Mustadrak al-Hakim — Hadith 7285

حدثنا محمد بن صالح بن هانئ، حدثنا السَّري بن خُزَيمة والحسن بن الفضل (ح) وأخبرنا إسماعيل بن علي الخُطَبي، حدثنا إسماعيل بن إسحاق القاضي ومحمد بن غالب؛ قالوا: حدثنا الحسن بن بشر بن سَلْم، حدثنا زهير، عن أبي الزُّبير، عن جابر قال: قال رسول الله ﷺ: "ذكاةُ الجَنينِ ذكاةُ أُمِّه" (1). تابعه من الثِّقات عُبيد الله بن أبي زياد القدَّاح المكي:
It is narrated from Sayyiduna Jabir (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "The slaughter of the fetus (the young in its mother's womb) is the slaughter of its mother." (That is, the lawful slaughter of the mother suffices for the young in her womb as well.) This hadith has been corroborated (mutaba'ah), from among the trustworthy narrators, by Ubaydullah bin Abi Ziyad al-Qaddah al-Makki as well:

(1) صحيح لغيره، وهذا إسناد ضعيف، الحسن بن بشر بن سلم روى عن زهير - وهو ابن معاوية الجعفي - أشياء مناكير كما قال الإمام أحمد. وقد ذكر ابن حبان في "المجروحين" 1/ 251: أن الحسن بن بشر إنما سمع هذا الخبر عن حماد بن شعيب عن أبي الزبير، ثم وهم فرواه عن زهير بن معاوية عن أبي الزبير. وقد أشار المصنف بإثر الحديث الآتي برقم (7287) أنَّ الحديث إنما يعرف عن ابن أبي ليلى وحماد بن شعيب.
Grading: This hadith is "sahih li-ghayrihi", but this particular chain is weak.
Technical note / Defect ('illah): Al-Hasan bin Bishr bin Salm transmitted "manakir" (objectionable narrations) from Zuhayr bin Mu'awiyah al-Ju'fi, as Imam Ahmad said. Ibn Hibban stated explicitly in "al-Majruhin" (1/251) that al-Hasan bin Bishr actually heard this narration from Hammad bin Shu'ayb from Abu al-Zubayr, but he erred and attributed it to Zuhayr. The author (al-Hakim) also indicated, after the hadith coming at number (7287), that this narration is known only through Ibn Abi Layla and Hammad bin Shu'ayb.
وأخرجه البيهقي 9/ 334 من طريق تمتام محمد بن غالب، بهذا الإسناد.
Reference / Source: It was narrated by al-Bayhaqi (9/334) through the route of Tamtam Muhammad bin Ghalib with this same chain.
وأخرجه أبو القاسم البغوي في "الجعديات" (2653)، وابن المقرئ في "المعجم" (997) وابن عدي في "الكامل" 2/ 320، وأبو نعيم في "تاريخ أصبهان" 2/ 82، والبيهقي 9/ 334 من طرق عن الحسن بن بشر بن سلم، به.
Reference / Source: It was recorded by Abu al-Qasim al-Baghawi in "al-Ja'diyyat" (2653), Ibn al-Muqri' in "al-Mu'jam" (997), Ibn Adi in "al-Kamil" (2/320), Abu Nu'aym in "Tarikh Asbahan" (2/82) and al-Bayhaqi (9/334) through various routes from al-Hasan bin Bishr.
وأخرجه أبو يعلى الموصلي (1808) - وعنه ابن حبان في "المجروحين" 1/ 289، وابن عدي في "الكامل" 2/ 242 - 243 - وابن عدي 2/ 242، وأبو نعيم في "تاريخ أصبهان" 1/ 92 من طريقين عن حماد بن شعيب، عن أبي الزبير، به. وزاد في رواية أبي يعلى: "إذا أشعر". وحماد بن شعيب متفق على ضعفه.
Details of the narration: It was narrated by Abu Ya'la al-Mawsili (1808), and from him by Ibn Hibban in "al-Majruhin" (1/289) and Ibn Adi in "al-Kamil" (2/242-243), and also by Ibn Adi (2/242) and Abu Nu'aym in "Tarikh Asbahan" (1/92), through two routes from Hammad bin Shu'ayb, from Abu al-Zubayr. In Abu Ya'la's narration there is the addition "idha ash'ara" (when its hair has grown).
Technical note / Defect ('illah): The hadith scholars agree that Hammad bin Shu'ayb is weak.
وأخرجه ابن الأعرابي في "المعجم" (201)، والدارقطني (4234) من طريق صباح بن يحيى المزني، عن ابن أبي ليلى، عن أبي الزبير، به. بلفظ: "كلِ الجنينَ في بطن أمه - أو الناقة.". ومحمد بن أبي ليلى سيئ الحفظ. وأخرجه ابن عدي في "الكامل" 6/ 408، وأبو نعيم في "الحلية" 7/ 92، وأبو يعلي الخليلي في "الإرشاد" (113) من طريق محمد بن إبراهيم بن زياد الرازي الطيالسي، عن إسحاق بن عمرو الرازي، عن معاوية بن هشام، عن سفيان الثَّوري، عن أبي الزبير، به. وقال أبو نعيم: تفرد به معاوية عن الثَّوري، وعنه إسحاق. وأشار الخليلي إلى أنَّ محمد بن إبراهيم الطيالسي هو المتفرد به عنهم. قلنا: وهو متهم كما قال الدارقطني، فلا يفرح به. ووقع في "كامل" ابن عدي تحريف في الإسناد.
Details of the narration: It was narrated by Ibn al-A'rabi in "al-Mu'jam" (201) and al-Daraqutni (4234) through the route of Sabbah bin Yahya al-Muzani, from Muhammad bin Abi Layla, from Abu al-Zubayr, with the wording: "Eat the fetus in its mother's womb".
Technical note / Defect ('illah): Muhammad bin Abi Layla had a poor memory. Ibn Adi in "al-Kamil" (6/408), Abu Nu'aym in "al-Hilyah" (7/92) and al-Khalili in "al-Irshad" (113) mention another route (from Sufyan al-Thawri, from Abu al-Zubayr) in which, as Abu Nu'aym and al-Khalili indicate, Muhammad bin Ibrahim al-Tayalisi is alone, and according to al-Daraqutni he is "muttaham" (accused), so this route is not reliable. In Ibn Adi's book there is also a corruption (error) in the chain at this place.
