باب: نكاح المحدثين وما جاء في قول الله عز وجل: الزاني لا ينكح إلا زانية أو مشركة والزانية لا ينكحها إلا زان أو مشرك وحرم ذلك على المؤمنين
Chapter: The marriage of fornicators, and reports on the saying of Allah the Mighty and Majestic: "The fornicator does not marry except a fornicatress or a polytheist woman, and the fornicatress none marries except a fornicator or a polytheist man, and that has been forbidden to the believers"

أَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ، وَأَبُو بَكْرِ بْنُ الْحَسَنِ قَالَا: ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ، أنبأ الشَّافِعِيُّ، أنبأ سُفْيَانُ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنِ ابْنِ الْمُسَيِّبِ، فِي قَوْلِهِ تَعَالَى: {الزَّانِي لَا يَنْكِحُ إِلَّا زَانِيَةً أَوْ مُشْرِكَةً} [النور: ٣] الْآيَةَ قَالَ: هِيَ مَنْسُوخَةٌ نَسَخَتْهَا آيَةُ: {وَأَنْكِحُوا الْأَيَامَى} [النور: ٣٢] مِنْكُمْ قَالَ: " فَهِيَ مِنْ أَيَامَى الْمُسْلِمِينَ ".
Yahya bin Sa'id (may Allah have mercy on him) narrates from Sa'id bin al-Musayyib (may Allah have mercy on him) that concerning "The fornicator does not marry except a fornicatress or a polytheist woman" [Surah al-Nur: 3] he said: It has been abrogated by this verse: "And marry the unmarried among you" [Surah al-Nur: 32]. So these are (among) the unmarried women of the Muslims.
