It is narrated from Sayyiduna Abu Ayyub (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "The slaughter of the fetus is the slaughter of its mother." In the narration of Abu al-Waddak from Abu Sa'id (may Allah be pleased with him), a narrator named Allan is alone in narrating it, and its wording contains some additions by which no proof is established. But when the experts of this discipline reflect on the hadiths of this chapter as a whole, they are amazed that the two Shaykhs (Bukhari and Muslim) did not include it in their "Sahih".

Grading: It is "sahih li-ghayrihi" on the basis of supporting reports, but this particular chain is weak. Technical note / Defect ('illah): Ibn Abi Layla (Muhammad bin Abd al-Rahman) is weak because of his poor memory, and there is disagreement over him as to whether it is narrated connected (wasl) or disconnected (irsal). His brother is Isa, who is well known for narrating from him. The condition of Abdullah bin al-Ala' bin Shaybah is not clear, while in this same generation there is also Abdullah bin al-Ala' bin Khalid al-Basri, who narrated from Shu'bah; Ibn Abi Hatim mentioned him in "al-Jarh wa al-Ta'dil" (5/128) and transmitted from his father that he is "salih" (acceptable). Reference / Source: It was narrated by al-Tabarani in "al-Kabir" (4010) via al-Husayn bin Ishaq al-Tustari, from Yusuf bin Musa al-Qattan, with this same chain. Reference / Source: It was narrated by al-Mahamili (430, in the narration of Ibn Yahya) through the route of Wahb bin Yahya bin Hafs al-Harrani, from his grandfather, from Shu'bah. Technical note / Defect ('illah): Its narrator Wahb is accused of lying. Reference / Source: It was narrated by Abd al-Razzaq (8649) from Ibn al-Mubarak, from Ibn Abi Layla or al-Hakam (Ibn al-Mubarak was in doubt), from Abd al-Rahman bin Abi Layla as "mursal". The brother of Muhammad bin Abi Layla is not mentioned in this chain.
Technical note / Defect ('illah): The word "Abi" has dropped out of the manuscripts available to us, and the narration of Abu al-Waddak from Abu Sa'id al-Khudri has been mentioned just before.
(11495). Technical note / Defect ('illah): Regarding the author's (al-Hakim's) statement that "Allan is alone in this narration", Imam Ibn al-Mulaqqin says in "al-Badr al-Munir" (9/393): "So he said, but I do not know this among its routes". Note / Clarification: We say: see the route of Abu al-Waddak in Musnad Ahmad (numbers 11260, 11343, 11495).
