أخبرني إبراهيم بن إسماعيل القارئ، حدثنا عثمان بن سعيد الدَّارِمي، حدثنا يحيى بن صالح الوُحَاظي، حدثنا معاوية بن سلَّام، عن يحيى بن أبي كثير، عن عِكْرمة، عن أبي هريرة قال: قال رسول الله ﷺ: "من استَلَجَّ في أهلِه بيمينٍ، فهو أعظُم إثمًا" (1). هذا حديث صحيح على شرط البخاري. It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever stubbornly persists in an oath (that causes harm) sworn concerning his family, that is a cause of greater sin for him (than breaking the oath)."
This hadith is sahih (authentic) on the condition of Imam Bukhari.

Reference / Source: It was recorded by Imam al-Bukhari (6626) and Ibn Majah (2114 M) through two routes from Yahya bin Salih al-Wuhazi, with this same chain. وقد خالف معمرٌ معاويةَ بنَ سلام، فرواه عن يحيى بن أبي كثير عن عكرمة مرسلًا كما في "مصنف عبد الرزاق" (16037)، ورجَّح روايته أبو حاتم في "العلل" (1330). Technical note / Defect ('illah): Imam Ma'mar contradicted Mu'awiyah bin Sallam: he narrated it via Yahya bin Abi Kathir from 'Ikrimah as "mursal", as in "Musannaf 'Abd al-Razzaq" (16037), and Imam Abu Hatim al-Razi preferred this mursal narration in "al-'Ilal" (1330). وانظر ما بعده. Important point: See also the narration that follows. قوله "من استلجَّ" قال السندي في حاشيته على "المسند": إذا حلف يمينًا يتعلق بأهله، وهم يتضررون بالإصرار عليه، فاللائق به أن يحنث ويكفر عن يمينه، وأما الثبات على اليمين والإصرار عليه وترك الحنث فهو لَجَاج. وقوله: "أعظم إثمًا" يعني: أعظم إثمًا من الكفارة. General principle: Regarding the words of the hadith "man istalajja", 'Allamah al-Sindi wrote in his gloss on "Musnad Ahmad": When a person swears an oath concerning his family, and persisting in it harms them, then what befits him is to break the oath and pay the expiation; clinging to such an oath and fulfilling it is itself "lajaj" (obstinacy). And "a'zamu ithman" means that (persisting in it) is a greater sin than paying the expiation.
