Bayhaqi 15766 — A mother who remarries loses her right of custody

Masruq (may Allah have mercy on him) says: Sayyiduna Umar (may Allah be pleased with him) divorced Umm Asim (may Allah be pleased with her), and Asim was in the lap of his maternal grandmother. Sayyiduna Umar (may Allah be pleased with him) and that woman brought the case to Sayyiduna Abu Bakr al-Siddiq (may Allah be pleased with him). Sayyiduna Abu Bakr al-Siddiq (may Allah be pleased with him) ruled that the child would stay with his grandmother and that Sayyiduna Umar (may Allah be pleased with him) would bear the expenses, and he said: She has more right to the child.
