Mustadrak al-Hakim — Hadith 7217

أخبرنا أبو بكر بن إسحاق، أخبرنا إسماعيل بن قُتيبة، حدثنا يحيى بن يحيى، أخبرنا سفيان، عن إسماعيل بن أُمية، عن الزُّهْري، عن سعيد بن المسيّب، يبلغ به النبيَّ ﷺ قال: "حَرِيمُ قَلِيب العاديَّة خمسون ذراعًا، وحَريمُ قَلِيب البادي خمسةٌ وعشرون ذِراعًا" (1). وَصَله وأسنَده عمرُ بن قيس عن الزُّهري:
It is narrated from Sa'id bin al-Musayyab (may Allah have mercy on him), who traces it back to the Prophet (peace and blessings be upon him), that he (peace and blessings be upon him) said: "The protected zone (the safeguarded area around it) of an ancient well ('adiyyah) is fifty cubits, and the zone of a newly dug well (badi) is twenty-five cubits."

(1) رجاله ثقات، وقد اختلف على الزهري فيه، فرواه بعضهم عنه عن سعيد بن المسيب مرسلًا، ورواه بعضهم عن الزهري عن سعيد موقوفًا عليه. يحيى بن يحيى: هو ابن بكير النيسابوري، وسفيان: هو ابن عيينة.
Technical note / Defect ('illah): All its narrators are thiqah (trustworthy); however, there is disagreement over it from Imam al-Zuhri: some narrated it through him from Sa'id bin al-Musayyab as "mursal", and some made it "mawquf" on Sa'id bin al-Musayyab (his own statement).
Note / Clarification: Yahya bin Yahya is Ibn Bukayr al-Naysaburi, and Sufyan is Sufyan bin Uyaynah.
وأخرجه مسدد كما في "المطالب العالية" (1464) عن سفيان بن عيينة، بهذا الإسناد مرسلًا.
Reference / Source: Musaddad narrated it (as in "al-Matalib al-Aliyah": 1464) by way of Sufyan bin Uyaynah, with this same chain, as "mursal".
وأخرجه ابن أبي شيبة 6/ 374، وابن زنجويه في "الأموال" (1078)، وأبو داود في "المراسيل" (402)، والبيهقي 6/ 155 من طرق عن سفيان الثَّوري، عن إسماعيل بن أمية، به مرسلًا.
Details of the narration: Ibn Abi Shaybah (6/374), Ibn Zanjawayh in "al-Amwal" (1078), Abu Dawud in "al-Marasil" (402) and al-Bayhaqi (6/155) narrated it through various routes from Sufyan al-Thawri, from Isma'il bin Umayyah, as "mursal".
وأخرجه مسدد أيضًا كما في "المطالب" (1464) من طريق زياد بن سعد، وتابعه صدقة بن عبد الله بن كثير كما في "علل" الدارقطني (1693)، كلاهما عن الزهري، به مرسلًا.
Details of the narration: Musaddad also narrated it by way of Ziyad bin Sa'd, and Sadaqah bin Abdullah bin Kathir corroborated him (as in al-Daraqutni's "al-Ilal": 1693). Both of them narrate it from al-Zuhri as "mursal".
وأخرجه موقوفًا على سعيد بن المسيب: يحيى بن آدم في "الخراج" (327) - ومن طريقه البيهقي 6/ 155 - من طريق يونس بن يزيد، وابن أبي شيبة 6/ 374 من طريق معمر، وأبو عبيد في "الأموال" (729)، وابن زنجويه (1079) من طريق الليث بن سعد، ثلاثتهم عن الزهري، عن سعيد بن المسيب.
Details of the narration: The following narrated it as "mawquf" on Sa'id bin al-Musayyab: Yahya bin Adam in "al-Kharaj" (327) (and through him al-Bayhaqi 6/155) by way of Yunus bin Yazid; Ibn Abi Shaybah (6/374) by way of Ma'mar; and Abu Ubayd in "al-Amwal" (729) and Ibn Zanjawayh (1079) by way of al-Layth bin Sa'd. All three of these narrators narrate it from al-Zuhri, from Sa'id bin al-Musayyab.

قوله: "البادي" وفي بعض مصادر التخريج البديء، وفي بعضها الآخر: البديّة، قال ابن الأثير في "النهاية" البَديء: بوزن البديع، البئر التي حُفرت في الإسلام، وليست بعاديّة قديمة.
Important point: The word "البادي" occurs in the text, whereas in some sources it is narrated as "البديء" and in others as "البدية". Ibn al-Athir writes in "al-Nihayah" that "al-badi'" (on the pattern of badi') is a well that was dug in the Islamic era and is not an ancient one ('adiyyah).
وقال ابن زنجويه في "الأموال" 2/ 653: البدية ما يُبتدأ حفرها في الإسلام، والعاديّة ما كان قديمًا.
General principle: Ibn Zanjawayh says in "al-Amwal" (2/653): "al-badiyyah" is a well whose digging was begun in Islam, while "al-'adiyyah" is one that dates from ancient times.
