Hadith 3246
نَا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، نَا أَبُو مُوسَى مُحَمَّدُ بْنُ مَثْنَى ، نَا مُعَاذُ بْنُ هَانِئٍ ، نَا مُحَمَّدُ بْنُ مُسْلِمٍ ، حَدَّثَنِي عَمْرُو بْنُ دِينَارٍ ، عَنْ عِكْرِمَةَ ، عَنِ ابْنِ عَبَّاسٍ ، " أَنَّ رَجُلا قَتَلَ رَجُلا عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَجَعَلَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ دِيَتَهُ اثْنَا عَشَرَ أَلْفًا ، وَذَلِكَ قَوْلُهُ : إِلا أَنْ أَغْنَاهُمُ اللَّهُ وَرَسُولُهُ مِنْ فَضْلِهِ سورة التوبة آية 74 بِأَخْذِهِمُ الدِّيَةَ " .
Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates: In the blessed time of the Prophet (peace and blessings be upon him), a man killed another man, so the Prophet (peace and blessings be upon him) set his blood money at twelve thousand dirhams. This is what is meant by Allah Almighty’s statement: “Except in the case when Allah and His Messenger enrich them out of His bounty.” That is, those people will become wealthy by receiving the blood money.
Hadith 3247
حَدَّثَنَا حَدَّثَنَا الْحُسَيْنُ بْنُ صَفْوَانَ ، نَا عَبْدُ اللَّهِ بْنُ أَحْمَدَ ، حَدَّثَنِي أَبِي ، نَا يَحْيَى بْنُ سَعِيدٍ ، عَنِ ابْنِ أَبِي عَرُوبَةَ ، عَنْ قَتَادَةَ ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ ، عَنْ عُمَرَ ، قَالَ : " دِيَةُ الْيَهُودِيِّ وَالنَّصْرَانِيِّ أَرْبَعَةُ آلافٍ ، وَالْمَجُوسِيِّ ثَمَانُمِائَةٍ " .
Sayyiduna Umar (may Allah be pleased with him) said: "The blood money (diyah) for a Jew and a Christian will be four thousand dirhams each, while the blood money for a Magian will be eight hundred dirhams."
Hadith 3248
نَا نَا الْحُسَيْنُ بْنُ صَفْوَانَ ، نَا عَبْدُ اللَّهِ بْنُ أَحْمَدَ ، نَا أَبُو مُحَمَّدٍ زَكَرِيَّا بْنُ يَحْيَى زَحْمَوَيْهِ ، نَا شَرِيكٌ ، عَنْ ثَابِتٍ أَبِي الْمِقْدَامِ ، وَيَحْيَى بْنِ سَعِيدٍ ، كِلاهُمَا ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ ، قَالَ : " كَانَ عُمَرُ " يَجْعَلُ دِيَةَ الْيَهُودِيِّ وَالنَّصْرَانِيِّ أَرْبَعَةَ آلافٍ أَرْبَعَةَ آلافٍ ، وَالْمَجُوسِيِّ ثَمَانَمِائَةٍ ".
Saeed bin Musayyib narrates: Sayyiduna Umar (may Allah be pleased with him) fixed the blood money (diyah) of a Jew and a Christian at four thousand dirhams each, and the blood money of a Magian at eight hundred dirhams.
Hadith 3249
نَا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، نَا مُحَمَّدُ بْنُ عَبْدِ الْمَلِكِ بْنِ زَنْجُوَيْهِ ، نَا عُبَيْدُ اللَّهِ بْنُ عَبْدِ الْمَجِيدِ ، نَا عُبَيْدُ اللَّهِ بْنُ عَبْدِ الرَّحْمَنِ بْنِ مَوْهَبٍ ، حَدَّثَنِي مَالِكُ بْنُ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ ، عَنْ عَمْرَةَ ، عَنْ عَائِشَةَ ، قَالَتْ : " وُجِدَ فِي قَائِمِ سَيْفِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، كِتَابَانِ : إِنَّ أَشَدَّ النَّاسِ عُتُوًّا فِي الأَرْضِ ، رَجُلٌ ضَرَبَ غَيْرَ ضَارِبِهِ ، وَرَجُلٌ قَتَلَ غَيْرَ قَاتِلِهِ ، وَرَجُلٌ تَوَلَّى غَيْرَ أَهْلِ نِعْمَتِهِ ، فَمَنْ فَعَلَ ذَلِكَ ، فَقَدْ كَفَرَ بِاللَّهِ وَبِرُسُلِهِ ، لا يَقْبَلُ اللَّهُ مِنْهُ صَرْفًا وَلا عَدْلا ، وَفِي الآخَرِ : الْمُؤْمِنُونَ تَتَكَافَأُ دِمَاؤُهُمْ ، وَيَسْعَى بِذِمَّتِهِمْ أَدْنَاهُمْ ، لا يُقْتَلُ مُسْلِمٌ بِكَافِرٍ ، وَلا ذُو عَهْدٍ فِي عَهْدِهِ ، وَلا يَتَوَارَثُ أَهْلُ مِلَّتَيْنِ " ، مُخْتَصَرٌ.
Lady Aisha (may Allah be pleased with her) narrates: On the hilt of the sword of the Noble Prophet (peace and blessings be upon him) were found these two statements: "The most disobedient person on earth is the one who kills someone other than his killer (the narrator is in doubt, perhaps the words are:) who kills someone other than the one who killed him, and the person who attributes himself to someone other than his master; whoever does this has, as if, denied Allah and His Messenger. Allah will not accept any obligatory or voluntary act of worship from such a person. (The second statement is:) The life of the believers is of equal value, and the protection granted by any common individual among them must be respected. No Muslim will be killed in retaliation for a disbeliever, nor will any covenant-holder (dhimmi) be killed, and people of two different religions will not inherit from each other." (This narration is brief.)
