Mustadrak al-Hakim — Hadith 7189

أخبرَناه محمد بن عليّ بن دُحَيم الشَّيباني بالكوفة، حدثنا أحمد بن حازم الغِفَاري، حدثنا أبو غسّان وعلي بن حَكيم، حدثنا شَريك، عن الأعمش، عن سَعْد (1) بن عُبيدة، عن ابن بُرَيدة، عن أبيه قال: قال رسول الله ﷺ: "قاضيانِ في النَّار، وقاضٍ في الجنَّة: قاضٍ قَضَى بالحقِّ فهو في الجنَّة، وقاضٍ قَضَى بِجَوْرٍ فهو في النَّار، وقاضٍ قَضَى بجهلِه فهو في النَّار"، قالوا: فما ذنبُ هذا الذي يَجهلُ؟ قال: "ذَنْبُه أن لا يكون قاضيًا حتى يَعلَم" (2).

Sayyiduna Ibn Buraydah narrates from his father that the Messenger of Allah (peace and blessings be upon him) said: "Two judges will be in the Fire and one judge in Paradise: the judge who judged according to the truth is in Paradise; the judge who judged with injustice is in the Fire; and the judge who judged in his ignorance is in the Fire." The Companions said: What is the sin of this one who is ignorant (since he acted out of ignorance)? He (peace and blessings be upon him) said: "His sin is that he sat in the office of judge before he had attained knowledge."
It has a supporting report (shahid) with an authentic chain on the condition of Imam Muslim.

(1) تحرَّف في النسخ الخطية إلى: سعيد.
Technical note / Defect ('illah): In the manuscripts this name has been distorted and written as 'Sa'id' (whereas the correct name is something else).

(2) حديث صحيح بطرقه وشواهده، وهذا إسناد حسن من أجل شريك - وهو ابن عبد الله النخعي - وهو متابع أبو غسان: هو مالك بن إسماعيل النَّهدي.
Grading: This hadith is 'sahih' on the basis of its supporting reports, while its present chain is 'hasan' because of Sharik bin Abd Allah al-Nakha'i.
Technical note / Defect ('illah): Sharik has been corroborated here. 'Abu Ghassan' is Malik bin Isma'il al-Nahdi.
وأخرجه الترمذي (1322) من طريق الحسن بن بشر، عن شريك، بهذا الإسناد.
Reference / Source: Imam al-Tirmidhi (1322) narrated it via al-Hasan bin Bishr from Sharik with this same chain.
