أخبرنا الحسن بن حَلِيم (1) المروزي، حدثنا أبو المُوجِّه، أخبرنا عَبْدان، أخبرنا عبد الله، أخبرني أسامة بن زيد [عن] (2) مولى أمِّ سَلَمة، عن أمِّ سَلَمة قالت: أتى رجلان النبيِّ ﷺ يَتَدارآنِ في مواريثَ بينهما، ليس لهما بيّنةٌ، فأمرهما النبيُّ ﷺ أن يقتسما ويتوخَّيا، ثم يَستَهما، ولْيُحلِلْ كلُّ واحدٍ منهما صاحبَه (3). صحيح الإسناد، ولم يُخرجاه. ومولى أمٍّ سَلمة: هو عُبيد الله بن أبي رافع المخرَّج في "الصحيحين". It is narrated from the Mother of the Believers, Sayyidah Umm Salamah (may Allah be pleased with her), that two men came to the Prophet (peace and blessings be upon him) who were arguing with one another over a matter of inheritance, and they had no witnesses. The Prophet (peace and blessings be upon him) ordered them to act fairly (in the division), seek what is right, then draw lots, and each of them should forgive the other.
This hadith is sahih al-isnad (authentic in its chain), but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) تحرَّف في نسخنا الخطية إلى: حكيم. Technical note / Defect ('illah): In the manuscripts we have, this name has been distorted (by error) into "Hakim".
(2) سقط من نسخنا الخطية، واستدرك من مصادر التخريج. Note / Clarification: This part was missing from our manuscripts and has been completed with the help of the other referencing books.
(3) إسناده حسن من أجل أسامة بن زيد: وهو الليثي، ومولى أم سلمة: هو عبد الله بن رافع، جاء مسمّى في مصادر التخريج، وليس هو عُبيدَ الله بن أبي رافع كما ذهب إليه المصنِّف بناءً على ما أورده في الرواية التالية. Grading: Its chain is "hasan" because of Usamah bin Zayd (al-Laythi). Important point: The mawla (freed slave) of Umm Salamah is "Abd Allah bin Rafi'", as his name is clearly mentioned in the other referencing sources. The author's taking him to be "Ubayd Allah bin Abi Rafi'" is not correct; he inferred it on the basis of the next narration. أبو الموجِّه: هو محمد بن عمرو الفزاري، وعبدان: هو عبد الله بن عثمان بن جَبَلة، وعبد الله: هو ابن المبارك. Important point: In the chain, Abu al-Muwajjih is "Muhammad bin Amr al-Fazari", Abdan is "Abd Allah bin Uthman bin Jabalah", and Abd Allah is "Ibn al-Mubarak". وأخرجه بنحوه أبو داود (3584) عن الربيع بن نافع، عن ابن المبارك، بهذا الإسناد. Reference / Source: Abu Dawud (3584) narrated it via al-Rabi' bin Nafi' from Ibn al-Mubarak with this same chain. وأخرجه أحمد 44 / (26717) عن وكيع، وأبو داود (3585) من طريق عيسى بن يونس، كلاهما عن أسامة بن زيد، به. Reference / Source: Imam Ahmad (44/26717) narrated it from Waki', and Abu Dawud (3585) via Isa bin Yunus; both of them narrate from Usamah bin Zayd.
