Note / Clarification: The wording between the square brackets had dropped out of the handwritten manuscripts; we took it from the narration of al-Nasa'i and added it.
(2) حديث صحيح من دون ذكر الحِرابة، وهذا إسناد رجاله ثقات، وقد تفرَّد بذكر الحرابة فيه إبراهيم بن طهمان عن عبد العزيز بن رفيع، وإبراهيم وإن كان ثقة إلَّا أنَّ له أفرادًا فيما ذكر ابن حبان في "الثقات" 6/ 27. وقد اختلف فيه أيضًا على إبراهيم بن طهمان في إسناده كما ذكرنا عند الرواية السالفة برقم (8239). أبو عامر العقدي هو عبد الملك بن عمرو القيسي.
Grading: This hadith is "sahih" without the mention of "hirabah" (brigandage/armed rebellion). All the narrators of this chain are trustworthy (thiqah).
Technical note / Defect ('illah): Ibrahim bin Tahman is "alone" (munfarid), in narrating from Abd al-Aziz bin Rufay', in mentioning "hirabah" in it. Although Ibrahim is trustworthy, he has some solitary narrations (afrad), as Ibn Hibban mentioned in "al-Thiqat" (6/27). There is also disagreement from Ibrahim bin Tahman in its chain, as we mentioned under the earlier narration (no. 8239). "Abu Amir al-Aqadi" is "Abd al-Malik bin Amr al-Qaysi".
وأخرجه النسائي (3497) عن عباس الدُّوري، عن أبي عامر العقدي، بهذا الإسناد.
Reference / Source: Al-Nasa'i (3497) narrated it from Abbas al-Duri, from Abu Amir al-Aqadi, with this same chain.
وأخرجه أبو داود (4353)، والطحاوي في "شرح المشكل" (1800)، والدارقطني في "سننه" (3087) من طريق محمد بن سنان، والنسائي (6919) من طريق حفص بن عبد الله، وأبو نعيم في "الحلية" 9/ 15 من طريق عبد الرحمن بن مهدي، والبيهقي 8/ 283 من طريق محمد بن سابق، أربعتهم عن إبراهيم بن طهمان، به.
Reference / Source: Abu Dawud (4353), al-Tahawi in "Sharh al-Mushkil" (1800) and al-Daraqutni in his "Sunan" (3087) narrated it through the route of Muhammad bin Sinan; al-Nasa'i (6919) through the route of Hafs bin Abdullah; Abu Nu'aym in "al-Hilyah" (9/15) through the route of Abd al-Rahman bin Mahdi; and al-Bayhaqi (8/283) through the route of Muhammad bin Sabiq. All four narrate this report from Ibrahim bin Tahman.
وقد تفرَّد إبراهيم بن طهمان بهذا اللفظ، والمحفوظ في حديث عائشة اللفظ الذي رواه عنها عمرو بن غالب السالف برقم (8237)، وما رواه مسروق عنها في الروايتين التاليتين له، وما رواه الأسود عنها عند أحمد بإثر (25475)، ومسلم بإثر (1676) (26)، والنسائي بإثر (3465)، وابن حبان بإثر (4407) من طريق إبراهيم النخعي عن الأسود.
Technical note / Defect ('illah): Ibrahim bin Tahman is "alone" in narrating it with this wording. The "preserved" (mahfuz) wording in the hadith of A'ishah (may Allah be pleased with her) is what Amr bin Ghalib narrated from her (which passed at no. 8237), what Masruq narrated from her in the two narrations following it, and what al-Aswad narrated from her, transmitted by Ahmad (after 25475), Muslim (after 1676/26), al-Nasa'i (after 3465) and Ibn Hibban (after 4407) through the route of Ibrahim al-Nakha'i from al-Aswad.
وهو الموافق أيضًا لحديث عثمان السالف برقم (8226)، وحديث ابن مسعود الذي ذكرناه هناك في الباب.
Corroborating chains and supporting reports: This (preserved wording) also agrees with the hadith of Uthman (may Allah be pleased with him) which passed at no. (8226), and with the hadith of Ibn Mas'ud (may Allah be pleased with him) which we mentioned there on this topic.
لذلك قال الجصّاص في "أحكام القرآن" 2/ 512: فإن قيل: روى إبراهيم بن طهمان عن عبد العزيز بن رفيع عن عبيد بن عمير عن عائشة عن النبي ﷺ: "لا يحل دم امرئ مسلم إلَّا بإحدى ثلاث: زنى بعد إحصان، ورجل قتل رجلًا فقتل به، ورجل خرج محاربًا لله ولرسوله، فيُقتل أو يُصلب أو يُنفى من الأرض"، قيل له: قد رُوي هذا الحديث من وجوه صحاح ولم يُذكر فيه قتل المحارب، رواه عثمان وعبد الله بن مسعود عن النبي ﷺ، ولم يذكر فيه قتل المحارب، والصحيح منها ما لم يذكر ذلك فيه، لأنَّ المرتد لا محالة مستحق للقتل بالاتفاق.
General principle: For this reason al-Jassas said in "Ahkam al-Qur'an" (2/512): "If it is said that Ibrahim bin Tahman narrated from Abd al-Aziz bin Rufay', from Ubayd bin Umayr, from A'ishah (may Allah be pleased with her), from the Prophet (peace and blessings be upon him): 'The blood of a Muslim man is not lawful except in one of three cases: adultery after being married; a man who kills a man and is killed in retaliation for him; and a man who goes out waging war against Allah and His Messenger, who is to be killed, crucified or banished from the land', the reply will be: This hadith has been narrated through sound routes (wujuh sihah) which do not mention the killing of the 'muharib' (one who wages war). Uthman and Abdullah bin Mas'ud (may Allah be pleased with them) narrated it from the Prophet (peace and blessings be upon him), and it does not mention the killing of the muharib. The correct version is the one that does not mention it, because the apostate is in any case deserving of death by agreement."
وسلف برقم (8122) من طريق أبي حذيفة موسى بن مسعود النهدي عن إبراهيم بن طهمان، ولم يذكر المصنف فيه هناك الحرابة.
Reference / Source: This narration has already passed at no. (8122) through the route of Abu Hudhayfah Musa bin Mas'ud al-Nahdi, from Ibrahim bin Tahman, and there the author (al-Hakim) did not mention "hirabah" in it.
