أخبرنا أبو عبد الله محمد بن يعقوب الحافظ، حدثنا يحيى بن محمد بن يحيى، حدثنا مُسدَّد، حدثنا عبد الوارث، عن عطاء بن السائب، عن أبي يحيى، عن ابن عباس: أنَّ رجلًا ادَّعى عند رجل حقًّا، فاختَصَما إلى نبي الله ﷺ، فسأله البيِّنةَ، فقال: ما عندي بيِّنةٌ، فقال للآخر: "احلِفْ"، فحَلَفَ فقال: والله ما له عندي شيء، فقال رسولُ الله ﷺ: "بَلَى، هو عندَك، ادفع إليه حقَّه" ثم قال له رسول الله ﷺ: "شهادتُك بأنْ لا إله إلَّا اللهُ كفّارةٌ ليمينِك" (1). هذا حديث صحيح الإسناد، ولم يُخرجاه. It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that a man claimed a right against another, so the two of them brought their case to the Prophet (peace and blessings be upon him). He (peace and blessings be upon him) asked the claimant for witnesses, and he said: I have no witness. He (peace and blessings be upon him) said to the other man: "Take an oath." He took the oath, saying: By Allah! He has nothing owed to him by me. Then the Messenger of Allah (peace and blessings be upon him) said: "No (it is not so); rather, his right is indeed owed by you, so give him his right." Then the Messenger of Allah (peace and blessings be upon him) said to him (the one who swore): "Your testimony that there is no true deity except Allah is an expiation for your (false) oath (that is, by the blessing of your Islam Allah has settled the matter)."
This hadith is sahih al-isnad (authentic in its chain), but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) ضعيف لاضطراب عطاء بن السائب في متنه وسنده، وتفرّده به، وقد عدَّ الإمام الذهبي هذا الحديث في "ميزان الاعتدال" 3/ 72 من مناكيره. Grading: This narration is weak, because there is "idtirab" (inconsistency) in both its text and its chain due to Ata' bin al-Sa'ib, and he is alone in transmitting it. Technical note / Defect ('illah): Imam al-Dhahabi counted this hadith among Ata''s munkar (unacceptable) narrations in "Mizan al-I'tidal" (3/72). أبو يحيى: اسمه زياد المكي الأعرج مولى قيس بن مخرمة. Important point: The actual name of Abu Yahya is "Ziyad al-Makki al-A'raj", the freed slave of Qays bin Makhramah. وأخرجه أحمد 4 / (2280)، وأبو داود (3275) من طريق حماد بن سلمة، عن عطاء بن السائب، بهذا الإسناد. ولفظه: أنَّ رجلين اختصما إلى النبي ﷺ فسأل النبي ﷺ المدَّعِي البينةَ، فلم تكن له بيّنة، فاستحلف المطلوب، فحلف بالله الذي لا إله إلّا هو، فقال رسول الله ﷺ: "إنك قد فعلتَ، ولكن غُفر لك بإخلاصك قول: لا إله إلّا الله". Reference / Source: Imam Ahmad (4/2280) and Abu Dawud (3275) narrated it via Hammad bin Salamah from Ata' bin al-Sa'ib with this same chain. Details of the narration: Its wording is: Two men brought a dispute to the Prophet (peace and blessings be upon him). He (peace and blessings be upon him) asked the claimant for witnesses; as he had no witnesses, he took an oath from the defendant, who swore by Allah, besides whom there is no god. Then the Messenger of Allah (peace and blessings be upon him) said: "You did do it (usurping the right), but you have been forgiven because of your saying 'La ilaha illa Allah' with sincerity." وأخرجه أحمد (2695) و (2956) من طريق شريك النخعي، عن عطاء، به. بلفظ: اختصم إلى النبي ﷺ رجلان، فوقعت اليمين على أحدهما، فحلف بالله الذي لا إله إلّا هو ما له عنده شيء، قال: فنزل جبريل على النبي ﷺ فقال: إنه كاذب، إنَّ له عنده حقّه، فأمره أن يعطيه حقه، وكفارة يمينه، وكفارة يمينه معرفته أن لا إله إلّا الله، أو شهادته. Reference / Source: Imam Ahmad narrated it (at 2695 and 2956) via Sharik al-Nakha'i from Ata'. Details of the narration: With these words: Two men came to the Prophet (peace and blessings be upon him); the oath fell upon one of them, and he swore by Allah that he owed nothing. The narrator says: Jibril (peace be upon him) descended and told him that this man was lying and that he did owe the right. He (peace and blessings be upon him) ordered him to pay the right, and said that the expiation of his false oath was his knowledge of, or testimony (affirmation) to, 'La ilaha illa Allah'. وأخرجه النسائي (5963) من طريق سفيان الثوري، عن عطاء. به. وفيه: فقال للآخر: "احلِفْ" فحلف: اللهِ الذي لا إله إلّا هو، فقال النبي ﷺ: "ادفع حقَّه وستكفِّرُ عنك لا إله إلّا الله ما صنعتَ". Reference / Source: Imam al-Nasa'i (5963) narrated it via Sufyan al-Thawri from Ata'. Details of the narration: In it: He (peace and blessings be upon him) said to the other: "Swear," and he swore by Allah. Then he (peace and blessings be upon him) said: "Pay him his right, and 'La ilaha illa Allah' will expiate for you what you did." وأخرجه أبو داود (3620) مختصرًا، والنسائي (5964) تامًّا من طريق أبي الأحوص سلّام بن سليم، عن عطاء، به. وفيه: فقال النبي ﷺ للمدعي: "أقم بينتك"، فقال: يا رسول الله، ليس لي بينة، فقال للآخر: "احِلفْ بالله الذي لا إله إلّا هو ما له عليك - أو عندك - شيء"، فحلف. وهذا اللفظ لا إشكال فيه. وأخرجه أحمد (26/ 16101)، والنسائي (5962) من طريق شعبة، عن عطاء بن السائب، عن أبي البختري، عن عبيدة، عن عبد الله بن الزبير، عن النبي ﷺ: "أن رجلًا حلف بالله الذي لا إله إلّا هو كاذبًا، فغفر له". قال شعبة: من قِبَل التوحيد. فجعله من حديث ابن الزبير! Reference / Source: Abu Dawud (3620) narrated it in brief, and al-Nasa'i (5964) in full, via Abu al-Ahwas Sallam bin Sulaym from Ata'. Details of the narration: There is no scholarly difficulty in its wording. Furthermore, Imam Ahmad (26/16101) and al-Nasa'i (5962) narrated via Shu'bah from Ata' bin al-Sa'ib, from Abu al-Bakhtari, from Ubaydah, from Abd Allah bin al-Zubayr (may Allah be pleased with him), that the Prophet (peace and blessings be upon him) said: "A man swore falsely by Allah (and he was a believer in tawhid), and he was forgiven." Technical note / Defect ('illah): Shu'bah attributed the reason for it to "tawhid", and he made this narration directly a hadith of Ibn al-Zubayr (may Allah be pleased with him)! وانظر حديث ابن عمر في "مسند أحمد" 9/ (5361).