Hadith 3250
نَا نَا ابْنُ مُبَشِّرٍ ، نَا مُحَمَّدُ بْنُ عُبَادَةَ ، نَا يَزِيدُ بْنُ هَارُونَ ، أنا سُلَيْمَانُ التَّيْمِيُّ ، عَنْ أَبِي مِجْلَزٍ ، " أَنَّ عَلِيًّا رَضِيَ اللَّهُ عَنْهُ " نَهَى أَصْحَابَهُ أَنْ يَبْسُطُوا عَلَى الْخَوَارِجِ حَتَّى يُحْدِثُوا حَدَثًا ، فَمَرُّوا بِعَبْدِ اللَّهِ بْنِ خَبَّابٍ فَأَخَذُوهُ فَانْطَلَقُوا بِهِ ، فَمَرُّوا عَلَى تَمْرَةٍ سَاقِطَةٍ مِنْ نَخْلَةٍ فَأَخَذَهَا بَعْضُهُمْ فَأَلْقَاهَا فِي فَمِهِ ، فَقَالَ لَهُ بَعْضُهُمْ : تَمْرَةُ مُعَاهَدٍ فِيمَ اسْتَحْلَلْتَهَا ؟ قَالَ عَبْدُ اللَّهِ بْنُ خَبَّابٍ : أَفَلا أَدُلُّكُمْ عَلَى مَنْ هُوَ أَعْظَمُ حُرْمَةً عَلَيْكُمْ مِنْ هَذَا ؟ قَالُوا : نَعَمْ ، قَالَ : أَنَا ، فَقَتَلُوهُ ، فَبَلَغَ ذَلِكَ عَلِيًّا فَأَرْسَلَ إِلَيْهِمْ أَنْ أَقِيدُونَا بِعَبْدِ اللَّهِ بْنِ خَبَّابٍ ، قَالُوا : كَيْفَ نَقِيدُكَ بِهِ وَكُلُّنَا قَتَلَهُ ؟ ، قَالَ : وَكُلُّكُمْ قَتَلَهُ ؟ ، قَالُوا : نَعَمْ ، قَالَ : اللَّهُ أَكْبَرُ ، ثُمَّ أَمَرَ أَنْ يَبْسُطُوا عَلَيْهِمْ ، وَقَالَ : وَاللَّهِ لا يُقْتَلُ مِنْكُمْ عَشْرَةٌ ، وَلا يَنْفَلِتُ مِنْهُمْ عَشَرَةٌ ، قَالُوا : فَقَتَلُوهُمْ ، قَالَ : فَقَالَ : اطْلُبُوا مِنْهُمْ ذَا الثُّدَيَّةِ " ، وَذَكَرَ بَاقِيَ الْحَدِيثِ.
Sayyiduna Ali (may Allah be pleased with him) forbade his companions from showing leniency towards the Khawarij. These people passed by Abdullah bin Khabbab, so they seized him and took him along with them. They passed by a date that had fallen from a tree; one of them picked up the date and put it in his mouth. Another person said to him, "You have eaten a date belonging to someone under a pact; on what basis have you made it lawful for yourself?" Abdullah bin Khabbab said, "Shall I not guide you to something that is more worthy of respect for you than this?" The people said, "Yes." Abdullah bin Khabbab said, "I am that (person)." Then those people killed Abdullah bin Khabbab. This news reached Sayyiduna Ali (may Allah be pleased with him), so he sent a message to the people: "You must pay us the blood money for Abdullah bin Khabbab." They replied, "How can we pay you his blood money when each one of us has killed him?" Sayyiduna Ali (may Allah be pleased with him) asked, "Did all of you kill him?" They replied, "Yes." So Sayyiduna Ali (may Allah be pleased with him) said, "Allahu Akbar!" Then he ordered that (his companions) launch a full attack on those people. Sayyiduna Ali (may Allah be pleased with him) said, "By Allah! Not even ten of you will be martyred, and not even ten of them will survive." The narrator states: So Sayyiduna Ali (may Allah be pleased with him) had all those people killed. Sayyiduna Ali (may Allah be pleased with him) ordered, "Look for the one with the protruding flesh among them." After this, the narrator mentioned the entire incident.
Hadith 3251
نَا عُبَيْدُ اللَّهِ بْنُ عَبْدِ الصَّمَدِ بْنِ الْمُهْتَدِي ، نَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ رِشْدِينَ ، نَا زَكَرِيَّا بْنُ يَحْيَى الْحِمْيَرِيُّ ، نَا الْحَكَمُ بْنُ عَبْدَةَ ، عَنْ أَيُّوبَ السَّخْتِيَانِيِّ ، عَنْ حُمَيْدِ بْنِ هِلالٍ الْعَدَوِيِّ ، عَنْ أَبِي الأَحْوَصِ ، قَالَ : لَمَّا كَانَ يَوْمُ النَّهْرَوَانِ كُنَّا مَعَ عَلِيِّ بْنِ أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُ دُونَ النَّهَرِ ، فَجَاءَتِ الْحَرُورِيَّةُ حَتَّى نَزَلُوا مِنْ وَرَائِهِ ، قَالَ عَلِيٌّ : لا تُحَرِّكُوهُمْ حَتَّى يُحْدِثُوا حَدَثًا ، فَانْطَلَقُوا إِلَى عَبْدِ اللَّهِ بْنِ خَبَّابٍ ، فَقَالُوا : حَدِّثْنَا حَدِيثًا حَدَّثَكَ بِهِ أَبُوكَ سَمِعَهُ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : حَدَّثَنِي أَبِي ، أَنَّهُ سَمِعَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : حَدَّثَنِي : تَكُونُ فِتْنَةٌ الْقَاعِدُ فِيهَا خَيْرٌ مِنَ الْقَائِمِ ، وَالْقَائِمُ خَيْرٌ مِنَ السَّاعِي ، فَقَدَّمُوهُ إِلَى النَّهَرِ فَذَبَحُوهُ كَمَا تُذْبَحُ الشَّاةُ ، فَأُتِيَ عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ فَأُخْبِرَ ، فَقَالَ : اللَّهُ أَكْبَرُ ، نَادُوهُمْ أَنْ أَخْرِجُوا إِلَيْنَا قَاتَلَ عَبْدِ اللَّهِ بْنِ خَبَّابٍ ، فَقَالُوا : كُلُّنَا قَتَلَهُ ، ثَلاثَ مَرَّاتٍ ، فَقَالَ عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ لأَصْحَابِهِ : دُونَكُمُ الْقَوْمُ ، فَمَا لَبِثَ أَنْ قَتَلَهُمُ عَلِيٌّ وَأَصْحَابُهُ " ، وَذَكَرَ بَاقِيَ الْحَدِيثِ.
