Mustadrak al-Hakim — Hadith 7333

حدثنا بكر بن محمد الصَّيرفي بمَرْو، حدثنا أبو قِلابة الرَّقَاشي، حدثنا أبو عاصم، حدثنا الأوزاعي، حدثنا حسان بن عطيّة، عن أبي واقدٍ اللَّيثي قال: قلتُ: يا رسولَ الله، إنَّا بأرضٍ مَخْمَصةٍ، فما يَحِلُّ لنا من المَيْتة؟ قال: "إذا لم تَصطَبِحوا، ولم تَغْتبِقوا، ولم تَحتَفِئوا (1) بها بَقْلًا، فشأنَكم بها" (2).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه.

It is narrated from Sayyiduna Abu Waqid al-Laythi (may Allah be pleased with him) that he said: O Messenger of Allah! We are in a land stricken by famine, so how much of carrion is lawful for us? He (peace and blessings be upon him) said: "When you have nothing (such as milk) to drink in the morning or in the evening, and you cannot obtain any vegetables or greens (from the ground), then it (the carrion) is permissible for you."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

(1) في (ص) و (م): تحتفوا، والمثبت من (ز)، وكلا الوجهين قد ورد، قال أبو عبيد: هو من الحفأ مهموز مقصور، وهو أصل البَردي الأبيض الرطب، وقد يؤكل، يعني: ما لم تقتلعوا هذا بعينه فتأكلوه. ويروى: ما لم تحتفُّوا، بالتشديد من: احتففتُ الشيء: إذا أخذتَه كلَّه. وذُكر له وجوه أخرى، انظر "النهاية" (حفف) لابن الأثير.
Note / Clarification: Manuscripts (S) and (M) have "tahtafu", while the word in (Z) has been kept in the text, and it has been narrated both ways.
General principle: Abu 'Ubayd says that it is from "al-hafa'" (with a hamzah), which is the root of the white, moist papyrus plant that is eaten, meaning: as long as you do not uproot it and eat it. There is also a narration "tahtaffu" (with a shaddah), meaning to take something completely. For further possibilities see Ibn al-Athir's "al-Nihayah" (root: h-f-f).

(2) حديث محتمل للتحسين، وهذا إسناد قد اختلف فيه على الأوزاعي - وهو عبد الرحمن بن عمرو - فروى عنه منقطعًا بين حسان بن عطية وبين أبي واقد الليث كما في هذه الرواية، وروي عنه متصلًا بذكر الواسطة بينهما، واختلف في هذه الواسطة، فقيل: هو مسلم بن مِشكَم، وقيل: مسلم بن يزيد، وقيل: مرثد أبو مرثد، وجاء مرة عن رجل سُمّي له على الإبهام، وروي عنه عن حسان مرسلًا. وذكرنا تخريجها في "مسند أحمد".
Grading: This hadith has the possibility of being graded "hasan".
Technical note / Defect ('illah): In this chain there is disagreement over Imam al-Awza'i ('Abd al-Rahman bin 'Amr); in this narration there is a break (inqita') between Hassan bin 'Atiyyah and Abu Waqid al-Laythi, whereas in some narrations it has been connected by mentioning an intermediary. There is also disagreement over the name of the intermediary (Muslim bin Mishkam, Muslim bin Yazid, or Abu Marthad). In some places an unnamed person is mentioned, and some narrated it from Hassan as "mursal".

Important point: There (in Musnad Ahmad) we missed mentioning the route in which the intermediary is explicitly named "Muslim bin Yazid", so we mention it here.
فأخرجه ابن حذلم في "جزء من حديث الأوزاعي" (33) من طريق عبد الله بن كثير الطويل القارئ، عن الأوزاعي، عن حسان بن عطية، عن مسلم بن يزيد عن أبي واقد.
Reference / Source: It was recorded by Ibn Hadhlam in "Juz' min Hadith al-Awza'i" (33) through the route of 'Abd Allah bin Kathir al-Tawil al-Qari', from al-Awza'i, from Hassan bin 'Atiyyah, from Muslim bin Yazid, from Abu Waqid al-Laythi.

قوله: "تغتبقوا" من الغَبوق، بفتح الغين: الشُّرب بالعَشيّ، وخصَّ بعضهم به اللبن المشروب في ذلك الوقت. انظر "لسان العرب" (عبق).
General principle: The root of the word "taghtabiqu" is "ghabuq", which means drinking in the evening, and some restricted it to milk drunk at that time. For details see "Lisan al-'Arab" (root: '-b-q).
