باب: الأبوين إذا افترقا وهما في قرية واحدة، فالأم أحق بولدها ما لم تتزوج، وكانوا صغارا، فإذا بلغ أحدهم سبع أو ثمان سنين وهو يعقل خير بين أبيه وأمه، وكان عند أيهما اختار
Chapter: When parents separate while living in the same town, the mother has more right to her children while they are young as long as she does not remarry; when one of them reaches seven or eight years and has understanding, he is given the choice between his father and mother and stays with whichever he chooses

وَرَوَى الشَّافِعِيُّ فِي الْقَدِيمِ وَلَيْسَ ذَلِكَ فِي مَسْمُوعِنَا، عَنْ سُفْيَانَ بْنِ عُيَيْنَةَ، عَنْ ⦗٧⦘ يَزِيدَ بْنِ يَزِيدَ بْنِ جَابِرٍ، عَنْ إِسْمَاعِيلَ بْنِ عُبَيْدِ اللهِ بْنِ أَبِي الْمُهَاجِرِ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ غَنْمٍ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللهُ عَنْهُ خَيَّرَ غُلَامًا بَيْنَ أَبِيهِ وَأُمِّهِ.
Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) also gave a boy the choice to pick whichever of his mother or father he wished.
