أَخْبَرَنَا أَبُو بَكْرٍ أَحْمَدُ بْنُ مُحَمَّدِ بْنِ الْحَارِثِ الْأَصْبَهَانِيُّ أنبأ أَبُو مُحَمَّدِ بْنُ حَيَّانَ، ثنا إِبْرَاهِيمُ بْنُ مُحَمَّدِ بْنِ الْحَارِثِ، ثنا شَيْبَانُ، ح وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ، أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ، ثنا أَبُو دَاوُدَ، قَالَ: وَجَدْتُ فِي كِتَابِي، عَنْ شَيْبَانَ، ثنا مُحَمَّدُ بْنُ رَاشِدٍ، ثنا سُلَيْمَانُ، هُوَ ابْنُ مُوسَى، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، قَالَ: قَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " إِنَّ الْعَقْلَ مِيرَاثٌ بَيْنَ وَرَثَةِ الْقَتِيلِ عَلَى قَرَابَتِهِمْ، فَمَا فَضَلَ فَلِلْعَصَبَةِ " قَالَ: وَقَضَى رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنْ عَقْلَ الْمَرْأَةِ بَيْنَ عَصَبَتِهَا مَنْ كَانُوا لَا يَرِثُونَ مِنْهَا شَيْئًا إِلَّا مَا فَضَلَ عَنْ وَرَثَتِهَا، وَإِنْ قُتِلَتْ فَعَقْلُهَا بَيْنَ وَرَثَتِهَا، وَهُمْ يَقْتُلُونَ قَاتِلَهَا.
Amr bin Shu'ayb narrates from his father, and he from his grandfather (may Allah be pleased with him), that the Messenger of Allah (peace and blessings be upon him) said: "Blood money is inheritance among the heirs of the slain, and whatever remains is for the 'asabah (paternal male relatives)." And he said that the Prophet (peace and blessings be upon him) ruled: "The blood money owed for a woman's offence is upon her 'asabah, whoever they are, who inherit from her only what remains after her heirs. And if she is killed, her blood money is among her heirs, and it is they who will kill her killer."
