أخبرني الحسن بن حَليم (3) المروزي، أخبرنا أبو الموجِّه، أخبرنا عَبْدانُ، أخبرني مصعب بن ثابت بن عبد الله بن الزُّبير، عن أبيه: أنَّ أباه عبد الله بن الزُّبير كانت بينه وبين أخيه عمرو بن الزُّبير خُصومةٌ، فدخل عبدُ الله بن الزُّبير على سعيد بن العاص وعمرُو بن الزُّبير معه على السرير، فقال سعيدٌ لعبد الله: هاهنا قال: لا، قضاءُ رسولِ الله وسنةُ رسول الله ﷺ: أَنَّ الخصمين يَقعدانِ بين يَدَي الحاكم (4).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyiduna Abdullah bin al-Zubayr (may Allah be pleased with him) that there was a dispute between him and his brother Amr bin al-Zubayr. Abdullah bin al-Zubayr went in to Sa'id bin al-As while Amr bin al-Zubayr was sitting with him on the couch. Sa'id said to Abdullah: Come here (onto the couch). He said: No; rather, the judgement of the Messenger of Allah (peace and blessings be upon him) and his (peace and blessings be upon him) Sunnah is that both litigants sit (equally) before the judge.
This hadith is sahih al-isnad (authentic in its chain), but the two Shaykhs (Bukhari and Muslim) did not record it.

(3) تحرَّف في نسخنا الخطية إلى: حكيم، وقد تكررت رواية المصنِّف عنه كثيرًا.
Technical note / Defect ('illah): In our manuscripts this has mistakenly become "Hakim", whereas the author has cited a great many narrations from him (Ali bin al-Hakam).
(4) إسناده ضعيف لضعف مصعب بن ثابت. أبو الموجِّه: هو محمد بن عمرو الفزاري، وعبدان هو عبد الله بن عثمان بن جبلة.
Grading: Its chain is weak because of the weakness of Mus'ab bin Thabit.
Important point: Abu al-Muwajjih is "Muhammad bin Amr al-Fazari", and Abdan is "Abd Allah bin Uthman bin Jabalah".
وأخرجه أحمد 26/ (16104)، وأبو داود (3588) من طريق عبد الله بن المبارك، عن مصعب بن ثابت، عن عبد الله بن الزبير، بإسقاط ثابت.
Reference / Source: Imam Ahmad (26/16104) and Abu Dawud (3588) narrated it via Abd Allah bin al-Mubarak from Mus'ab bin Thabit, directly from Abd Allah bin al-Zubayr (may Allah be pleased with him), without mentioning "Thabit" (in the chain).