Abu Ahwas narrates: On the day of the Battle of Nahrawan, we were on one side of the river with Sayyiduna Ali ibn Abi Talib (may Allah be pleased with him), when the Kharijites came and camped on the other side of the river. Sayyiduna Ali (may Allah be pleased with him) said: "Do not provoke them, unless they themselves commit any wrongdoing." Those people went to Abdullah ibn Khabbab and said: "Tell us a hadith that your father narrated to you, which he heard from the Prophet Muhammad (peace and blessings be upon him)." So Abdullah ibn Khabbab said: "My father narrated to me that he heard the Prophet Muhammad (peace and blessings be upon him) say: 'A time of tribulation will come in which the one who is sitting will be better than the one who is standing, and the one who is standing will be better than the one who is running.'" (The narrator says:) Those people (i.e., the Kharijites) took him (i.e., Abdullah ibn Khabbab) to the bank of the river and slaughtered him as a goat is slaughtered. When this news reached Sayyiduna Ali (may Allah be pleased with him), he said: "Allahu Akbar!" and said: "Call out to them loudly, say that they should send the killer of Abdullah ibn Khabbab to us." So those people replied three times: "We all killed him." Then Sayyiduna Ali (may Allah be pleased with him) said to his companions: "Now attack them." The narrator says: After that, Sayyiduna Ali (may Allah be pleased with him) and his companions killed those people. The narrator says: After that, (the one narrating) narrated the rest of the narration.
Hadith 3252
نَا عَبْدُ الصَّمَدِ بْنُ عَلِيٍّ ، نَا السَّرِيُّ بْنُ سَهْلٍ ، نَا عَبْدُ اللَّهِ بْنُ رُشَيْدٍ ، نَا عُثْمَانُ الْبُرِّيُّ ، عَنْ جُوَيْبِرٍ ، عَنِ الضَّحَّاكِ ، عَنِ ابْنِ عَبَّاسٍ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لا يُقْتَلُ حُرٌّ بِعَبْدٍ " .
Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates: The Noble Prophet (peace and blessings of Allah be upon him) said: "A free person will not be killed in retaliation for a slave."
Hadith 3253
نَا نَا ابْنُ الْجُنَيْدِ ، نَا زِيَادُ بْنُ أَيُّوبَ ، نَا الْقَاسِمُ بْنُ مَالِكٍ ، نَا لَيْثٌ ، عَنِ الْحَكَمِ ، قَالَ : قَالَ عَلِيٌّ ، وَابْنُ مَسْعُودٍ : إِذَا قَتَلَ الْحُرُّ الْعَبْدَ مُتَعَمِّدًا فَهُوَ قَوَدُهُ " ، لا تَقُومُ بِهِ حَجَّةٌ ، لأَنَّهُ مُرْسَلٌ.
Sayyiduna Ali (may Allah be pleased with him) and Sayyiduna Abdullah ibn Mas'ud (may Allah be pleased with him) say: "When a free person deliberately kills a slave, then (in this case, retribution will not be taken) rather, blood money will be paid." (Imam Daraqutni, may Allah have mercy on him, says:) This narration cannot be used as evidence, because it is mursal.
Hadith 3254
نا أَبُو عُبَيْدٍ الْقَاسِمُ بْنُ إِسْمَاعِيلَ ، نَا أَبُو السَّائِبِ سَلْمُ بْنُ جُنَادَةَ ، نَا وَكِيعٌ ، عَنْ إِسْرَائِيلَ ، عَنْ جَابِرٍ ، عَنْ عَامِرٍ ، قَالَ : قَالَ عَلِيٌّ : " مِنَ السُّنَّةِ أَنْ لا يُقْتَلَ مُؤْمِنٌ بِكَافِرٍ ، وَمِنَ السُّنَّةِ أَنْ لا يُقْتَلَ حُرٌّ بِعَبْدٍ " .
Sayyiduna Ali (may Allah be pleased with him) said: "The Sunnah (prescribed way) is: a Muslim should not be killed in retaliation for a disbeliever; the Sunnah (prescribed way) is: a free person should not be killed in retaliation for a slave."
Hadith 3255
نَا نَا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ الْحَسَنِ ، نَا أَبُو أَحْمَدَ ، نَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، نَا عَبَّادُ بْنُ الْعَوَّامِ ، عَنْ حَجَّاجٍ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ ، " أَنَّ أَبَا بَكْرٍ ، وَعُمَرَ اللَّهُ عَنْهُمَا ، كَانَا لا يَقْتُلانِ الْحُرَّ بِقَتْلِ الْعَبْدِ " ،.
Amr bin Shu'aib narrates from his father, from his grandfather: Sayyiduna Abu Bakr (may Allah be pleased with him) and Sayyiduna Umar (may Allah be pleased with him) would not have a free person killed (in retribution) for killing a slave.
Hadith 3256
نَا مُحَمَّدُ بْنُ الْحَسَنِ الْمُقْرِئُ ، نَا أَحْمَدُ بْنُ الْعَبَّاسِ الطَّبَرِيُّ ، نَا إِسْمَاعِيلُ بْنُ سَعِيدٍ ، نَا عَبَّادُ بْنُ الْعَوَّامِ ، عَنْ عَمْرُو بْنُ عَامِرٍ ، وَالْحَجَّاجُ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ ، مِثْلَهُ سَوَاءٌ.
This narration is also transmitted with another chain of transmission.
Hadith 3257
نَا نَا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ عَبْدَكَ ، نَا عَمْرُو بْنُ تَمِيمٍ ، نَا أَبُو غَسَّانَ ، نَا إِسْرَائِيلُ ، عَنْ جَابِرٍ ، عَنْ عَامِرٍ ، قَالَ : قَالَ عَلِيُّ رَضِيَ اللَّهُ عَنْهُ : " مِنَ السُّنَّةِ أَنْ لا يُقْتَلَ مُسْلِمٌ بِذِي عَهْدٍ ، وَلا حُرٌّ بِعَبْدٍ " .
