Bayhaqi 12322 — The share of maternal brothers and sisters
قَالَ اللهُ تَبَارَكَ وَتَعَالَى {وَإِنْ كَانَ رَجُلٌ يُورَثُ كَلَالَةً أَوِ امْرَأَةٌ وَلَهُ أَخٌ أَوْ أُخْتٌ فَلِكُلِّ وَاحِدٍ مِنْهُمَا السُّدُسُ فَإِنْ كَانُوا أَكْثَرَ مِنْ ذَلِكَ فَهُمْ شُرَكَاءُ فِي الثُّلُثِ} [النساء: 12].
Allah, the Blessed and Exalted, says: "And if a man or a woman whose inheritance is in question is kalalah (that is, has neither parents nor children), and has a brother or a sister, then for each one of them is a sixth; but if they are more than that, they share in a third." [Surah al-Nisa: 12]
أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، أنا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا مُحَمَّدُ بْنُ نَصْرٍ، ثنا يَحْيَى بْنُ يَحْيَى، أنا هُشَيْمٌ، عَنْ يَعْلَى بْنِ عَطَاءٍ، عَنِ الْقَاسِمِ بْنِ عَبْدِ اللهِ بْنِ رَبِيعَةَ بْنِ قَانِفٍ، أَنَّ سَعْدًا كَانَ يَقْرَؤُهَا " وَإِنْ كَانَ رَجُلٌ يُورَثُ كَلَالَةً أَوِ امْرَأَةٌ وَلَهُ أَخٌ أَوْ أُخْتٌ مِنْ أُمٍّ ".
Sayyiduna Sa'd (may Allah be pleased with him) used to recite this verse: "And if a man or a woman whose inheritance is in question is kalalah and has a brother or a sister" [Surah al-Nisa: 12] from the mother's side.
