Mustadrak al-Hakim — Hadith 8295

حدثنا علي بن حَمْشاذ العَدْل، حدثنا هشام بن علي السَّدُوسي، حدثنا يحيى بن عبد الله، حدثنا يزيد بن زُرَيع، عن سليمان التَّيمي، عن أنس بن مالك: أنَّ النبي ﷺ إنما سَمَلَ أعينَ العُرَنيِّين لأنهم سَمَلُوا أعينَ الرُّعاة (1).
It is narrated from Sayyiduna Anas bin Malik (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) put out the eyes of the people of Uraynah only because they had put out the eyes of the Muslim herdsmen.

(1) إسناده صحيح. هشام السدوسي: هو هشام بن علي السِّيرافي، ويحيى بن عبد الله: هو يحيى بن غيلان بن عبد الله، نسبه المصنف إلى جده، وفي صنيعه إغراب. وقال الذهبي في "التلخيص": ذا في مسلم. يعني استدراكه على الصحيح وهمٌ.
Grading: Its chain is "sahih". Hisham al-Sadusi is Hisham bin Ali al-Sirafi, and Yahya bin Abdullah is Yahya bin Ghaylan bin Abdullah; the author (al-Hakim) attributed him to his grandfather, which is unusual (ighrab).
Note / Clarification: Al-Dhahabi said in "al-Talkhis": "This is in Muslim." That is, his (al-Hakim's) adding it as something missed by the Sahih (istidrak) is a "mistake".
وأخرجه مسلم (1671) (14)، والترمذي (73) والنسائي (3492)، والحاكم في الرواية التالية (8296) من طريق الفضل بن سهل، وابن حبان (4474) من طريق محمد بن عبد الله بن أبي الثلج، كلاهما عن يحيى بن غيلان، بهذا الإسناد. وقال الترمذي: هذا حديث غريب، لا نعلم أحدًا ذكره غير هذا الشيخ عن يزيد بن زريع، وكذا قال الطبراني في "الأوسط" بعد أن أخرجه (1710). وقال الترمذي في "العلل الكبير" بعد أن أخرجه فيه (39): سألت محمدًا - يعني البخاري - عن هذا الحديث، فلم يعرفه، ولا أعلم أنَّ أحدًا ذكر هذا الحرف إلَّا هو؛ يعني يحيى بن غيلان. واستنكره الطحاوي في "شرح مشكل الآثار" 5/ 72، فقال: وهذا الحديث عندنا منكر.
Reference / Source: Muslim (1671/14), al-Tirmidhi (73), al-Nasa'i (3492) and al-Hakim in the next narration (8296) narrated it through the route of al-Fadl bin Sahl, and Ibn Hibban (4474) through the route of Muhammad bin Abdullah bin Abi al-Thalj; both of them narrate it from Yahya bin Ghaylan with this same chain.
Technical note / Defect ('illah): Imam al-Tirmidhi said: "This hadith is gharib; we do not know anyone who mentioned it from Yazid bin Zuray' other than this shaykh." Al-Tabarani said the same in "al-Awsat" (1710). Al-Tirmidhi said in "al-'Ilal al-Kabir" (39): "I asked Muhammad (i.e., Imam al-Bukhari) about this hadith and he did not know it, and I know of no one other than Yahya bin Ghaylan who mentioned these words." Al-Tahawi rejected it in "Sharh Mushkil al-Athar" (5/72) and said: "In our view this hadith is munkar."
كذا قالا، مع أنَّ الحديث رواه جمع أنس مطولًا، وذكروا فيه قصة سمل عيونهم، أخرجه كذلك أحمد 20/ (13045)، والبخاري (6802)، ومسلم (1671) (10) و (11)، وأبو داود (4364)، والنسائي (3473 - 3476) و (11078)، وابن حبان (4469) من طريق أبي قلابة، ومسلم (1671) (9)، وأبو داود (4367)، وابن ماجه (2578)، والنسائي (3477 - 3480)، وابن حبان (4471) من طريق حميد الطويل، وأبو داود (4367) و (4368)، والنسائي (3480 - 3483)، وابن حبان (1388) من طريق قتادة، وأبو داود (4367)، والنسائي (3483) من طريق ثابت البناني، وابن ماجه (2579)، والنسائي (3486) و (3487) من طريق عروة بن الزبير، والنسائي (3484) من طريق يحيى بن سعيد الأنصاري، ستتهم عن أنس، به.
