أَوَّلُ سَارِقٍ قَطَعَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ 8216 - حَدَّثَنَا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ، ثَنَا إِبْرَاهِيمُ بْنُ مَرْزُوقٍ ، ثَنَا وَهْبُ بْنُ جَرِيرٍ ، عَنْ شُعْبَةَ ، وَأَخْبَرَنَا أَحْمَدُ بْنُ جَعْفَرٍ الْقَطِيعِيُّ ، ثَنَا عَبْدُ اللَّهِ بْنُ أَحْمَدَ بْنِ حَنْبَلٍ ، حَدَّثَنِي أَبِي ، ثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ ، عَنْ شُعْبَةَ ، قَالَ : سَمِعْتُ يَحْيَى الْجَابِرَ ، يَقُولُ : سَمِعْتُ أَبَا مَاجِدَةَ ، يَقُولُ : كُنْتُ قَاعِدًا مَعَ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ - رَضِيَ اللَّهُ عَنْهُ - ، فَقَالَ : إِنِّي لَأَذْكُرُ أَوَّلَ رَجُلٍ قَطَعَهُ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ - أُتِيَ بِسَارِقٍ فَأَمَرَ بِقَطْعِهِ فَكَأَنَّمَا أَسِفَ وَجْهُ رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ - فَقَالُوا : يَا رَسُولَ اللَّهِ كَأَنَّكَ كَرِهْتَ قَطْعَهُ ، قَالَ : " وَمَا يَمْنَعُنِي ، لَا تَكُونُوا أَعْوَانًا لِلشَّيْطَانِ عَلَى أَخِيكُمْ إِنَّهُ لَا يَنْبَغِي لِلْإِمَامِ إِذَا انْتَهَى إِلَيْهِ حَدٌّ إِلَّا أَنْ يُقِيمَهُ ، إِنَّ اللَّهَ عَفُوٌّ يُحِبُّ الْعَفْوَ وَلْيَعْفُوا وَلْيَصْفَحُوا أَلَا تُحِبُّونَ أَنْ يَغْفِرَ اللَّهُ لَكُمْ وَاللَّهُ غَفُورٌ رَحِيمٌ " هَذَا حَدِيثٌ صَحِيحُ الْإِسْنَادِ وَلَمْ يُخْرِجَاهُ .

Mustadrak al-Hakim — Hadith 8354

حدَّثنا أبو العباس محمد بن يعقوب، حدَّثنا إبراهيم بن مرزوق، حدَّثنا وهب بن جَرير وسعيد بن عامر (1)، عن شُعْبة. وأخبرنا أحمد بن جعفر القَطِيعي، حدَّثنا عبد الله بن أحمد بن حنبل، حدثني أبي، حدَّثنا محمد بن جعفر، عن شُعبة، قال: سمعتُ يحيى الجابر يقول: سمعتُ أبا ماجدةَ يقول: كنتُ قاعدًا مع عبد الله بن مسعود فقال: إني لأذكرُ أولَ رجلٍ قَطَعَه رسولُ الله ﷺ، أُتِيَ بسارق فأمرَ بقطعِه، فكأنما أَسِفَ وجهُ رسول الله ﷺ، فقالوا: يا رسول الله، كأنَّك كرهتَ قطعَه، قال: "وما يَمنَعُني؟! لا تكونوا أعوانًا للشيطان على أخيكم، إنه لا يَنبَغي للإمام إذا انتَهَى إليه حدٌّ إلَّا أن يُقِيمَه، إِنَّ الله عَفُوٌّ يُحبُّ العفو، ﴿وَلْيَعْفُوا وَلْيَصْفَحُوا أَلَا تُحِبُّونَ أَنْ يَغْفِرَ اللَّهُ لَكُمْ وَاللَّهُ غَفُورٌ رَحِيمٌ﴾ [النور: 22] " (2).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him); he said: I remember the first man whom the Messenger of Allah (peace and blessings be upon him) had cut (as a prescribed punishment). A thief was brought, and he (peace and blessings be upon him) ordered that he be cut. At that time it was as though signs of displeasure and sorrow were on the face of the Messenger of Allah (peace and blessings be upon him). The people said: O Messenger of Allah, it seems that cutting off his hand was displeasing to you. He (peace and blessings be upon him) said: "Why should it not be?! Do not be helpers of Satan against your brother. It is not fitting for the ruler (imam), when a case of a prescribed punishment reaches him, not to carry it out. Surely Allah is Pardoning and loves pardon. 'Let them pardon and overlook. Do you not love that Allah should forgive you? And Allah is Most Forgiving, Most Merciful.' [Surah al-Nur: 22]"
This hadith is sahih al-isnad (its chain is authentic), but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) قوله: "وسعيد بن عامر" سقط من (ز) و (ب).
Note / Clarification: (1) The words "wa Sa'id bin Amir" are missing from manuscripts (Z) and (B).

