Mustadrak al-Hakim — Hadith 7216

أخبرنا أبو بكر بن إسحاق، أخبرنا عبد الله بن أحمد بن حنبل، حدثنا أبو كامل الجَحْدري، حدثنا فُضَيل بن سليمان، عن موسى بن عُقبة، عن إسحاق بن يحيى، عن عُبادة بن الصامت، قال: قَضَى رسولُ الله ﷺ في النَّخلة والنخلتين والثلاثِ، فيختلفون في حقوق ذلك، فقضى أنَّ لكلِّ نخلةٍ مبلغَ جَريدِها حَرِيمًا (2).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyiduna Ubadah bin al-Samit (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him), concerning one, two or three date palms over whose rights people were disputing, ruled that "around each tree, a space equal to the spread of its branches will be counted as its protected zone (harim) (that is, that space will be regarded as the property of the tree's owner)."
This hadith is sahih al-isnad (authentic in its chain), but the two Shaykhs (Bukhari and Muslim) did not record it.

(2) صحيح لغيره، وهذا إسناد ضعيف، فضيل بن سليمان - وهو النميري - ليِّن الحديث، وإسحاق بن يحيى - وهو ابن الوليد بن عبادة - مجهول الحال، ثم روايته عن جدِّ أبيه عبادة مرسلة.
Grading: This narration is "sahih li-ghayrihi" (authentic due to supporting reports), but this particular chain is da'if (weak).
Technical note / Defect ('illah): Fudayl bin Sulayman al-Numayri is "layyin al-hadith" (weak), and Ishaq bin Yahya (Ibn al-Walid bin Ubadah) is "majhul al-hal" (of unknown condition); moreover, his narration from his great-grandfather Ubadah is "mursal".
وهو في زوائد عبد الله على "مسند أحمد" 37 / (22778) ضمن حديث طويل.
Reference / Source: This narration is found in Abdullah bin Ahmad's additions (zawa'id) to "Musnad Ahmad" (37/22778), within a long hadith.
وأخرجه ابن ماجه (2488) عن عبد ربه بن خالد، عن فضيل بن سليمان، بهذا الإسناد.
Reference / Source: Ibn Majah (2488) narrated it by way of Abd Rabbih bin Khalid, from Fudayl bin Sulayman, with this same chain.
ويشهد له حديث أبي سعيد الخدري قال: اختصم إلى رسول الله ﷺ رجلان في حريم نخلة، فأمر بها، فذُرعت فوجدت سبعة أذرع - وفي رواية: خمسة أذرع - فقضى بذلك. قال عبد العزيز الدراوردي راويه: فأمر بجريدة من جريدها، فذرعت. أخرجه أبو داود (3640) وغيره، وسنده قوي.
Corroborating chains and supporting reports: It is supported by the hadith of Abu Sa'id al-Khudri (may Allah be pleased with him) that two men brought a dispute to the Messenger of Allah (peace and blessings be upon him) about the harim (protected surrounding area) of a date palm; he (peace and blessings be upon him) ordered it to be measured, and it came to seven cubits (in one narration, five cubits), so he (peace and blessings be upon him) judged accordingly. Its narrator Abd al-Aziz al-Darawardi said: He (peace and blessings be upon him) ordered it to be measured with one of the palm's branches. Abu Dawud (3640) and others narrated it, and its chain is strong.
ويشهد له أيضًا حديث ابن عمر عند ابن ماجه (2489)، وسنده ضعيف.
Corroborating chains and supporting reports: Another supporting report for it is narrated from Ibn Umar (may Allah be pleased with them both) in Ibn Majah (2489), but its chain is da'if (weak).
