باب: الرجل يقول: ثلث مالي إلى فلان يضعه حيث أراه الله، وما يختار للموصى إليه أن يعطيه أهل الحاجة من قرابة الميت حتى يغنيهم ثم رضعاءه ثم جيرانه
Chapter: A man who says: A third of my wealth is for so-and-so to spend as Allah guides him, and that the executor should prefer giving it to the needy relatives of the deceased until they are sufficient, then his foster relatives, then his neighbours
Bayhaqi 12607 — A man who says: A third of my wealth is for so-and-so
اُردوEn
وَأَخْبَرَنَا أَبُو طَاهِرٍ الْفَقِيهُ، أنا أَبُو بَكْرٍ مُحَمَّدُ بْنُ الْحُسَيْنِ الْقَطَّانُ، ثنا عَلِيُّ بْنُ الْحَسَنِ الدَّارَابَجِرْدِيُّ، ثنا يَحْيَى بْنُ يَحْيَى قَالَ: قَرَأْتُ عَلَى مَالِكٍ فَذَكَرَهُ وَقَالَ: بَرِيحَا رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ عَبْدِ اللهِ بْنِ مَسْلَمَةَ، وَرَوَاهُ مُسْلِمٌ عَنْ يَحْيَى بْنِ يَحْيَى.
A narration like the previous one is reported from Imam Malik (may Allah have mercy on him), but in it the wording is "Bariha".
