Mustadrak al-Hakim — Hadith 7207

أخبرنا الحسن بن يعقوب العدل، حدثنا يحيى بن أبي طالب، حدثنا عبد الوهاب بن عطاء، أخبرنا سعيد بن أبي عَروبة، عن قَتَادة، عن سعيد بن أبي بُرْدة، عن أبيه، عن جَدِّه أبي موسى: أنَّ رجلينِ ادَّعَيا بعيرًا أو دابَّةً إلى النبي ﷺ، وليس لواحدٍ منهما بيِّنةٌ، فجعله النبيُّ ﷺ بينَهما (1).
هذا حديث صحيح على شرط الشيخين، ولم يخرجاه. وقد خالف همَّامُ بن يحيى بن سعيدَ بن أبي عَروبة في متن هذا الحديث:

It is narrated from Sayyiduna Abu Musa al-Ash'ari (may Allah be pleased with him) that two men laid claim before the Prophet (peace and blessings be upon him) to a camel or an animal, and neither of them had any witness, so the Prophet (peace and blessings be upon him) divided that animal between the two of them (half and half).
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

(1) حديث مُعَلٌّ عند أهل الحديث مع الاختلاف في إسناده على قتادة، كما أن أبا بردة لم يسمعه من أبيه أبي موسى كما بيَّناه في تعليقنا على "مسند أحمد".
Grading: According to the hadith scholars this hadith is "mu'all" (outwardly sound but with a hidden defect), because there is variation in its chain on the authority of Qatadah.
Technical note / Defect ('illah): Moreover, Abu Burdah's hearing (of it) from his father Abu Musa al-Ash'ari (may Allah be pleased with him) is not established, as we have explained in the notes on "Musnad Ahmad".
وأخرجه أحمد 32 / (19603)، وأبو داود (3613) و (3614)، وابن ماجه (2330)، والنسائي (5955) من طريق عن سعيد بن أبي عروبة، بهذا الإسناد.
Reference / Source: Imam Ahmad (32/19603), Abu Dawud (3613, 3614), Ibn Majah (2330) and al-Nasa'i (5955) narrated it via Sa'id bin Abi Arubah with this same chain.
وأخرجه النسائي (5954) من طريق محمد بن كثير، عن حماد بن سلمة، عن قتادة، عن النَّضر بن أنس، عن أبي بردة، عن أبي موسى، بنحو رواية همام التالية عند المصنف. قال النسائي عقبه: خطأ ومحمد بن كثير هذا هو المصيصي، وهو صدوق إلّا أنه كثير الخطأ. قلنا: محمد بن كتير متابع، لما بيناه في تعليقنا على "المسند". وانظر ما بعده.
Reference / Source: Imam al-Nasa'i (5954) narrated it via Muhammad bin Kathir, from Hammad bin Salamah, from Qatadah, from al-Nadr bin Anas, from Abu Burdah, from Abu Musa (similar to Hammam's narration that follows with the author).
Technical note / Defect ('illah): Imam al-Nasa'i declared it a "mistake" after this narration, because Muhammad bin Kathir (al-Massisi), although truthful (saduq), makes many mistakes.
Important point: However, according to our research Muhammad bin Kathir has been corroborated, the details of which we have given in the notes on "Musnad Ahmad".