Sayyiduna Ali (may Allah be pleased with him) said: "The Sunnah (prescribed way) is: A Muslim will not be killed in retaliation for a Mu'ahid (i.e., a non-Muslim under covenant), and a free person will not be killed in retaliation for a slave."
Hadith 3258
نَا نَا مُحَمَّدُ بْنُ الْحَسَنِ ، نَا أَحْمَدُ بْنُ الْعَبَّاسِ ، نَا إِسْمَاعِيلُ بْنُ سَعِيدٍ ، نَا عَبَّادُ بْنُ الْعَوَّامِ ، عَنِ الْحَجَّاجِ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ ، قَالَ : قَالَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ : " فِي الْحُرِّ يَقْتُلُ الْعَبْدَ ، قَالَ : فِيهِ ثَمَنُهُ " .
Amr bin Shu'aib narrates from his father, from his grandfather: Sayyiduna Umar (may Allah be pleased with him) said regarding a slave of a free man being killed: "Its value (as blood money) will be paid."
Hadith 3259
نَا الْحَسَنُ بْنُ أَحْمَدَ بْنِ سَعِيدٍ الرَّهَاوِيُّ ، أَخْبَرَنِي جَدِّي سَعِيدُ بْنُ مُحَمَّدٍ الرَّهَاوِيُّ ، أَنَّ عَمَّارَ بْنَ مَطَرٍ ، حَدَّثَهُمْ ، نَا إِبْرَاهِيمُ بْنُ مُحَمَّدٍ الأَسْلَمِيُّ ، عَنْ رَبِيعَةَ بْنِ أَبِي عَبْدِ الرَّحْمَنِ ، عَنِ ابْنِ الْبَيْلَمَانِيِّ ، عَنِ ابْنِ عُمَرَ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، " قَتَلَ مُسْلِمًا بِمُعَاهَدٍ ، وَقَالَ : أَنَا أَكْرَمُ مَنْ وَفَى بِذِمَّتِهِ " .
Sayyiduna Ibn Umar (may Allah be pleased with them both) narrates: The Noble Prophet (peace and blessings be upon him) had a Muslim killed in retaliation for a treaty-bound (dhimmi) person. He said: "I am the most entitled to fulfill the protection I have granted." This narration has only been transmitted as musnad by Ibrahim bin Abi Yahya, who is abandoned in hadith; the correct version is that this narration is transmitted as mursal from Ibn Bilmani, who is weak. Such a narration cannot be used as proof, even if he has transmitted it as a connected narration, let alone when he has transmitted it as mursal. And Allah knows best.
Hadith 3260
ثنا إِسْمَاعِيلُ الصَّفَّارُ ، نَا الرَّمَادِيُّ ، ح وَنا مُحَمَّدُ بْنُ إِسْمَاعِيلَ الْفَارِسِيُّ ، نَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ ، قَالا : نَا عَبْدُ الرَّزَّاقِ ، عَنِ الثَّوْرِيِّ ، عَنْ رَبِيعَةَ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْبَيْلَمَانِيِّ ، يَرْفَعْهُ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " أَقَادَ مُسْلِمًا قَتَلَ يَهُودِيًّا " ، وَقَالَ الرَّمَادِيُّ : " أَقَادَ مُسْلِمًا بِذِمِّيٍّ " ، وَقَالَ : " أَنَا أَحَقُّ مَنْ وَفَّى بِذِمَّتِهِ ".
Abdur Rahman bin Bilmani has narrated as a marfu’ hadith: The Prophet Muhammad (peace be upon him) had a Muslim killed in retribution; this Muslim had killed a Jew. Ramadi has narrated these words: The Prophet Muhammad (peace be upon him) had a Muslim killed in place of a dhimmi, and he said: “I am the most entitled to fulfill the protection I have granted.”
Hadith 3261
نَا مُحَمَّدُ بْنُ مَخْلَدٍ ، نَا مُوسَى بْنُ إِسْحَاقَ ، نَا أَبُو بَكْرٍ ، نَا عَبْدُ الرَّحِيمِ ، عَنْ حَجَّاجٍ ، عَنْ رَبِيعَةَ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْبَيْلَمَانِيِّ ، قَالَ : " قَتَلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ رَجُلا مِنْ أَهْلِ الْقِبْلَةِ بِرَجُلٍ مِنْ أَهْلِ الذِّمَّةِ ، وَقَالَ : أَنَا أَحَقُّ مَنْ أَوْفَى بِذِمَّتِهِ " ،.
Abdur Rahman bin Bilmani narrates: The Prophet Muhammad (peace be upon him) had a person belonging to the people of the Qiblah killed in exchange for a Dhimmi. He said: "I am the most entitled to fulfill my covenant."
Hadith 3262
نَا مُحَمَّدُ بْنُ الْقَاسِمِ ، نَا هِشَامُ بْنُ يُونُسَ ، نَا أَبُو مَالِكٍ الْجَنْبِيُّ ، عَنْ حَجَّاجٍ ، مِثْلَهُ.
This narration is also transmitted with another chain of transmission.
Hadith 3263
نَا أَبُو مُحَمَّدِ بْنُ صَاعِدٍ ، نَا الْفَضْلُ بْنُ سَهْلٍ ، نَا يَحْيَى بْنُ غَيْلانَ ، نَا يَزِيدُ بْنُ زُرَيْعٍ ، نَا سُلَيْمَانُ التَّيْمِيُّ ، عَنْ أَنَسِ بْنِ مَالِكٍ ، قَالَ : " إِنَّمَا سَمَلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَعْيُنَهُمْ لأَنَّهُمْ سَمَلُوا أَعْيُنَ الرِّعَاءِ " ، وَقَالَ ابْنُ صَاعِدٍ : يَعْنِي الْعُرَنِيِّينَ.
Sayyiduna Anas bin Malik (may Allah be pleased with him) narrates: The Noble Prophet (peace and blessings be upon him) had needles passed through their (the apostates') eyes, because those people had passed needles through the eyes of the (Prophet's) camel herder. Ibn Sa'ad says: By "those (apostate) people" is meant the people of the tribe of 'Uraina.
