باب: لا يزوج نفسه امرأة هو وليها كما لا يشتري من نفسه شيئا هو ولي بيعه
Chapter: He may not marry himself to a woman of whom he is the guardian, just as he may not buy from himself something whose sale he is in charge of

أَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ الْفَضْلِ الْقَطَّانُ بِبَغْدَادَ، أنبأ عَبْدُ اللهِ بْنُ جَعْفَرِ بْنِ ⦗٢٣١⦘ دُرُسْتَوَيْهِ، ثنا يَعْقُوبُ بْنُ سُفْيَانَ، ثنا ابْنُ بَشَّارٍ، ثنا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ، عَنْ سُفْيَانَ، عَنْ مُحَمَّدِ بْنِ خَالِدٍ، عَنْ رَجُلٍ يُقَالُ لَهُ الْحَكَمُ، عَنِ ابْنِ عَبَّاسٍ قَالَ: " لَا نِكَاحَ إِلَّا بِأَرْبَعَةٍ وَلِيٍّ وَشَاهِدَيْنِ وَخَاطِبٍ " وَلَهُ شَاهِدٌ عَنِ ابْنِ عَبَّاسٍ بِإِسْنَادٍ مُنْقَطِعٍ.
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) says that a marriage takes place in the presence of four: 1. the guardian, 2. two witnesses, 3. the one marrying.
