Bayhaqi 11882 — One who judges between people by ijtihad

Amr bin Yahya al-Mazini (may Allah have mercy on him) narrates from his father that Sayyiduna al-Dahhak bin Khalifah (may Allah be pleased with him) dug a small canal (channel) for himself from al-Urayd and wanted to pass it through the land of Sayyiduna Muhammad bin Maslamah (may Allah be pleased with him), but Sayyiduna Muhammad bin Maslamah (may Allah be pleased with him) refused. Sayyiduna al-Dahhak (may Allah be pleased with him) informed Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) of this (matter). He called Sayyiduna Muhammad bin Maslamah (may Allah be pleased with him) and ordered him to let him through. Sayyiduna Muhammad bin Maslamah (may Allah be pleased with him) refused, so Sayyiduna Umar (may Allah be pleased with him) said: "Why do you prevent your brother from something that benefits him and benefits you too? You too will drink from it (water your crops) first and last, and it does not harm you." Sayyiduna Muhammad bin Maslamah (may Allah be pleased with him) said: "No," that is, he refused. So Sayyiduna Umar (may Allah be pleased with him) said: "By Allah! He will certainly pass it through, even if it is over your belly."
This is mursal (its chain is broken); Yahya bin Sa'id al-Ansari also narrated it with the same meaning, and that too is mursal.