(2) حسن لغيره، وهذا إسناد ضعيف لضعف يحيى الجابر - وهو يحيى بن عبد الله بن الحارث - ولجهالة أبي ماجدة، ويقال: أبو ماجد، وهو الحنفي الكوفي.
Grading: (2) This hadith is "hasan li-ghayrihi", while this isnad is da'if (weak). Technical note / Defect ('illah): In it, Yahya al-Jabir (Yahya bin Abd Allah bin al-Harith) is weak and Abu Majidah is unknown. It is said his name is Abu Majid, and he is al-Hanafi al-Kufi.
وهو في "مسند أحمد 7/ (4168) عن محمد بن جعفر، بهذا الإسناد.
Reference / Source: This narration is in "Musnad Ahmad" (7/ 4168) from Muhammad bin Ja'far, with this same isnad.
وأخرجه أحمد 6/ (3711) من طريق المسعودي، و 7/ (3977) و (4169) من طريق سفيان الثوري، كلاهما عن يحيى الجابر، به. ورواية المسعودي مختصرة، وجعل السارق امرأةً!
Reference / Source: It was recorded by Imam Ahmad (6/ 3711) via al-Mas'udi, and (7/ 3977, 4169) via Sufyan al-Thawri, both of them from Yahya al-Jabir. Details of the narration: Al-Mas'udi's narration is abridged, and he made the thief a "woman"!
ويشهد لقوله: "لا تكونوا أعوانًا للشيطان على أخيكم" حديث أبي هريرة عند البخاري (6781).
Corroborating chains and supporting reports: His (peace and blessings be upon him) saying "Do not be helpers of Satan against your brother" is supported (as a shahid) by the hadith of Abu Hurayrah (may Allah be pleased with him) in al-Bukhari (6781).
ولقوله: "إنه لا ينبغي للإمام إذا انتهى إليه حدٌّ إلَّا أن يقيمه" شواهد من حديث هزال وابن عباس وصفوان بن أمية سلفت بالأرقام (8279) و (8347) و (8348)، وحديث عبد الله بن عمرو التالي، وحديث عبد الله بن عمر الآتي برقم (8357).
Corroborating chains and supporting reports: For his (peace and blessings be upon him) saying "When a hadd (case) reaches the ruler, he must carry it out", there are supporting reports in the narrations of Hazzal, Ibn Abbas and Safwan bin Umayyah (may Allah be pleased with them), which passed earlier as numbers (8279), (8347) and (8348); also the following hadith of Abd Allah bin Amr and the hadith of Abd Allah bin Umar that will come as number (8357) support it.
ولقوله: "إنَّ الله عفو يحب العفو" شاهد من حديث عائشة، سلف برقم (1963).
Corroborating chains and supporting reports: The saying "Indeed Allah is Pardoning and loves pardon" has a supporting report in the hadith of A'ishah (may Allah be pleased with her), which passed earlier as number (1963).
