Mustadrak al-Hakim — Hadith 7213

أخبرني محمد بن علي (1) بن دُحَيم الشَّيباني، حدثنا أحمد بن حازم الغِفاري، حدثنا مالك بن إسماعيل النَّهْدي، حدثنا الأجلح، عن الشَّعبي، عن عبد الله بن الخليل، عن زيد بن أرقم: أنَّ عليًّا بعثه النبيُّ ﷺ إلى اليمن، فارتفع إليه ثلاثةٌ يتنازعون ولدًا، كلُّ واحد يَزعُمُ أنَّه ابنُه. قال: فخَلَا باثنين، فقال: أتَطيبانِ نَفْسًا لهذا الباقي بالولد؟ قالا: لا، وخَلَا باثنين، فقال لهما مثلَ ذلك، فقالا: لا، فقال: أُراكم شُركاءَ متشاكِسون (2) وأنا مُقرِعٌ بينكم، فأقرعَ بينهم فجعلَه لأحدِهم، وأغرَمَه ثُلُثَي الدِّيَة للباقين. قال: فذكر ذلك للنبي ﷺ، فضحك حتى بَدَتْ نَواجِذُه (3). قد أعرض الشيخان ﵄ عن الأجلح بن عبد الله الكِندي أصلًا، وليس في رواياته بالمتروك، فإنَّ الذي يُنقَم عليه به مذهبُه.

It is narrated from Sayyiduna Zayd bin Arqam (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) sent Sayyiduna Ali (may Allah be pleased with him) to Yemen. There, three men brought him a dispute concerning a child, each of them claiming that he was his son. The narrator says that Sayyiduna Ali (may Allah be pleased with him) called them two at a time, in turn, in private and asked: Will you willingly give up the child in favour of this third companion? They all refused. Then he said: "I see you as partners who are at odds with one another (shuraka' mutashakisun), so now I will cast lots between you." So he cast lots, and it fell to one of them; he gave the child to him and ordered him to pay the other two companions two-thirds of the blood money (diyah) (for the child). The narrator says that when this incident was mentioned to the Prophet (peace and blessings be upon him), he (peace and blessings be upon him) laughed so much that his (peace and blessings be upon him) blessed molars became visible.
The two Shaykhs turned away from al-Ajlah bin Abdullah al-Kindi altogether, although his narrations are not abandoned (matruk); the objection raised against him is on account of his particular views (madhhab).

(1) جاء اسمه مقلوبًا في النسخ الخطية إلى: علي بن محمد، والتصويب من الأسانيد الأخرى عند المصنف.
Important point: In the manuscripts this name has been transposed and written as "Ali bin Muhammad", whereas in light of the other chains with the author the correct name has been restored.

(2) كذا في نسخنا الخطية، والجادة أن تكون منصوبة نعت منصوب للمفعول الثاني "شركاء".
Note / Clarification: It is written thus in our manuscripts, whereas by the rules (of grammar) it should have been in the accusative case, being an adjective of the second object "shuraka'".

(3) إسناده ضعيف لاضطرابه، وقد سلف بيانه برقم (2865).
Grading: Its chain is weak because of "idtirab" (inconsistency), the details of which have already passed under number (2865).
