Bayhaqi 12530 — The abrogation of inheritance through alliance

It is narrated from Sayyidah Aishah (may Allah be pleased with her) that Abu Hudhayfah bin Utbah bin Rabi'ah was among those who were present at Badr with the Messenger of Allah (peace and blessings be upon him). He had adopted Salim as his son and married him to his niece, Hind bint al-Walid bin Utbah, while Salim was the freed slave of a woman of the Ansar, just as the Prophet (peace and blessings be upon him) had adopted Zayd bin Harithah as his son. In the Jahiliyyah it was the custom that when someone adopted a person as his son, people would call him by the adopter's name, and that son would also be entitled to his inheritance. This continued until the verse "Call them by (the names of) their fathers; that is more just in the sight of Allah. But if you do not know their fathers, then they are your brothers in religion and your freed clients" [Surah al-Ahzab: 5] was revealed. Then people began to call them by their fathers' names, and whoever's father was not known was called a client (mawla) or a brother.
