أَخْبَرَنَا أَبُو مُحَمَّدِ بْنُ يُوسُفَ، أنبأ أَبُو سَعِيدِ بْنُ الْأَعْرَابِيِّ، ثنا الزَّعْفَرَانِيُّ، ثنا عَبْدُ الْوَهَّابِ، عَنْ سَعِيدٍ، عَنْ قَتَادَةَ، عَنْ خِلَاسٍ، أَنَّ امْرَأَةً زَوَّجَهَا أَوْلِيَاؤُهَا بِالْجَزِيرَةِ مِنْ عُبَيْدِ اللهِ بْنِ الْحُرِّ، وَزَوَّجَهَا أَهْلُهَا بَعْدَ ذَلِكَ بِالْكُوفَةِ، فَرَفَعُوا ذَلِكَ إِلَى عَلِيٍّ رَضِيَ اللهُ عَنْهُ، فَفَرَّقَ بَيْنَهَا وَبَيْنَ زَوْجِهَا الْآخَرِ، وَرَدَّهَا إِلَى زَوْجِهَا الْأَوَّلِ، وَجَعَلَ لَهَا صَدَاقَهَا بِمَا أَصَابَ مِنْ فَرْجِهَا، وَأَمَرَ زَوْجَهَا الْأَوَّلَ أَنْ لَا يَقْرَبَهَا حَتَّى تَنْقَضِيَ عِدَّتُهَا.
Qatadah (may Allah have mercy on him) narrates from Khilas (may Allah have mercy on him) that a woman was married by her guardians in al-Jazirah to Ubaydullah bin al-Hurr, and afterwards her family married her off in Kufah. They brought the case to Sayyiduna Ali (may Allah be pleased with him), and Sayyiduna Ali (may Allah be pleased with him) separated the woman from the second husband, returned her to the first husband, made the dower (mahr) binding on the second for the benefit he had taken, and ordered the first husband not to go near her until her waiting period ('iddah) was complete.