Hadith 3264
حَدَّثَنِي مُحَمَّدُ بْنُ عَلِيِّ بْنِ جَعْفَرٍ الْعَطَّارُ إِمْلاءً ، نَا أَحْمَدُ بْنُ الْحَسَنِ بْنِ سُفْيَانَ ، أنا أَحْمَدُ بْنُ عُبَيْدِ بْنِ نَاصِحٍ ، نَا الْوَاقِدِيُّ ، حَدَّثَنِي عَمْرُو بْنُ عُثْمَانَ ، عَنْ عَبْدِ الْمَلِكِ بْنِ عُبَيْدٍ ، عَنْ خُدَيْنِقَ بِنْتِ الْحُصَيْنِ ، عَنْ عِمْرَانَ بْنِ حُصَيْنٍ ، قَالَ : " قَتَلَ حِرَاشُ بْنُ أُمَيَّةَ بَعْدَمَا نَهَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنِ الْقَتْلِ ، فَقَالَ : لَوْ كُنْتُ قَاتِلا مُؤْمِنًا بِكَافِرٍ ، لَقَتَلْتُ حِرَاشًا بِالْهُذَلِيِّ " ، يَعْنِي لَمَّا قَتَلَ حِرَاشٌ رَجُلا مِنْ هُذَيْلٍ يَوْمَ فَتْحِ مَكَّةَ.
Sayyiduna Imran bin Husayn (may Allah be pleased with him) narrates: Khirash bin Umayyah killed a (non-Muslim), even though the Noble Prophet (peace and blessings be upon him) had already forbidden the killing of (non-Muslims). The Noble Prophet (peace and blessings be upon him) said: "If I were to kill a Muslim in retaliation for a disbeliever, I would have had Khirash killed in retaliation for that man from the tribe of Hudhayl." (The narrator states:) This happened when, at the time of the conquest of Makkah, Khirash bin Umayyah killed a man from the tribe of Hudhayl.
Hadith 3265
نَا مُحَمَّدُ بْنُ مَخْلَدِ بْنِ حَفْصٍ ، نَا إِسْحَاقُ بْنُ دَاوُدَ بْنِ عِيسَى الْمَرْوَزِيُّ ، نَا خَالِدُ بْنُ عَبْدِ السَّلامِ الصَّدَفِيُّ ، نَا الْفَضْلُ بْنُ الْمُخْتَارِ ، عَنْ عَبْدِ اللَّهِ بْنِ مَوْهَبٍ ، عَنْ عِصْمَةَ بْنِ مَالِكٍ ، قَالَ : " سَرَقَ مَمْلُوكٌ فِي عَهْدِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَرُفِعَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَعَفَا عَنْهُ ، ثُمَّ رُفِعَ إِلَيْهِ الثَّانِيَةَ وَقَدْ سَرَقَ ، فَعَفَا عَنْهُ ، فَرُفِعَ الثَّالِثَةَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَعَفَا عَنْهُ ، ثُمَّ رُفِعَ إِلَيْهِ الرَّابِعَةَ وَقَدْ سَرَقَ ، فَعَفَا عَنْهُ ، ثُمَّ رُفِعَ إِلَيْهِ الْخَامِسَةَ وَقَدْ سَرَقَ ، فَقَطَعَ يَدَهُ ، ثُمَّ رُفِعَ إِلَيْهِ السَّادِسَةَ ، فَقَطَعَ رِجْلَهُ ، ثُمَّ رُفِعَ إِلَيْهِ السَّابِعَةَ ، فَقَطَعَ يَدَهُ ، ثُمَّ رُفِعَ إِلَيْهِ الثَّامِنَةَ ، فَقَطَعَ رِجْلَهُ ، وَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : أَرْبَعٌ بِأَرْبَعٍ " .
Sayyiduna Asmah bin Malik (may Allah be pleased with him) narrates: In the blessed time of the Prophet (peace and blessings of Allah be upon him), a slave committed theft. His case was presented before the Prophet (peace and blessings of Allah be upon him), and the Prophet (peace and blessings of Allah be upon him) forgave him. Then his case was presented a second time before the Prophet (peace and blessings of Allah be upon him) that he had committed theft, and the Prophet (peace and blessings of Allah be upon him) again forgave him. Then his case was presented a third time, and you again forgave him. Then for the fourth time, his case was presented before you that he had committed theft, and the Prophet (peace and blessings of Allah be upon him) again forgave him. Then when for the fifth time his case of theft was presented, the Prophet (peace and blessings of Allah be upon him) had one of his hands cut off. Then when he was presented for the sixth time, you (peace and blessings of Allah be upon him) had one of his feet cut off. Then when for the seventh time his case was presented before you, you had his other hand cut off. When for the eighth time the case was presented, you had his other foot cut off. The narrator states: The Prophet (peace and blessings of Allah be upon him) said: "This (punishment) was given four times in exchange for the four times (he was) forgiven."
Hadith 3266
نَا نَا مُحَمَّدُ بْنُ إِسْمَاعِيلَ الْفَارِسِيُّ ، نَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ ، نَا عَبْدُ الرَّزَّاقِ ، عَنْ إِبْرَاهِيمَ ، عَنْ دَاوُدَ ، عَنْ عِكْرِمَةَ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : " نزلت هَذِهِ الآيَةُ فِي الْمُحَارِبِ إِنَّمَا جَزَاءُ الَّذِينَ يُحَارِبُونَ اللَّهَ وَرَسُولَهُ سورة المائدة آية 33 إِذَا عَدَا فَقَطَعَ الطَّرِيقَ فَقَتَلَ وَأَخَذَ الْمَالَ صُلِبَ ، فَإِنْ قَتَلَ وَلَمْ يَأْخُذْ مَالا قُتِلَ ، فَإِنْ أَخَذَ الْمَالَ وَلَمْ يَقْتُلْ ، قُطِعَ مِنْ خِلافٍ ، فَإِنْ هَرَبَ وَأَعْجَزَهُمْ ، فَذَلِكَ نَفْيُهُ " .
Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates: This verse was revealed about the highway robbers: "Indeed, the punishment of those who wage war against Allah and His Messenger is..." When they commit crimes, commit robbery, kill people, and seize wealth, then they are to be crucified. If they kill people but do not seize wealth, then they are to be killed. If they seize wealth but do not kill anyone, then their hands and feet are to be cut off from opposite sides. And if they run away and are not apprehended, then their punishment is exile.
Hadith 3267
نَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، نَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ عَبْدِ الْحَكَمِ ، نَا عَبْدُ اللَّهِ بْنُ وَهْبٍ ، أَخْبَرَنِي جَرِيرُ بْنُ حَازِمٍ ، عَنْ سُلَيْمَانَ بْنِ مِهْرَانَ ، عَنْ أَبِي ظَبْيَانَ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : مَرَّ عَلِيُّ بْنُ أَبِي طَالِبٍ بِمَجْنُونَةِ بَنِي فُلانٍ قَدْ زَنَتْ ، فَأَمَرَ عُمَرُ بِرَجْمِهَا ، فَرَدَّهَا عَلِيُّ ، وَقَالَ لِعُمَرَ : أَمَا تَذْكُرُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : رُفِعَ الْقَلَمُ عَنْ ثَلاثَةٍ ، عَنِ الْمَجْنُونِ الْمَغْلُوبِ عَلَى عَقْلِهِ ، وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ ، وَعَنِ الصَّبِيِّ حَتَّى يَحْتَلِمَ ، قَالَ : صَدَقْتَ ، فَخَلَّى عَنْهَا " .
Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates: Sayyiduna Ali (may Allah be pleased with him) passed by a mad woman from such-and-such tribe who had committed adultery, and Sayyiduna Umar (may Allah be pleased with him) had ordered her to be stoned. Sayyiduna Ali (may Allah be pleased with him) brought her back and said to Sayyiduna Umar (may Allah be pleased with him): "Do you not remember that the Noble Prophet (peace and blessings be upon him) said: 'The pen has been lifted from three types of people: the insane person whose mind is overcome, the sleeping person until he wakes up, and the child until he reaches puberty.'" So Sayyiduna Umar (may Allah be pleased with him) said: "You have spoken the truth." Then Sayyiduna Umar (may Allah be pleased with him) let the woman go.
Hadith 3268
نَا مُحَمَّدُ بْنُ الْقَاسِمِ بْنِ زَكَرِيَّا ، نَا عَبَّادُ بْنُ يَعْقُوبَ ، نَا مُحَمَّدُ بْنُ الْفَضْلِ ، عَنْ إِسْمَاعِيلَ بْنِ أُمَيَّةَ ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ ، قَالَ : " أُتِيَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِرَجُلَيْنِ أَحَدُهُمَا قَتَلَ ، وَالآخَرُ أَمْسَكَ ، فَقَتَلَ الَّذِي قَتَلَ ، وَحَبَسَ الْمُمْسِكَ " .
Saeed bin Musayyib narrates: Two men were brought before the Prophet Muhammad (peace be upon him), one of whom had committed murder and the other had held (the victim). The Prophet Muhammad (peace be upon him) ordered the murderer to be killed (as punishment), and the one who had held (the victim) to be imprisoned.
Hadith 3269
نَا مُحَمَّدُ بْنُ إِسْمَاعِيلَ الْفَارِسِيُّ ، نَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ ، نَا عَبْدُ الرَّزَّاقِ ، عَنْ مَعْمَرٍ ، وَابْنِ جُرَيْجٍ ، عَنْ إِسْمَاعِيلَ بْنِ أُمَيَّةَ رَفَعَ الْحَدِيثَ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " يُقْتَلُ الْقَاتِلُ ، وَيُصْبَرُ الصَّابِرُ " .
Ismail bin Umayyah narrates as a marfu’ hadith: The Prophet Muhammad (peace be upon him) said: “The killer will be killed, and the one who restrains the murdered person will be imprisoned.”
Hadith 3270
نَا الْحَسَنُ بْنُ أَحْمَدَ بْنِ صَالِحٍ الْكُوفِيُّ ، نَا إِبْرَاهِيمُ بْنُ مُحَمَّدِ بْنِ إِبْرَاهِيمَ الصَّيْرَفِيُّ ، نَا عَبْدَةُ بْنُ عَبْدِ اللَّهِ الصَّفَّارُ ، نَا أَبُو دَاوُدَ الْحَفَرِيُّ ، عَنْ سُفْيَانَ الثَّوْرِيِّ ، عَنْ إِسْمَاعِيلَ بْنِ أُمَيَّةَ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِذَا أَمْسَكَ الرَّجُلُ الرَّجُلَ وَقَتَلَهُ الآخَرُ ، يُقْتَلُ الَّذِي قَتَلَ ، وَيُحْبَسُ الَّذِي أَمْسَكَ " .
Sayyiduna Ibn Umar (may Allah be pleased with them both) narrates: The Noble Prophet (peace and blessings be upon him) said: "When a person holds someone and another kills him, the killer will be killed, and the one who held him will be imprisoned."
Hadith 3271
نَا أَبُو عُبَيْدٍ ، نَا سَلْمُ بْنُ جُنَادَةَ ، نَا وَكِيعٌ ، عَنْ سُفْيَانَ ، عَنْ إِسْمَاعِيلَ بْنِ أُمَيَّةَ ، قَالَ : " قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي رَجُلٍ أَمْسَكَ رَجُلا وَقَتَلَهُ الآخَرُ ، فَقَالَ : يُقْتَلُ الْقَاتِلُ ، وَيُحْبَسُ الْمُمْسِكُ " .
Ismail bin Umayyah narrates: The Prophet Muhammad (peace be upon him) gave a verdict in a case where one person held another, and a third person killed him. The Prophet (peace be upon him) said: "The killer will be killed, and the one who held him will be imprisoned."
Hadith 3272
، وَعَنْ سُفْيَانَ ، عَنْ جَابِرٍ ، عَنْ عَامِرٍ ، عَنْ عَلِيٍّ أَنَّهُ قَضَى بِذَلِكَ.
Aamir (may Allah have mercy on him) narrates that Sayyiduna Ali (may Allah be pleased with him) also gave the same verdict.
