باب: الأبوين إذا افترقا وهما في قرية واحدة، فالأم أحق بولدها ما لم تتزوج، وكانوا صغارا، فإذا بلغ أحدهم سبع أو ثمان سنين وهو يعقل خير بين أبيه وأمه، وكان عند أيهما اختار
Chapter: When parents separate while living in the same town, the mother has more right to her children while they are young as long as she does not remarry; when one of them reaches seven or eight years and has understanding, he is given the choice between his father and mother and stays with whichever he chooses

أَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ، أنبأ الشَّافِعِيُّ، أنبأ ابْنُ عُيَيْنَةَ، عَنْ يُونُسَ بْنِ عَبْدِ اللهِ الْجَرْمِيِّ، عَنْ عُمَارَةَ الْجَرْمِيِّ، قَالَ: خَيَّرَنِي عَلِيٌّ رَضِيَ اللهُ عَنْهُ، بَيْنَ أُمِّي، وَعَمِّي، ثُمَّ قَالَ لِأَخٍ لِي أَصْغَرَ مِنِّي: وَهَذَا أَيْضًا لَوْ قَدْ بَلَغَ مَبْلَغَ هَذَا لَخَيَّرْتُهُ، قَالَ الشَّافِعِيُّ، قَالَ إِبْرَاهِيمُ، عَنْ يُونُسَ، عَنْ عُمَارَةَ، عَنْ عَلِيٍّ، رَضِيَ اللهُ عَنْهُ مِثْلَهُ. وَقَالَ فِي الْحَدِيثِ: وَكُنْتُ ابْنَ سَبْعٍ أَوْ ثَمَانِ سِنِينَ،.
Umarah al-Jarmi says: Sayyiduna Ali (may Allah be pleased with him) gave me the choice between my mother and my paternal uncle, and then said about my younger brother: If he too were of this age, I would give him the choice as well.
Imam al-Shafi'i (may Allah have mercy on him) said: Ibrahim narrated from Yunus, from Umarah, from Sayyiduna Ali (may Allah be pleased with him) the like of it, and he said in the hadith: I was seven or eight years old at the time.
