أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، نا يَحْيَى بْنُ مَنْصُورٍ الْقَاضِي، نا مُحَمَّدُ بْنُ عَبْدِ السَّلَامِ، نا يَحْيَى بْنُ يَحْيَى قَالَ: قَرَأْتُ عَلَى مَالِكٍ وَأنا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ، أنا أَبُو بَكْرِ بْنُ دَاسَةَ، نا أَبُو دَاوُدَ، نا الْقَعْنَبِيُّ، عَنْ مَالِكٍ، عَنْ نَافِعٍ، عَنْ عَبْدِ اللهِ بْنِ عُمَرَ أَنَّهُ ⦗٦٨١⦘ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ عَلَى عَهْدِ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَسَأَلَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللهُ عَنْهُ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عَنْ ذَلِكَ فَقَالَ رَسُولُ اللهِ صلَّى الله عَلَيْهِ وَسَلَّمَ: " مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لِيُمْسِكْهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ ثُمَّ تَطْهُرَ ثُمَّ إِنْ شَاءَ أَمْسَكَ بَعْدَ ذَلِكَ وَإِنْ شَاءَ طَلَّقَ قَبْلَ أَنْ يَمَسَّ، فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللهُ أَنْ يُطَلَّقَ لَهَا النِّسَاءُ " رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ، عَنِ ابْنِ أَبِي أُوَيْسٍ عَنْ مَالِكٍ، وَرَوَاهُ مُسْلِمٌ، عَنْ يَحْيَى بْنِ يَحْيَى.
It is narrated from Abdullah bin Umar (may Allah be pleased with them both) that he divorced his wife while she was menstruating, in the time of the Messenger of Allah (peace and blessings be upon him). Umar bin al-Khattab (may Allah be pleased with him) asked the Messenger of Allah (peace and blessings be upon him) about it, and the Messenger of Allah (peace and blessings be upon him) said: "Command him to take her back, then keep her until she becomes pure, then menstruates, then becomes pure; then, if he wishes, he may keep her after that, and if he wishes, he may divorce her before touching her. That is the waiting period for which Allah Almighty has commanded that women be divorced."