Hadith 3273
نَا أَحْمَدُ بْنُ الْحُسَيْنِ بْنِ مُحَمَّدِ بْنِ أَحْمَدَ بْنِ الْجُنَيْدِ ، نَا الْحَسَنُ بْنُ عَرَفَةَ ، نَا عَبَّادُ بْنُ الْعَوَّامِ ، عَنِ الْحَجَّاجِ بْنِ أَرْطَأَةَ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ ، أَنَّ قَتَادَةَ بْنَ عَبْدِ اللَّهِ ، قَالَ لَهُ عُمَرُ بْنُ الْخَطَّابِ : لَوْلا أَنِّي سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : " لا يُقَادُ وَالِدٌ بِوَلَدِهِ " ، لَقَتَلْتُكَ أَوْ لَضَرَبْتُ عُنُقَكَ " .
Amr bin Shu'aib narrates from his father, from his grandfather: Sayyiduna Umar bin Khattab (may Allah be pleased with him) said to Qatadah bin Abdullah: "If I had not heard the Prophet Muhammad (peace and blessings be upon him) say: 'Retaliation (qisas) for a child will not be taken from the parent,' I would have killed you (the narrator is in doubt, perhaps these are the words: 'I would have struck your neck')."
Hadith 3274
نَا أَبُو عُبَيْدٍ ، وَابْنُ مَخْلَدٍ ، وَآَخَرُونَ ، قَالُوا : نَا مُحَمَّدُ بْنُ وَارَةَ يَعْنِي مُحَمَّدَ بْنَ مُسْلِمٍ ، نَا مُحَمَّدُ بْنُ سَعِيدٍ ، نَا عَمْرُو بْنُ أَبِي قَيْسٍ ، عَنْ مَنْصُورٍ ، عَنْ مُحَمَّدِ بْنِ عَجْلانَ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو ، عَنْ عُمَرَ بْنِ الْخَطَّابِ ، قَالَ : إِنِّي سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : " لا يُقَادُ الأَبُ مِنَ ابْنِهِ " .
Sayyiduna Umar bin Khattab (may Allah be pleased with him) says: "I heard the Noble Prophet (peace and blessings of Allah be upon him) say: 'A father will not be subjected to retribution (qisas) for (killing) his son.'"
Hadith 3275
نَا يُوسُفُ بْنُ يَعْقُوبَ بْنِ إِسْحَاقَ بْنِ بُهْلُولٍ ، نَا الْحَسَنُ بْنُ عَرَفَةَ ، نَا أَبُو حَفْصٍ الأَبَّارُ ، عَنْ إِسْمَاعِيلَ بْنِ مُسْلِمٍ ، عَنْ عَمْرِو بْنِ دِينَارٍ ، عَنْ طَاوُسٍ ، عَنِ ابْنِ عَبَّاسٍ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لا تُقَامُ الْحُدُودُ فِي الْمَسَاجِدِ ، وَلا يُقْتَلُ الْوَالِدُ بِالْوَلَدِ " .
Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates: The Noble Prophet (peace and blessings be upon him) said: "The prescribed punishment (hadd) will not be carried out in the mosque, and a father will not be killed in retaliation for his son."
Hadith 3276
نَا مُحَمَّدُ بْنُ مَخْلَدٍ ، نَا مُوسَى بْنُ إِسْحَاقَ ، نَا أَبُو بَكْرٍ ، نَا عَبَّادُ بْنُ الْعَوَّامِ ، وَأَبُو خَالِدٍ الأَحْمَرُ ، عَنْ حَجَّاجٍ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ ، عَنْ عُمَرَ ، قَالَ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : " لا يُقْتَلُ الْوَالِدُ بِالْوَلَدِ " .
Sayyiduna Umar (may Allah be pleased with him) narrates: I heard the Noble Prophet (peace and blessings be upon him) say: "A father will not be killed in retaliation for his son."
Hadith 3277
نَا عَبْدُ الْعَزِيزِ بْنُ جَعْفَرِ بْنِ بَكْرٍ ، نَا الْحَسَنُ بْنُ عَرَفَةَ ، نَا عَلِيُّ بْنُ ثَابِتٍ الْجَزَرِيُّ ، نَا يَحْيَى بْنُ أَبِي أُنَيْسَةَ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لا يُقَادُ الْوَالِدُ بِوَلَدِهِ ، وَإِنْ قَتَلَهُ عَمْدًا " .
Amr ibn Shu'ayb narrates from his father, from his grandfather: The Prophet Muhammad (peace be upon him) said: "A father will not be killed in retaliation for his son, even if (the father) killed (the son) intentionally."
Hadith 3278
نَا عَلِيُّ بْنُ مُحَمَّدٍ الْمِصْرِيُّ ، نَا يُوسُفُ بْنُ يَزِيدَ ، نَا حَجَّاجُ بْنُ إِبْرَاهِيمَ ، نَا إِسْمَاعِيلُ بْنُ عَيَّاشٍ ، عَنِ ابْنِ جُرَيْجٍ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ . ح وَنا أَبُو عَمْرٍو عُثْمَانُ بْنُ أَحْمَدَ الدَّقَّاقُ ، نَا أَحْمَدُ بْنُ عَلِيٍّ الْخَزَّازُ ، نَا الْهَيْثَمُ بْنُ خَارِجَةَ ، نَا إِسْمَاعِيلُ بْنُ عَيَّاشٍ ، عَنِ الْمُثَنَّى ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ ، عَنْ سُرَاقَةَ بْنِ مَالِكٍ ، كَذَا قَالَ : عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " نُقِيدُ الأَبَ عَنِ ابْنِهِ ، وَلا نُقِيدُ الابْنَ عَنْ أَبِيهِ " .
Sayyiduna Suraqah bin Malik (may Allah be pleased with him) narrates this statement of the Noble Prophet (peace and blessings be upon him): "We will exact retribution for the father from the son, but we will not exact retribution for the son from his father."
