Mustadrak al-Hakim — Hadith 7218

أخبرَناه أبو بكر بن إسحاق، أخبرنا زياد بن الخليل التُّستَري، حدثنا هارون بن سعيد الأيْلي، حدثنا خالد بن نِزار، عن عمر بن قيس، عن الزُّهري، عن سعيد بن المسيب، عن أبي هريرة، عن النبيِّ ﷺ، قال: "حَرِيمُ البئر العاديَّة خمسون ذراعًا، وحَرِيمُ البئر المُحْدَثة خمسةٌ وعشرون ذِراعًا" (2).
It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said: "The protected zone of an ancient well is fifty cubits, and the zone of a newly dug well is twenty-five cubits."

(2) إسناده ضعيف جدًّا، عمر بن قيس - وهو أبو حفص المكي المعروف بسندل - متروك الحديث، وجاء موصولًا مرفوعًا من طريق غيره، كما سيأتي في التخريج، ولا يصح منها شيء. وأخرجه الدارقطني في "السنن" (4519) من طريق الحسن بن أبي جعفر، عن معمر، عن الزهري، عن سعيد بن المسيب، عن أبي هريرة مرفوعًا. والحسن بن أبي جعفر ضعيف أو منكر الحديث.
Grading: Its chain is "da'if jiddan" (extremely weak).
Technical note / Defect ('illah): Umar bin Qays (Abu Hafs al-Makki, known as Sandal) is "matruk al-hadith" (abandoned). Although it is also narrated through other routes as "mawsul marfu'" (as will come in the takhrij), none of them is sahih. Imam al-Daraqutni narrated it in "al-Sunan" (4519) by way of al-Hasan bin Abi Ja'far, from Ma'mar, from al-Zuhri, from Sa'id bin al-Musayyab, from Abu Hurayrah (may Allah be pleased with him) as "marfu'", but al-Hasan bin Abi Ja'far is "da'if" or "munkar al-hadith".
وقد سلفت من طريق معمر الصحيحة في الحديث السابق.
Corroborating chains and supporting reports: This narration has already passed in the previous hadith through the sahih route of Ma'mar.
وأخرجه الدارقطني (4519) من طريق إبراهيم بن أبي عبلة، عن الزهري، عن سعيد، عن أبي هريرة مرفوعًا. وفي إسناده محمد بن يوسف المقرئ، وهو متهم بالوضع.
Technical note / Defect ('illah): Al-Daraqutni narrated it (4519) by way of Ibrahim bin Abi Ablah, from al-Zuhri, from Sa'id, from Abu Hurayrah as marfu', but its chain contains Muhammad bin Yusuf al-Muqri', who is accused of fabricating hadith.
قال الدارقطني: الصحيح من الحديث أنه مرسل عن ابن المسيب، ومن أسنده فقد وهم.
Important point: Imam al-Daraqutni says: What is correct in this hadith is that it is "mursal" from Ibn al-Musayyab, and whoever made it "musnad" (connected) was mistaken.
وقال البيهقي في "سننه" 6/ 155: روي من حديث معمر وإبراهيم بن أبي عبلة عن الزهري عن سعيد عن أبي هريرة مرفوعًا موصولًا، وهو ضعيف.
Grading: Imam al-Bayhaqi says in "al-Sunan" (6/155): This narration is reported through Ma'mar and Ibrahim bin Abi Ablah, from al-Zuhri, from Sa'id, from Abu Hurayrah as marfu' and mawsul, but it is weak.
ورواه سفيان بن حسين - كما في علل الدارقطني (1693) - عن الزهري، عن سعيد بن المسيب، عن ضمرة مرفوعًا. وسفيان بن حسين ضعيف في حديث الزهري، وقال الدارقطني: المرسل أشبه.
Technical note / Defect ('illah): Sufyan bin Husayn narrated it from al-Zuhri, from Sa'id bin al-Musayyab, from Damrah as marfu' (as in al-Daraqutni's al-Ilal: 1693), but Sufyan bin Husayn is weak in the narrations of al-Zuhri; Imam al-Daraqutni said that its being "mursal" is closer to the truth.
وفي الباب عن ابن عباس موقوفًا، ولفظه: حريم البئر خمسون ذراعًا، وحريم العين مئتا ذراع.
Corroborating chains and supporting reports: In this chapter there is a "mawquf" narration from Ibn Abbas (may Allah be pleased with them both) whose wording is: "The harim of a well is fifty cubits, and the harim of a spring is two hundred cubits."
أخرجه يحيى بن آدم في "الخراج" (335)، والبيهقي 6/ 257، وفي سنده إبراهيم بن أبي يحيى الأسلمي، متروك الحديث.
Technical note / Defect ('illah): Yahya bin Adam narrated it in "al-Kharaj" (335) and al-Bayhaqi (6/257), but its chain contains Ibrahim bin Abi Yahya al-Aslami, who is "matruk al-hadith".
وقد صحَّ من حديث أبي هريرة مرفوعًا عند أحمد 16 / (10411) وغيره: "حريم البئر أربعون ذراعًا من حواليها كلها لأعطان الإبل والغنم، وابن السبيل أول شارب … ".
Grading: This is established as "sahih" through the marfu' hadith of Abu Hurayrah (Musnad Ahmad 16/10411 and others): "The harim of a well is forty cubits all around it, for the resting places of camels and sheep, and the traveller is the first to drink".
