Mustadrak al-Hakim — Hadith 8242

حدثنا علي بن حَمْشَاذَ العَدْل، حدثنا محمد بن عيسى بن السَّكَن بواسط، حدثنا أبو منصور الحارث بن منصور، حدثنا إسرائيل، حدثنا عثمان الشَّحَّام، عن عكرمة، عن عبد الله بن عباس قال: كانت أُمُّ ولدِ لرجل كان له منها ابنانِ مثل اللُّؤلؤتين، وكانت تَشتِمُ النبيَّ ﷺ فينهاها ولا تنتهي، ويزجُرُها ولا تنزجِرُ، فلما كان ذاتُ ليلةٍ ذكرتِ النبيَّ ﷺ، فما صَبَرَ أن قام إلى مِغوَلٍ فَوَضَعَها في بطنها، ثم اتَّكأ عليها حتى أنقَذَها، فقال رسول الله ﷺ: "أَشْهَدُ أَنَّ دَمَها هَدْرٌ" (1).
هذا حديث صحيح الإسناد على شرط مسلم، ولم يُخرجاه.

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that a man had an "umm walad" (a slave woman who had borne her master a child), from whom he had two sons like pearls. She used to insult the Prophet (peace and blessings be upon him); he would forbid her but she would not desist, and he would rebuke her but she paid no heed. Then one night she mentioned the Prophet (peace and blessings be upon him) (in an evil way), and the man could not bear it. He got up with a dagger, placed it on the woman's belly and pressed on it until he drove it through her. Then the Messenger of Allah (peace and blessings be upon him) said: "I bear witness that her blood is unavenged (no retribution is due for it)."
This hadith is sahih (authentic) on the condition of Imam Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it.

Grading: The hadith is strong (qawi).
Technical note: This chain is "hasan" in corroborations on account of "al-Harith bin Mansur", and he has been corroborated. (The narrator) Isra'il is "Ibn Yunus al-Sabi'i".
وأخرجه أبو داود (4361)، والنسائي (3519) من طريق إسماعيل بن جعفر، عن إسرائيل، بهذا الإسناد.
Reference / Source: Abu Dawud (4361) and al-Nasa'i (3519) narrated it via Isma'il bin Ja'far, from Isra'il, with this same chain.

Supporting reports: On this topic there is a narration from Ali (may Allah be pleased with him) in Abu Dawud (4362).
قوله: "المغول" قال ابن الأثير في "النهاية": بالكسر: شبهُ سيف قصير، يشتمل به الرجلُ تحت ثيابه فيغطيه. وقيل: هو حديدة دقيقة لها حدٌّ ماض وقفًا.
Linguistic note: About the word "al-mighwal" (with kasrah on the mim), Ibn al-Athir says in "al-Nihayah": It is something like a short sword which a man conceals under his clothes. And it is said: It is a thin blade with a sharp edge.
وقوله: "هدر" قال الجوهري في "الصحاح": ذهب دمُ فلان هَدْرًا وهَدَرًا بالتحريك، أي: باطلًا ليس فيه قَوَدٌ ولا عَقْلٌ.
Linguistic note: About the word "hadar", al-Jawhari says in "al-Sihah": So-and-so's blood went "hadran" (in vain), i.e., it went for nothing, with neither retaliation (qawad) nor blood money for it.
قال الخطابي في "معالم السنن" 3/ 295: وفيه بيان أن سابَّ النبي ﷺ مقتول، وذلك أنَّ السبّ منها لرسول الله ﷺ ارتدادٌ عن الدين، ولا أعلم أحدًا من المسلمين اختلف في وجوب قتله، ولكن إذا كان السابُّ ذميًا فقد اختلفوا فيه، فقال مالك بن أنس: من شتم النبي ﷺ من اليهود والنصارى قُتل إلَّا أن يُسلِم، وكذلك قال أحمد بن حنبل، وقال الشافعي: يُقتل الذِّمِّي إذا سبَّ النبيَّ ﷺ وتبرأ منه الذمة، واحتجَّ في ذلك بخبر كعب بن الأشرف، وحُكي عن أبي حنيفة أنه قال: لا يُقتل الذميُّ بشتم النبي ﷺ، ما هم عليه من الشرك أعظم.
Juristic analysis: Imam al-Khattabi says in "Ma'alim al-Sunan" (3/295): This shows that one who reviles the Prophet (peace and blessings be upon him) is to be killed, because reviling the Messenger of Allah (peace and blessings be upon him) is apostasy from the religion, and I do not know of any Muslim who differed over the obligation to kill him. However, if the reviler is a "dhimmi", they differed about it. Imam Malik bin Anas said: Whoever of the Jews and Christians reviles the Prophet (peace and blessings be upon him) is to be killed unless he accepts Islam. Imam Ahmad bin Hanbal said the same. Imam al-Shafi'i said: The dhimmi is to be killed if he reviles the Prophet (peace and blessings be upon him), and the covenant of protection (dhimmah) is void with respect to him; he took as evidence the report about Ka'b bin al-Ashraf. And it is reported from Abu Hanifah that he said: The dhimmi is not to be killed for reviling the Prophet (peace and blessings be upon him), (because) the polytheism they are upon is greater.
