أَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمُقْرِئُ، أنا الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ، ثنا يُوسُفُ بْنُ يَعْقُوبَ، ثنا مُحَمَّدُ بْنُ أَبِي بَكْرٍ، ثنا فُضَيْلُ بْنُ سُلَيْمَانَ، ثنا مُوسَى بْنُ عُقْبَةَ بْنِ أَبِي عَيَّاشٍ الْأَسَدِيُّ، قَالَ: حَدَّثَنِي إِسْحَاقُ بْنُ يَحْيَى بْنِ الْوَلِيدِ بْنِ عُبَادَةَ بْنِ الصَّامِتِ، عَنْ عُبَادَةَ بْنِ الصَّامِتِ رَضِيَ اللهُ عَنْهُ، قَالَ: " إِنَّ مِنْ قَضَاءِ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنَّ ثَمَرَ النَّخْلِ لِمَنْ أَبَّرَهَا إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ، وَأَنَّ مَالَ الْمَمْلُوكِ لِمَنْ بَاعَهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ ".
Sayyiduna Ubadah bin al-Samit (may Allah be pleased with him) said that among the rulings of the Messenger of Allah (peace and blessings be upon him) is: "The fruit of the palm tree belongs to the one who pollinated it, unless the buyer stipulates (otherwise); and the property of a slave belongs to the one who sold him, unless the buyer stipulates (otherwise)."
