باب: نكاح المحدثين وما جاء في قول الله عز وجل: الزاني لا ينكح إلا زانية أو مشركة والزانية لا ينكحها إلا زان أو مشرك وحرم ذلك على المؤمنين
Chapter: The marriage of fornicators, and reports on the saying of Allah the Mighty and Majestic: "The fornicator does not marry except a fornicatress or a polytheist woman, and the fornicatress none marries except a fornicator or a polytheist man, and that has been forbidden to the believers"

أَخْبَرَنَا أَبُو الْقَاسِمِ زَيْدُ بْنُ جَعْفَرِ بْنِ مُحَمَّدٍ الْعَلَوِيُّ، وَعَبْدُ الْوَاحِدِ بْنُ مُحَمَّدِ بْنِ النَّجَّارِ الْمُقْرِئُ بِالْكُوفَةِ قَالَا: ثنا أَبُو جَعْفَرِ بْنُ دُحَيْمٍ، ثنا إِبْرَاهِيمُ بْنُ إِسْحَاقَ الْقَاضِي، ثنا قَبِيصَةُ، عَنْ سُفْيَانَ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، فِي قَوْلِهِ تَعَالَى: {إِنَّهُ كَانَ لِلْأَوَّابِينَ غَفُورًا} قَالَ: " يُذْنِبُ ثُمَّ يَتُوبُ، ثُمَّ يُذْنِبُ ثُمَّ يَتُوبُ " قَالَ: وَسَمِعْتُهُ يَقُولُ: {الزَّانِيَةُ لَا يَنْكِحُهَا إِلَّا زَانٍ أَوْ مُشْرِكٌ} [النور: ٣] قَالَ: نَسَخَتْهَا آيَةُ: {وَأَنْكِحُوا الْأَيَامَى} [النور: ٣٢] مِنْكُمْ وَالصَّالِحِينَ مِنْ عِبَادِكُمْ وَإِمَائِكُمْ ".
Yahya bin Sa'id (may Allah have mercy on him) narrates from Sa'id bin al-Musayyib (may Allah have mercy on him) concerning the saying of Allah Almighty: "Indeed, He is ever Forgiving to those who often turn back (to Him)." [Surah al-Isra: 25] He said: A servant sins and then repents, then sins and then repents. (He said:) And I heard him saying that the verse "The fornicator does not marry except a fornicatress or a polytheist woman" [Surah al-Nur: 3] was abrogated by this verse: "And marry the unmarried among you and the righteous among your male slaves and female slaves." [Surah al-Nur: 32]
