Mustadrak al-Hakim — Hadith 7206

أخبرنا أبو بكر بن إسحاق، أخبرنا عبد الله بن أحمد بن حنبل، حدثنا محمد بن عبد الله بن نُمير، حدثنا أبو معاوية، عن الأعمش، عن القاسم، عن أبيه، عن عبد الله قال: من عَرَضَ له قضاءٌ فليقضِ بما في كتاب الله، فإن جاءه أمرٌ ليس في كتاب الله فليقضِ بما قضى به نبيُّه، فإن جاءه أمرٌ ليس في كتاب الله ﷿ ولم يقضِ به نبيُّه ﷺ، فليقضِ بما قاله الصالحون، فإن جاءه أمرٌ ليس في كتاب الله ولم يقض به نبيُّه ﷺ ولم يقضِ به الصالحون فليَجتهِدْ رأيَه، فإن لم يُحسِنُ، فليُقِرَّ ولا، يستحيي (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه. والقاسم: هو ابن عبد الرحمن بن عبد الله بن مسعود.

It is narrated from Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) that whoever is faced with a judgement should judge according to the Book of Allah. If a matter comes to him that is not in the Book of Allah, he should judge according to what His Prophet (peace and blessings be upon him) judged. If a matter comes to him that is neither in the Book of Allah nor judged by His Prophet (peace and blessings be upon him), he should judge according to what the righteous have said. And if a matter comes to him that is neither in the Book of Allah, nor judged by the Prophet (peace and blessings be upon him), nor by the righteous, he should exercise ijtihad with his own opinion. And if he cannot understand the right answer, he should admit it (rather than judge) and not be ashamed.
This hadith is sahih al-isnad (authentic in its chain), but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) رجاله ثقات القاسم: هو ابن عبد الرحمن بن عبد الله بن مسعود، وأبوه عبد الرحمن قد اختلف في سماعه من أبيه عبد الله بن مسعود.
Grading: All its narrators are thiqah (trustworthy).
Technical note / Defect ('illah): Al-Qasim is "Ibn Abd al-Rahman bin Abd Allah bin Mas'ud". The hadith scholars differ as to whether his father Abd al-Rahman heard (directly) from his father Abd Allah bin Mas'ud (may Allah be pleased with him).
كما اختلف فيه على الأعمش كما سيأتي في التخريج.
Technical note / Defect ('illah): Likewise, there is variation in the chain of this narration on the authority of Imam al-A'mash, as will become clear in the referencing details below.
وأخرجه ابن أبي شيبة 7/ 242 عن يحيى بن أبي زائدة، والدارمي (173) من طريق جرير بن عبد الحميد، وابن عبد البر في "جامع بيان العلم" (1599) من طريق أبي معاوية محمد بن خازم، ثلاثتهم عن الأعمش، بهذا الإسناد.
Reference / Source: Ibn Abi Shaybah (7/242) narrated it from Yahya bin Abi Za'idah, al-Darimi (173) via Jarir bin Abd al-Hamid, and Ibn Abd al-Barr in "Jami' Bayan al-'Ilm" (1599) via Abu Mu'awiyah Muhammad bin Khazim; all three (Yahya, Jarir and Abu Mu'awiyah) narrate from Imam al-A'mash with this same chain.
وأخرج نحوه مختصرًا عبد الرزاق (15295)، والطبراني 9 / (8921)، والخطيب في "الفقيه والمتفقه" (538) من طريق عبد الرحمن المسعودي، عن القاسم بن عبد الرحمن، عن ابن مسعود. ليس فيه عبد الرحمن بن عبد الله بن مسعود.
Reference / Source: A brief narration of similar meaning was reported by Abd al-Razzaq (15295), al-Tabarani (9/8921) and al-Khatib al-Baghdadi in "al-Faqih wa al-Mutafaqqih" (538) via Abd al-Rahman al-Mas'udi, from al-Qasim bin Abd al-Rahman, directly from Ibn Mas'ud (may Allah be pleased with him).
Technical note / Defect ('illah): In this chain "Abd al-Rahman bin Abd Allah bin Mas'ud" (al-Qasim's father) is not mentioned between al-Qasim and Ibn Mas'ud.
وأخرجه بنحوه ابن أبي شيبة 4/ 544، والنسائي في "المجتبى" (5397) من طريق أبي معاوية، وابن أبي شيبة 7/ 241 عن يحيى بن أبي زائدة، والدارمي (172) من طريق أبي عوانة، والطبراني في "الكبير" 9/ (8920)، والبيهقي 10/ 115 من طريق سفيان الثَّوري، وابن عبد البر (1597) من طريق عبد الواحد بن زياد، خمستهم عن الأعمش، عن عمارة بن عمير، عن عبد الرحمن بن يزيد النخعي، عن ابن مسعود وقال النسائي عقبه: هذا الحديث جيد جيد.
Reference / Source: A narration of similar meaning was reported by Ibn Abi Shaybah (4/544) and al-Nasa'i in "al-Mujtaba" (5397) via Abu Mu'awiyah, Ibn Abi Shaybah (7/241) from Yahya bin Abi Za'idah, al-Darimi (172) via Abu Awanah, al-Tabarani in "al-Kabir" (9/8920) and al-Bayhaqi (10/115) via Sufyan al-Thawri, and Ibn Abd al-Barr (1597) via Abd al-Wahid bin Ziyad. All five narrate from Imam al-A'mash, from Umarah bin Umayr, from Abd al-Rahman bin Yazid al-Nakha'i, from Ibn Mas'ud (may Allah be pleased with him).
Grading: Imam al-Nasa'i said after this narration: "This hadith is very good (jayyid jayyid)."
ووقع في رواية الطبراني والبيهقي: وربما قال: عن حريث بن ظهير، يعني بدل عبد الرحمن بن يزيد النخعي، قلنا: وهذه الطريق أخرجها الدارمي (167)، والنسائي (5398) من طريق سفيان الثوري، والدارمي (171)، والبيهقي 10/ 115 من طريق شعبة، كلاهما عن الأعمش، عن عمارة بن عمير، عن حرث بن ظهير، عن ابن مسعود. وحريث بن ظهير تفرَّد بالرواية عنه عمارة، ووصفه بالجهالة الذهبي وابن حجر.
Technical note / Defect ('illah): In the narration of al-Tabarani and al-Bayhaqi it is mentioned that (al-A'mash) sometimes named "Hurayth bin Zuhayr" in place of Abd al-Rahman bin Yazid al-Nakha'i.
Reference / Source: This route was narrated by al-Darimi (167) and al-Nasa'i (5398) via Sufyan al-Thawri, and by al-Darimi (171) and al-Bayhaqi (10/115) via Shu'bah; both of them narrate from Imam al-A'mash, from Umarah bin Umayr, from Hurayth bin Zuhayr, from Ibn Mas'ud.
Technical note / Defect ('illah): Umarah (bin Umayr) is alone in narrating from Hurayth bin Zuhayr, and Imam al-Dhahabi and Ibn Hajar declared him "majhul" (an unknown narrator).
