Bayhaqi 14426 — A man marrying a woman on the condition

Muhammad bin Sirin (may Allah have mercy on him) said that Al-Ash'ath bin Qays (may Allah be pleased with him) travelled with a man and the man's wife pleased him greatly. The man died on the way, so Al-Ash'ath bin Qays (may Allah be pleased with him) proposed marriage to the woman, but she refused to marry him except on her own decision (as to the dowry). So Al-Ash'ath bin Qays (may Allah be pleased with him) married her on her own decision. Then Al-Ash'ath (may Allah be pleased with him) divorced her before she had decided, and said: Give your decision.
The woman said: I decide on such-and-such and such-and-such slaves, who were his father's inherited slaves. He said: Decide on something other than these. The woman refused. He came to Sayyiduna Umar (may Allah be pleased with him) and said: O Commander of the Believers, I have been overcome three times. He asked: What are they? He said: I fell in love with a woman. He said: That is something you had no control over. He said: Then I married her on her own decision, then divorced her before she had decided. Sayyiduna Umar (may Allah be pleased with him) said: She is a woman of the Muslims. Imam al-Shafi'i (may Allah have mercy on him) said: Sayyiduna Umar (may Allah be pleased with him) meant that she has the dowry of a Muslim woman, that is, like the women of her own family.