Details of the narration: The two of them said this, even though a group narrated this hadith from Anas (may Allah be pleased with him) at length and mentioned in it the story of their eyes being put out with heated needles (saml al-a'yun). It was narrated by Ahmad (20/13045), al-Bukhari (6802), Muslim (1671/10, 11), Abu Dawud (4364), al-Nasa'i (3473-3476, 11078) and Ibn Hibban (4469) through the route of Abu Qilabah; by Muslim (1671/9), Abu Dawud (4367), Ibn Majah (2578), al-Nasa'i (3477-3480) and Ibn Hibban (4471) through the route of Humayd al-Tawil; by Abu Dawud (4367, 4368), al-Nasa'i (3480-3483) and Ibn Hibban (1388) through the route of Qatadah; by Abu Dawud (4367) and al-Nasa'i (3483) through the route of Thabit al-Bunani; by Ibn Majah (2579) and al-Nasa'i (3486, 3487) through the route of Urwah bin al-Zubayr; and by al-Nasa'i (3484) through the route of Yahya bin Sa'id al-Ansari. These six narrators narrate it from Anas (may Allah be pleased with him) in this way.
وأخرج البيهقي 9/ 70 من طريق حصين بن مخارق، عن داود بن أبي هند، عن أنس: أنَّ النبي ﷺ إنما مثّل بهم لأنهم مثّلوا بالراعي. وإسناده تالف؛ حصين متهم بالكذب.
Reference / Source: Al-Bayhaqi (9/70) narrated it through the route of Husayn bin Mukhariq, from Dawud bin Abi Hind, from Anas (may Allah be pleased with him): "The Prophet (peace and blessings be upon him) mutilated them only because they had mutilated the herdsman."
Grading: Its chain is "talif" (ruined, extremely weak); Husayn is accused of lying (muttaham bi'l-kadhib).
وروي أيضًا بإسناد محتمل للتحسين عن ابن عمر عند أبي داود (4369).
Grading: This narration is also reported from Ibn Umar (may Allah be pleased with him) in Abu Dawud (4369), with a chain that could possibly be graded "hasan".
فائدة: روى البخاري في "صحيحه" بإثر (5686)، وأبو داود (4371) من طريق قتادة قال: حدثني محمد بن سِيرِين: أنَّ ذلك كان قبل أن تنزل الحدود. قال الحافظ ابن حجر في "فتح الباري" 1/ 698: قال ابن شاهين عقب حديث عمران بن حصين في النهي عن المُثلة [الذي أخرجه أحمد (19844)، وفيه: أن حصينًا نذر أن يقطع يد غلامه الآبق]: هذا الحديث ينسخ كل مُثلة.
Important point: (Benefit): Imam al-Bukhari in his "Sahih" after (5686) and Abu Dawud (4371) narrated through the route of Qatadah, who said: Muhammad bin Sirin told me: "This incident was before (the rulings of) the prescribed punishments (hudud) were revealed."
General principle: Al-Hafiz Ibn Hajar says in "Fath al-Bari" (1/698): Ibn Shahin said after the hadith of Imran bin Husayn prohibiting mutilation [which Ahmad (19844) narrated, and in which Husayn vowed to cut off the hand of his runaway slave]: "This hadith abrogates every kind of mutilation."
وتعقبه ابن الجوزي بأن ادعاء النسخ يحتاج إلى تاريخ قلت (أي ابن حجر): يدل عليه ما رواه البخاري في الجهاد (2954) من حديث أبي هريرة في النهي عن التعذيب بالنار بعد الإذن فيه، وقصة العرنيِّين قبل إسلام أبي هريرة، وقد حضر الإذنَ ثم النهي.
Technical note / Defect ('illah): Ibn al-Jawzi objected to this, saying that "a claim of abrogation requires (knowledge of) the chronology." I (Ibn Hajar) say: This is indicated by the hadith which al-Bukhari narrated in the Book of Jihad (2954) from Abu Hurayrah (may Allah be pleased with him), in which punishment by fire was prohibited after it had been permitted. The story of the Uranis was before Abu Hurayrah (may Allah be pleased with him) accepted Islam, and he witnessed both the permission (for punishment by fire) and then the prohibition.
