Mustadrak al-Hakim — Hadith 7772

أخبرنا الحسن بن يعقوب العَدْل، حدثنا يحيى بن أبي طالب، أخبرنا عبد الوهاب بن عطاء، أخبرنا داود بن أبي هِند، عن الشَّعْبي، عن محمد بن صفوان أنه أصابَ أرنبَينِ فلم يجدْ حديدةً يُذكِّيهما، فذبحهما (1) بمَرُوةٍ، فأتى النبيَّ ﷺ فقال: يا رسولَ الله، إنِّي اصطدتُ أرنَبينِ فلم أجدْ حديدةً أُذكِّيهما، فذكَّيتُهما بمَرُوةٍ، أفآكلُ؟ قال: "نَعَمْ كُلْ" (2).
هذا حديث صحيح على شرط مسلم مع الاختلاف فيه على الشعبيِّ، ولم يُخرجاه.

It is narrated from Muhammad bin Safwan (may Allah be pleased with him) that he caught two rabbits but found no knife or iron implement with which to slaughter them, so he slaughtered them with a sharp-edged stone. Then he came to the Prophet (peace and blessings be upon him) and said: "O Messenger of Allah (peace and blessings be upon him), I hunted two rabbits but found no iron with which to slaughter them, so I slaughtered them with a marwah (sharp stone). May I eat them?" He (peace and blessings be upon him) said: "Yes, eat them."
This hadith is sahih (authentic) on the condition of Imam Muslim, although there is a disagreement over its narration from Imam al-Sha'bi, and the two Shaykhs (Bukhari and Muslim) did not record it.

Note / Clarification: In manuscript (Z) the words "yudhakkiha fa-dhabahaha" are narrated in the singular form.

(2) حديث صحيح، وهذا إسناد قوي من أجل يحيى بن أبي طالب وعبد الوهاب بن عطاء -وهو الخفّاف- وقد توبعا، واختُلف على الشعبي في اسم صحابيه ألوانًا كما في "علل الدارقطني" (3386)، ولا يضرّ.
Grading: This hadith is sahih, and its chain is strong (qawi) on account of Yahya bin Abi Talib and 'Abd al-Wahhab bin 'Ata' (al-Khaffaf), and both of them have corroboration (mutaba'ah).
Technical note / Defect ('illah): Various differences are reported from al-Sha'bi concerning the name of the Companion in this narration, as mentioned in al-Daraqutni's "al-'Ilal" (3386), but this difference does not harm the authenticity of the hadith.
وأخرجه أحمد 25/ (15871)، وابن ماجه (3244)، والنسائي (4473) و (4806) من طرق عن داود بن أبي هند، بهذا الإسناد.
Reference / Source: Imam Ahmad narrated it in 25/ (15871), Imam Ibn Majah in (3244) and Imam al-Nasa'i in (4473) and (4806) by various routes from Dawud bin Abi Hind, with this same chain.
وأخرجه أحمد 25/ (15870)، وأبو داود (2822)، والنسائي (4806)، وابن حبان (5887) من طريق عاصم بن سليمان الأحول، عن الشعبي، به.
Reference / Source: Imam Ahmad 25/ (15870), Imam Abu Dawud (2822), Imam al-Nasa'i (4806) and Imam Ibn Hibban (5887) narrated it by way of 'Asim bin Sulayman al-Ahwal, from al-Sha'bi.
وأخرجه ابن ماجه (712) من طريق أبي الأحوص سلام بن سليم، عن الشعبي، عن محمد بن صَيفي. كذا سماه ابنَ صيفي.
Reference / Source: Imam Ibn Majah narrated it in (712) by way of Abu al-Ahwas (Sallam bin Sulaym), from al-Sha'bi, from Muhammad bin Sayfi. In this narration the Companion's name is given as "Ibn Sayfi".
وأخرجه أحمد 22/ 14486) من طريق جابر الجعفي، والترمذي (1472) من طريق قتادة، كلاهما عن الشعبي، عن جابر بنحوه.
Reference / Source: Imam Ahmad narrated it in 22/ (14486) by way of Jabir al-Ju'fi, and Imam al-Tirmidhi in (1472) by way of Qatadah; both of them (Jabir al-Ju'fi and Qatadah) narrate from al-Sha'bi, from Jabir bin 'Abd Allah (may Allah be pleased with him), with a similar meaning.
قال الترمذي عقبه: اختلف أصحاب الشعبي في رواية هذا الحديث، فروى داود بن أبي هند عن الشعبي عن محمد بن صفوان، وروى عاصم الأحول عن الشعبي عن صفوان بن محمد أو محمد ابن صفوان، ومحمد بن صفوان أصح، وروى جابر الجعفي عن الشعبي عن جابر بن عبد الله نحو حديث قتادة عن الشعبي، ويحتمل أنَّ الشعبي روى عنهما جميعًا، قال محمد (يعني البخاري): حديث الشعبي عن جابر غير محفوظ.
Technical note / Defect ('illah): After this hadith Imam al-Tirmidhi says that the students of al-Sha'bi differed in narrating it: Dawud bin Abi Hind narrated it from al-Sha'bi, from Muhammad bin Safwan; 'Asim al-Ahwal narrated it from al-Sha'bi, from Safwan bin Muhammad or Muhammad bin Safwan, but "Muhammad bin Safwan" is more correct; Jabir al-Ju'fi narrated it from al-Sha'bi, from Jabir bin 'Abd Allah, like the narration of Qatadah. It is possible that al-Sha'bi narrated it from both of them (Muhammad bin Safwan and Jabir). Imam Muhammad bin Isma'il al-Bukhari says: "The hadith of al-Sha'bi from Jabir bin 'Abd Allah is not mahfuz (preserved)."
قال الخطابي: المَرْوة: حجارة بيض. قال الأصمعي: وهي التي يُقدَح منها النار، وإنما تجزئ الذكاة من الحجر بما كان له حدٌّ يقطع.
Note / Clarification: Imam al-Khattabi says: "al-marwah" is a white stone. According to Imam al-Asma'i, it is the stone from which fire is struck (kindled).
General principle: Slaughtering with a stone is valid only when it has an edge sharp enough to cut (the vessels).
