Mustadrak al-Hakim — Hadith 7332

حدثني أبو بكر محمد بن أحمد بن بالَوَيهِ، حدثنا محمد بن غالب وإسحاق بن الحسن، قالا: حدثنا عفّان، حدثنا أبو عَوَانة، عن سِماك بن حرب، عن جابر بن سَمُرة قال: فُلِتَ (1) بغلٌ عند رجلٍ، فأتى رسولَ الله ﷺ يستفتيه، فزعم جابر بن سَمُرة: أنَّ رسول الله ﷺ قال لصاحبها: "أما لك ما يُغنيكَ عنها؟ " قال: لا، قال: "اذهَبْ فكُلْها" (2). صحيح على شرط مسلم، ولم يُخرجاه.

It is narrated from Sayyiduna Jabir bin Samurah (may Allah be pleased with him) that a man's animal was about to die, so he came to the Messenger of Allah (peace and blessings be upon him) to seek a ruling. Sayyiduna Jabir bin Samurah (may Allah be pleased with him) states that the Messenger of Allah (peace and blessings be upon him) said to its owner: "Do you not have anything else that would suffice you instead of it?" He said: No. He (peace and blessings be upon him) said: "Then go and eat it."
This hadith is sahih (authentic) on the condition of Imam Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) كذا في النسخ: فلت، بالفاء مبنيٌّ للمفعول، والمعنى: مات فجأةً، ويمكن أن تكون: قَلِتَ، بالقاف كسَمِعَ، والقَلَت: الهلاك.
General principle: Textual investigation: The manuscripts have "fulita" (with fa'), meaning "to die suddenly", and it may also be "qalita" (with qaf), meaning "to perish".

(2) منكر، سماك بن حرب اختلف فيه كلام أهل العلم، لكنه إذا انفرد بأصل لم يكن حجة، لأنه كان يُلقَّن فيتلقن كما قال النسائي، وقد انفرد بهذا الحديث، كما أن الرواة اختلفوا عليه، فجعل الأكثرون أنَّ الدابة التي ماتت هي ناقة، وجعلها أبو عوانة عنه بغلًا! ومع ذلك فقد نقل الخطيب في "الجامع لأخلاق الراوي" (1336) أن أحمد سُئل عن معناه، فقال: صحيح، ولا أعرف معناه.
Grading: This narration is "munkar".
Technical note / Defect ('illah): There is criticism regarding Simak bin Harb; when he is alone in a basic report he is not a proof, because he would be "prompted" (talqin) and would accept it. He is alone in this hadith, and there is also disagreement among the narrators (most said a she-camel, Abu 'Awanah said a mule).
Note / Clarification: Imam Ahmad said regarding its meaning: "It is sahih, but I do not know its meaning".
وأخرجه أحمد 34/ (20824) عن عفّان بن مسلم، بهذا الإسناد.
Reference / Source: It was recorded by Imam Ahmad 34/(20824) through the route of 'Affan bin Muslim, with this same chain.
وأخرجه عبد الله بن أحمد (20918)، والطبراني في "الكبير" (1977)، والبيهقي 9/ 356 من طرق عن أبي عوانة، به. ووقع في رواية البيهقي: مات بغل أو قال: ناقة. وقال عبد الله بن أحمد: الصواب ناقة.
Reference / Source: This narration was recorded by 'Abd Allah bin Ahmad (20918), al-Tabarani in "al-Kabir" (1977) and al-Bayhaqi 9/356 through various routes from Abu 'Awanah (al-Waddah bin 'Abd Allah al-Yashkuri), with this same chain.
Note / Clarification: In al-Bayhaqi's narration there is doubt as to "whether a mule died or a she-camel", while 'Abd Allah bin Ahmad stated explicitly that the correct word is "naqah" (she-camel).
وأخرجه أحمد (20815) من طريق شريك النخعي، و (20993) من طريق حماد بن سلمة، كلاهما عن سماك، به.
Reference / Source: It was recorded by Imam Ahmad (20815) through the route of Sharik bin 'Abd Allah al-Nakha'i and (20993) through the route of Hammad bin Salamah; both of them narrate from Simak bin Harb with this same chain.
