Bayhaqi 11746 — One who cultivates another's land without

It is narrated from Sayyiduna Rafi' bin Khadij (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever cultivates the land of a people without their permission has no share in the crop, and he is to be given the value of his expenses."
Ibn Adi said: I used to think that (the narration of) Ata from Rafi' bin Khadij was mursal, until it became clear to me that (the narration of) Abu Ishaq from Ata is also mursal. Yusuf said: No one besides Hajjaj mentions Abd al-Aziz (bin Rufay'); they say: from Abu Ishaq, from Ata. Abu Ishaq used to commit tadlis, and the scholars of hadith say that (the narration of) Ata from Rafi' is munqati' (broken). Abu Sulayman al-Khattabi said: This hadith is not established according to the experts in hadith; Musa bin Harun al-Hammal used to reject this hadith and declare it weak, saying: No one narrated it from Abu Ishaq except Sharik, no one narrated it from Ata except Abu Ishaq, and Ata did not hear anything from Rafi' bin Khadij. Al-Bukhari also declared it weak. Uqbah bin al-Asamm narrated it from Ata, saying: Rafi' bin Khadij narrated to us; but Uqbah is da'if (weak) and is not used as proof. As for the hadith of Bukayr bin Amir al-Bajali from Ibn Abi Nu'm from Rafi', although Muslim bin al-Hajjaj cited Bukayr as supporting evidence in a hadith other than this one, Yahya bin Sa'id al-Qattan, Hafs bin Ghiyath, Ahmad bin Hanbal and Yahya bin Ma'in declared him weak. As for the third hadith, it was narrated by Abu Ja'far Umayr bin Yazid al-Khatmi, and I have not seen al-Bukhari or Muslim use him as proof in any hadith, and Allah knows best. It has also been narrated from Rifa'ah bin Rafi' bin Khadij from the Prophet (peace and blessings be upon him) with this meaning, but it is munqati' (broken).
