حدثنا أبو نصر أحمد بن سهل الفقيه ببخاري، حدثنا صالح بن محمد بن حبيب الحافظ، حدثنا محمد بن أبي بكر وأحمد بن المِقدام، قالا: حدثنا الفُضيل بن سليمان، حدثنا أسامة بن زيد، حدثني عُبيد الله بن أبي رافع مولى أمِّ سَلَمة، قال: سمعتُ أمَّ سَلَمةَ تقول: كنتُ عند النبيِّ ﷺ فجاءه رجلانِ يختصمانِ في ميراثٍ بينهما، وليس لواحدٍ منهما بينِّةٌ، وقال كلُّ واحدٍ منهما لصاحبه: يا رسول الله، حَقِّي هذا الذي طلبتُه لفلان، قال: "لا، ولكن اذهبا فتَوخَّيا ثم استَهِما، ثم اقسِما، ثمَّ لْيُحلِلْ كلُّ واحدٍ منكما صاحبَه" (4). هذا حديث صحيح على شرط مسلم، ولم يُخرجاه. It is narrated from the Mother of the Believers, Sayyidah Umm Salamah (may Allah be pleased with her), that I was with the Prophet (peace and blessings be upon him) when two men came disputing over a matter of inheritance, and neither of them had a witness. Each of them said about his companion: O Messenger of Allah! This right of mine which I claimed belongs to so-and-so. He (peace and blessings be upon him) said: "No; rather, go, both of you, and seek what is right (in the division), then draw lots, then divide it, and let each of you forgive his companion."
This hadith is sahih (authentic) on the condition of Imam Muslim, but the two Shaykhs did not record it.

(4) إسناده ضعيف، الفضيل بن سليمان - وهو النميري - ليِّن، وقد خالف جميعَ من رواه عن أسامة بن زيد، حيث سمَّى مولى أم سلمة عُبيدَ الله بن أبي رافع، والصوابُ رواية الجمهور عن أسامة بن زيد أنَّ اسمه عَبد الله بن رافع، كما تقدَّم في تخريج الحديث السابق. Grading: Its chain is weak. Technical note / Defect ('illah): Fudayl bin Sulayman (al-Numayri) is "layyin" (soft, of weak memory), and he differed from all the other narrators who narrated it from Usamah bin Zayd. He gave the name of Umm Salamah's mawla as "Ubayd Allah bin Abi Rafi'", whereas the correct view is what the majority reported from Usamah bin Zayd, that his name is "Abd Allah bin Rafi'", as passed in the previous hadith.
