وَأَخْبَرَنَا أَبُو الْقَاسِمِ هِبَةُ اللهِ بْنُ الْحَسَنِ، أنا عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ أَحْمَدَ، أنا عُثْمَانُ بْنُ أَحْمَدَ، ثنا أَبُو قِلَابَةَ، ثنا عُبَيْدُ اللهِ بْنُ عَبْدِ الْمَجِيدِ، ثنا رَبَاحُ بْنُ أَبِي مَعْرُوفٍ، عَنِ ابْنِ أَبِي مُلَيْكَةَ، أَنَّ عُثْمَانَ، ابْتَاعَ مِنْ طَلْحَةَ بْنِ عُبَيْدِ اللهِ أَرْضًا بِالْمَدِينَةِ نَاقَلَهُ بِأَرْضٍ لَهُ بِالْكُوفَةِ فَلَمَّا تَبَايَنَا نَدِمَ عُثْمَانُ ثُمَّ قَالَ: " بَايَعْتُكَ مَا لَمْ أَرَهُ "، فَقَالَ طَلْحَةُ: " إِنَّمَا النَّظَرُ لِي إِنَّمَا ابْتَعْتُ مَغِيبًا، وَأَمَّا أَنْتَ فَقَدْ رَأَيْتَ مَا ابْتَعْتَ " فَجَعَلَا بَيْنَهُمَا حَكَمًا فَحَكَّمَا جُبَيْرَ بْنَ مُطْعِمٍ فَقَضَى عَلَى عُثْمَانَ أَنَّ الْبَيْعَ جَائِزٌ وَأنَّ النَّظَرَ لِطَلْحَةَ أَنَّهُ ابْتَاعَ مَغِيبًا وَرُوِيَ فِي ذَلِكَ عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَلَا يَصِحُّ.
Ibn Abi Mulaykah (may Allah have mercy on him) says that Sayyiduna Uthman (may Allah be pleased with him) bought land in Madinah from Sayyiduna Talhah bin Ubaydullah (may Allah be pleased with him), exchanging it for land of his in Kufah. When they had concluded the sale, Sayyiduna Uthman (may Allah be pleased with him) became uneasy, and then said: "I have sold something I have not seen." Sayyiduna Talhah (may Allah be pleased with him) said: "The option of seeing belongs to me, because I bought something absent, whereas you have seen what you bought." They appointed an arbiter between themselves; Sayyiduna Jubayr bin Mut'im (may Allah be pleased with him) was their arbiter. Sayyiduna Jubayr (may Allah be pleased with him) ruled against Sayyiduna Uthman (may Allah be pleased with him) that the sale was valid, and that the option of seeing belonged to Sayyiduna Talhah (may Allah be pleased with him), because he had bought something absent.
