Mustadrak al-Hakim — Hadith 7201

أخبرني أبو عَوْن محمد بن أحمد بن ماهان البزَّار (4) بمكة حرسها الله تعالى على الصَّفا، حدثنا محمد بن علي بن زيد، حدثنا سعيد بن منصور، حدثنا شَريك، عن سِماك بن حرب، عن حَنَش، عن علي قال: بَعَثَني رسول الله ﷺ إلى اليمن، فقلتُ: تَبعَثُني إلى قوم ذَوِي أسنانٍ وأنا حَدَثُ السِّنِّ؟! قال: "إذا جلس إليك الخَصْمَانِ، فلا تقضِ لأحدِهما حتى تسمعَ من الآخر كما سمعتَ من الأول". قال عليٌّ: فما زلتُ قاضيًا (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyiduna Ali (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) sent me to Yemen. I said: You are sending me to people who are elders (experienced), while I am still young?! He (peace and blessings be upon him) said: "When two litigants sit before you, do not judge in favour of one of them until you have heard from the other as you heard from the first." Sayyiduna Ali (may Allah be pleased with him) said: After that I always remained (a successful) judge.
This hadith is sahih al-isnad (authentic in its chain), but the two Shaykhs (Bukhari and Muslim) did not record it.

(4) كذا وقع في نسخنا الخطية، وهو تحريف فيما نرى، وقد تكرر عند المصنف في عدة مواضع، ونسب فيها: الجزار، وانظر التعليق على سند الحديث (2219).
Technical note / Defect ('illah): It occurs thus in our manuscripts, which in our view is a distortion. The name is repeated in several places with the author, and there he is attributed as "al-Jazzar"; see our comment on the chain of hadith (2219).

(1) حسن لغيره، شريك - هو ابن عبد الله النخعي - وحنش - وهو ابن المعتمر - وإن كانا فيهما ضعف متابعان.
Grading: This hadith is "hasan li-ghayrihi"; although Sharik (bin Abd Allah al-Nakha'i) and Hanash (bin al-Mu'tamir) both have weakness, they have been corroborated.
وأخرجه أبو داود (3582) عن عمرو بن عون، والنسائي (8366) من طريق أحمد بن سليمان كلاهما عن شريك بن عبد الله، بهذا الإسناد وفيه زيادة، وهذه الزيادة سلفت مفردة عند المصنف برقم (4709)، وانظر ما سلف أيضًا برقم (7179).
Reference / Source: Abu Dawud (3582) narrated it from Amr bin Awn, and al-Nasa'i (8366) via Ahmad bin Sulayman; both narrate from Sharik bin Abd Allah with this same chain, which contains an addition.
Details of the narration: This addition has already passed on its own with the author under hadith number (4709); see also (7179).
وأخرجه أحمد 2 / (690) من طريق زائدة، عن سماك، به.
Reference / Source: Imam Ahmad (2/690) narrated it via Za'idah from Simak (bin Harb).
وأخرجه بنحوه مطولًا ابن حبان (5065) من طريق أسباط بن نصر، عن سماك، عن عكرمة، عن ابن عباس، عن علي، به.
Reference / Source: Imam Ibn Hibban (5065) narrated something similar at length via Asbat bin Nasr from Simak, from Ikrimah, from Ibn Abbas, from Ali (may Allah be pleased with him).
وأخرجه وكيع في "أخبار القضاة" 1/ 87 من طريق أبي جحيفة السوائي، عن علي، به. وفيه الزيادة المذكورة.
Reference / Source: Waki' narrated it in "Akhbar al-Qudat" (1/87) via Abu Juhayfah al-Suwa'i (Wahb bin Abd Allah) from Ali (may Allah be pleased with him), and it contains the above-mentioned addition.
