Mustadrak al-Hakim — Hadith 8298

أخبرَناه عبد الباقي بن قانِع الحافظ ببغداد، حدثنا محمد بن يحيى بن المنذر ومحمد بن غالب بن حَرْب قالا: حدثنا عثمان بن الهيثم مؤذِّن مسجد البصري، حدثنا هشام بن حسان، عن محمد بن سِيرِين، عن أبي هريرة قال: قال رسول الله ﷺ: "مَن قَتَلَ عبدَه قَتَلْناه، ومَن جَدَعَ عبدَه جَدَعْناه" (1). قال الحاكم: أنا أَخشى أنَّ عثمان بن الهيثم أراد الإسناد الأول كما رواه يزيدُ بن هارون، والله أعلم.
It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever kills his slave, we will kill him; and whoever cuts off a limb of his slave, we will cut off his limb."
Imam al-Hakim says: I fear that Uthman bin al-Haytham intended by this chain the same narration that Yazid bin Harun narrated. And Allah knows best.

Grading: It is "da'if" (weak).
Technical note / Defect ('illah): Because Uthman bin al-Haytham, in his chain, contradicted narrators more trustworthy than him in narrating from Hisham bin Hassan (as in the previous hadith). Uthman is "saduq" (truthful) and "hasan al-hadith", but in the last part of his life his memory changed and he began to accept "talqin" (prompting, i.e., accepting whatever people suggested to him). In narrating from Hisham bin Hassan he followed the "well-trodden path" (tariq al-jaddah, the common, familiar chain).

Note / Clarification: We have not found this narration through this route with anyone other than the author (al-Hakim).
