Bayhaqi 12211 — Those who held that relatives through the womb inherit

وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ، أنا مُحَمَّدُ بْنُ بَكْرٍ، ثنا أَبُو دَاوُدَ، ثنا عَبْدُ السَّلَامِ بْنُ عَتِيقٍ الدِّمَشْقِيُّ، ثنا مُحَمَّدُ بْنُ الْمُبَارَكِ، ثنا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ يَزِيدَ بْنِ حُجْرٍ، عَنْ صَالِحِ بْنِ يَحْيَى بْنِ الْمِقْدَامِ، عَنْ أَبِيهِ، عَنْ جَدِّهِ قَالَ: سَمِعْتُ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ يَقُولُ: " أَنَا وَارِثُ مَنْ لَا وَارِثَ لَهُ، أَفُكُّ عُنِيَّهُ وَأَرِثُ مَالَهُ، وَالْخَالُ وَارِثُ مَنْ لَا وَارِثَ لَهُ، يَفُكُّ عُنِيَّهُ وَيَرِثُ مَالَهُ ".
Salih bin Yahya bin al-Miqdam narrates from his father, and he from his grandfather (may Allah be pleased with him), who said: I heard the Messenger of Allah (peace and blessings be upon him) say: "I am the heir of one who has no heir: I will ransom his captives and inherit his wealth. And the maternal uncle is the heir of one who has no heir: he will ransom his captives and inherit his wealth."