Hadith 3279
نَا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، وَابْنُ مَخْلَدٍ ، قَالا : نَا مُحَمَّدُ بْنُ هَارُونَ ، نَا أَبُو الْمُغِيرَةِ ، نَا سَعِيدُ بْنُ بَشِيرٍ ، عَنْ قَتَادَةَ ، عَنْ عَمْرِو بْنِ دِينَارٍ . ح وَنا عَبْدُ الْبَاقِي بْنُ قَانِعٍ ، نَا الْحَسَنُ بْنُ عَلِيٍّ الْمَعْمَرِيُّ ، نَا عُقْبَةُ بْنُ مُكْرَمٍ الْعَمِّيُّ ، نَا تُمَارٌ عُمَرُ بْنُ عَامِرٍ أَبُو حَفْصٍ السَّعْدِيُّ ، وَكَانَ يَنْزِلُ فِي بَنِي رِفَاعَةَ ، عَنْ عُبَيْدِ اللَّهِ بْنِ الْحَسَنِ الْعَنْبَرِيِّ ، عَنْ عَمْرِو بْنِ دِينَارٍ ، عَنْ طَاوُسٍ ، عَنِ ابْنِ عَبَّاسٍ ، عَن النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لا تُقَامُ الْحُدُودُ فِي الْمَسَاجِدِ ، وَلا يُقَادُ الْوَالِدُ بِوَلَدِهِ " .
Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates this statement of the Noble Prophet (peace and blessings be upon him): "The prescribed punishment (hadd) will not be carried out in the mosque, and a father will not be killed in retaliation for his son."
Hadith 3280
نَا نَا مُحَمَّدُ بْنُ مَخْلَدٍ ، حَدَّثَنَا الرَّمَادِيُّ ، نَا جَعْفَرُ بْنُ عَوْنٍ ، نَا إِسْمَاعِيلُ بْنُ مُسْلِمٍ ، عَنْ عَمْرِو بْنِ دِينَارٍ ، بِإِسْنَادِهِ مِثْلَهُ ، " لا يُقَادُ الْوَالِدُ بِالْوَلَدِ " .
The same narration is also transmitted with another chain, however, in it these additional words are present: "A father will not be subject to retribution (qisas) for (killing) his son."
Hadith 3281
نَا ابْنُ مَخْلَدٍ ، نَا إِبْرَاهِيمُ بْنُ هَاشِمٍ ، نَا عَبْدُ اللَّهِ بْنُ سَيَّارٍ ، نَا إِبْرَاهِيمُ بْنُ رُسْتُمَ ، عَنْ حَمَّادِ بْنِ سَلَمَةَ ، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ ، عَنْ عُمَرَ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لا يُقَادُ الأَبُ بِالابْنِ " .
Sayyiduna Umar (may Allah be pleased with him) narrates: The Noble Prophet (peace and blessings be upon him) said: "Retaliation (qisas) will not be taken from a son for (killing) his father."
Hadith 3282
نَا الْحُسَيْنُ بْنُ الْحُسَيْنِ بْنِ الصَّابُونِيِّ الأَنْطَاكِيُّ قَاضِي الثُّغُورِ ، نَا مُحَمَّدُ بْنُ عَبْدِ الْحَكَمِ الرَّمْلِيُّ ، حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ الْعَزِيزِ الرَّمْلِيُّ ، نَا إِسْمَاعِيلُ بْنُ عَيَّاشٍ ، عَنِ الأَوْزَاعِيِّ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ أَنَّ رَجُلا قَتَلَ عَبْدَهُ مُتَعَمِّدًا ، " فَجَلَدَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِائَةَ جَلْدَةٍ ، وَنَفَاهُ سَنَةً ، وَمَحَى سَهْمَهُ مِنَ الْمُسْلِمِينَ ، وَلَمْ يُقِدْهُ بِهِ ، وَأَمَرَهُ أَنْ يُعْتِقَ رَقَبَةً " .
Amr bin Shu'aib narrates from his father, from his grandfather: A man killed his slave intentionally. The Prophet Muhammad (peace be upon him) ordered that he be given one hundred lashes and exiled for one year. He stopped his official payment (salary). The Prophet did not exact retribution (qisas) from him for the slave, but instructed him to free a slave.
Hadith 3283
نَا مُحَمَّدُ بْنُ الْقَاسِمِ بْنِ زَكَرِيَّا ، نَا عَبَّادُ بْنُ يَعْقُوبَ ، نَا إِسْمَاعِيلُ بْنُ عَيَّاشٍ الْحِمْصِيُّ ، عَنْ إِسْحَاقَ بْنِ عَبْدِ اللَّهِ بْنِ أَبِي فَرْوَةَ ، عَنْ إِبْرَاهِيمَ بْنِ عَبْدِ اللَّهِ بْنِ حُنَيْنٍ ، عَنْ أَبِيهِ ، عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : " أُتِيَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِرَجُلٍ قَتَلَ عَبْدَهُ مُتَعَمِّدًا ، فَجَلَدَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِائَةَ جَلْدَةٍ ، وَنَفَاهُ سَنَةً ، وَمَحَى سَهْمَهُ مِنَ الْمُسْلِمِينَ ، وَلَمْ يُقِدْهُ بِهِ " ،.
Sayyiduna Ali (may Allah be pleased with him) narrates: A man was brought to the Prophet (peace and blessings of Allah be upon him); he had intentionally killed his slave. The Prophet (peace and blessings of Allah be upon him) ordered that he be given one hundred lashes and exiled for one year. He (the Prophet) withheld his official payment (salary), and did not exact retribution (qisas) from him.
Hadith 3284
نَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ الْبَزَّازُ ، نَا الْحَسَنُ بْنُ عَرَفَةَ ، نَا إِسْمَاعِيلُ بْنُ عَيَّاشٍ ، عَنْ إِسْحَاقَ بْنِ عَبْدِ اللَّهِ بْنِ أَبِي فَرْوَةَ ، عَنْ إِبْرَاهِيمَ بْنِ عَبْدِ اللَّهِ بْنِ حُنَيْنٍ ، عَنْ عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِثْلَهُ .
This narration is also transmitted with another chain of transmission.
Hadith 3285
وَعَنْ إِسْحَاقَ بْنِ عَبْدِ اللَّهِ بْنِ أَبِي فَرْوَةَ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مثل ذَلِكَ.
This narration is also transmitted with another chain of transmission.
