أَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ، أنا أَبُو الْحَسَنِ الطَّرَائِفِيُّ، نا عُثْمَانُ بْنُ سَعِيدٍ، نا عَبْدُ اللهِ بْنُ صَالِحٍ، عَنْ مُعَاوِيَةَ بْنِ صَالِحٍ، عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللهُ عَنْهُمَا فِي آيَةِ الْإِيلَاءِ قَالَ: " الرَّجُلُ يَحْلِفُ لِامْرَأَتِهِ بِاللهِ لَا يَنْكِحُهَا تَتَرَبَّصُ أَرْبَعَةَ أَشْهُرٍ فَإِنْ هُوَ نَكَحَهَا كَفَّرَ عَنْ يَمِينِهِ بِإِطْعَامِ عَشَرَةِ مَسَاكِينَ، أَوْ كِسْوَتِهِمْ، أَوْ تَحْرِيرِ رَقَبَةٍ فَمَنْ لَمْ يَجِدْ ⦗٦٢٤⦘ فَصِيَامُ ثَلَاثَةِ أَيَّامٍ، وَإِنْ مَضَتْ أَرْبَعَةُ أَشْهُرٍ قَبْلَ أَنْ يَنْكِحَهَا خَيَّرَهُ السُّلْطَانُ إِمَّا أَنْ يُفِيءَ فَيُرَاجِعَ، وَإِمَّا أَنْ يَعْزِمَ فَيُطَلِّقَ، كَمَا قَالَ اللهُ سُبْحَانَهُ وَتَعَالَى ".
Ali bin Abi Talhah (may Allah have mercy on him) narrates from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) regarding the verse of ila: A man swears that he will not have intercourse with his wife, and she waits four months. If the husband has intercourse with his wife, he must expiate his oath, which is feeding ten poor people, clothing them, or freeing a slave; whoever does not find this must fast three days. If four months pass before intercourse, the ruler will give him the choice: if he wants to return, he returns, or if he intends divorce, he divorces, just as Allah has said.
