وَأَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ، أنبأ أَبُو الْحَسَنِ أَحْمَدُ بْنُ مُحَمَّدِ بْنِ عَبْدُوسٍ ثنا عُثْمَانُ بْنُ سَعِيدٍ، ثنا عَبْدُ اللهِ بْنُ صَالِحٍ، عَنْ مُعَاوِيَةَ بْنِ صَالِحٍ، عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ، عَنِ ابْنِ عَبَّاسٍ، فِي قَوْلِهِ تَعَالَى: {إِلَّا أَنْ يَعْفُونَ} [البقرة: ٢٣٧] قَالَ: " هِيَ الْمَرْأَةُ الثَّيِّبُ أَوِ الْبِكْرُ يُزَوِّجُهَا غَيْرُ أَبِيهَا فَجَعَلَ اللهُ الْعَفْوَ إِلَيْهِنَّ إِنْ شِئْنَ تَرَكْنَ، وَإِنْ شِئْنَ أَخَذْنَ نِصْفَ الصَّدَاقِ "، ثُمَّ قَالَ: " {أَوْ يَعْفُوَ الَّذِي بِيَدِهِ عُقْدَةُ النِّكَاحِ} [البقرة: ٢٣٧] وَهُوَ أَبُو الْجَارِيَةِ الْبِكْرِ، جَعَلَ اللهُ الْعَفْوَ إِلَيْهِ لَيْسَ لَهَا مَعَهُ أَمْرٌ إِذَا طُلِّقَتْ مَا كَانَتْ فِي حِجْرِهِ ".
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) said concerning the words of Allah Almighty, "Unless they forgo it, or forgoes it" [Surah al-Baqarah: 237]: This is the previously married woman or the virgin who is married off by someone other than her father; if they wish they may take the dowry, or they may forgo it. Then he said: "Or the one in whose hand is the marriage tie forgoes it" [Surah al-Baqarah: 237] means the father of the virgin girl. Allah has given the right to forgo to him, and she has no say alongside him when she is divorced, as long as she is under his care.
