Mustadrak al-Hakim — Hadith 7226

أخبرنا عبد الرحمن بن الحسن القاضي بهَمَذان، حدثنا إبراهيم بن الحسين، حدثنا عبد الله بن الزُّبير الحُميدي، حدثنا مسلم بن خالد، حدثنا العلاء بن عبد الرحمن، عن أبيه، عن أبي هريرة، قال: قال رسول الله ﷺ: "لا تجوزُ شهادةُ ذي الظِّنّةِ ولا ذي الحِنَة" (1).
هذا حديث صحيح على شرط مسلم، ولم يُخرجاه.

It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "The testimony of a person under suspicion (of ill repute) and of one who bears a grudge (an enemy) is not permissible."
This hadith is sahih (authentic) on the condition of Imam Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) إسناده ضعيف، عبد الرحمن بن الحسن شيخ المصنف ليِّن، ومسلم بن خالد - وهو المخزومي مولاهم المعروف بالزنجي - ضعيف.
Grading: Its chain is da'if (weak).
Technical note / Defect ('illah): The author's shaykh "Abd al-Rahman bin al-Hasan" is "layyin" (weak), and Muslim bin Khalid (al-Makhzumi, known as al-Zanji) is also a weak narrator.
وأخرجه البيهقي 10/ 201 من طريق عبيد الله بن موسى، ومن طريق عبد الصمد بن النعمان، كلاهما عن مسلم بن خالد الزنجي بهذا الإسناد. ولفظه الأول عنده: لا تجوز شهادة ذي الخُلَّة ولا ذي الجِنَّة، ولا ذي الحِنَة المحقود. ولفظ الثاني: لا تجوز شهادة ذي الحِنَة والظِّنة، وقال: الظنة أحفظ من الخلة.
Reference / Source: Imam al-Bayhaqi narrated it (10/201) by way of Ubaydullah bin Musa and Abd al-Samad bin al-Nu'man; both of them transmit it from Muslim bin Khalid al-Zanji with this same chain.
Details of the narration: In al-Bayhaqi, the first wording is: "The testimony of a friend, an insane person, or a spiteful enemy is not permissible." The second wording is: "The testimony of a spiteful enemy and a suspected person is not permissible." Imam al-Bayhaqi said that the word "al-zinnah" (suspicion) is better preserved (more correct) than "al-khullah" (friendship).
ثم نقل تفسيره عن أحد الرواة، فقال: الجِنَّة الجنون، والحِنَة الذي يكون بينكم وبينه عداوة.
Note / Clarification: Then Imam al-Bayhaqi transmitted its explanation from one of the narrators, saying: "al-jinnah" means insanity, and "al-hinah" refers to someone between whom and you there is enmity.
وقال ابن الأثير في "النهاية" الحِنَة: العداوة، وهي لغة قليلة في الإحنة.
Important point: Ibn al-Athir wrote in "al-Nihayah" that "al-hinah" means enmity, and it is a rarely used variant of "al-ihnah".
وأخرجه أبو داود في "المراسيل" (397)، والبيهقي 10/ 201 من طريق ابن أبي ذئب عن الحكم بن مسلم، عن عبد الرحمن الأعرج مرسلًا، قال: قال رسول الله ﷺ: "لا تجوز شهادة ذي الظنة والإحنة والجنة".
Reference / Source: Imam Abu Dawud narrated it in "al-Marasil" (397), and al-Bayhaqi (10/201), by way of Ibn Abi Dhi'b, from al-Hakam bin Muslim, from Abd al-Rahman al-A'raj as "mursal", that the Messenger of Allah (peace and blessings be upon him) said: "The testimony of a suspected person, a spiteful enemy, and an insane person is not permissible."
وأشار البيهقي إلى أنه أصح شيء في هذا الباب وإن كان مرسلًا، قلنا: والحكم بن مسلم روى عنه اثنان، وذكره ابن حبان في "الثقات".
Grading: Imam al-Bayhaqi indicated that it is the most authentic narration in this chapter, even though it is "mursal".
Technical note / Defect ('illah): We say: two narrators reported from al-Hakam bin Muslim, and Imam Ibn Hibban mentioned him in "al-Thiqat".
وأخرجه عبد الرزاق (15366) من طريق ابن أبي ذئب عن الحكم، به. لكن جعل عبد الرحمن هو ابن فروخ، وليس عبد الرحمن الأعرج!
Technical note / Defect ('illah): Abd al-Razzaq narrated it (15366) by way of Ibn Abi Dhi'b, from al-Hakam, but here Abd al-Rahman is taken to be "Ibn Farrukh" and not "Abd al-Rahman al-A'raj".
وأخرج عبد الرزاق (15365) عن إبراهيم بن محمد الأسلمي، عن عبد الله، عن يزيد بن طلحة، عن طلحة بن عبد الله، عن أبي هريره مرفوعًا: "لا تجوز شهادة خصم ولا ظَنين".
Reference / Source: Abd al-Razzaq narrated (15365) by way of Ibrahim bin Muhammad al-Aslami, from Abdullah, from Yazid bin Talhah, from Talhah bin Abdullah, from Abu Hurayrah (may Allah be pleased with him) as marfu': "The testimony of an opposing litigant and a suspected person is not permissible."
وإبراهيم الأسلمي متروك، ووصله منكر، والصواب أنه مرسل كما في "مراسيل أبي داود" (396). وانظر أحاديث الباب عند حديث عبد الله بن عمرو في "مسند أحمد" 11/ (6698).
Grading: Ibrahim al-Aslami is a "matruk" (abandoned) narrator, and his making it "mawsul" is munkar;
