Mustadrak al-Hakim — Hadith 6964

حدثنا بصحة ما ذكرتُه أبو العباس محمد بن يعقوب، حدثنا محمد بن إسحاق الصَّغَاني، حدثنا وهب بن جرير بن حازم، حدثنا أبي، قال: سمعت أبا فَزَارة يُحدِّث عن يزيد بن الأصم، عن ميمونة: أن رسول الله ﷺ تزوجها حلالًا، وبَنَى بها حلالًا بنى بها بسَرِفَ. وماتت بسَرِفَ في الليلة التي بَنَى بها فيها، وكانت خالتي، فنزلتُ في قبرها أنا وابن عبّاس، فلما وضعناها في اللحد مال رأسها، فأخذتُ رِدائي فجمعته فوضعته عند رأسها، فأخذه ابن عباس فرمى به، ووضع عند رأسها كَذَّانَةٌ، قال: وكانت حَلَقَت في الحج، وكان رأسُها مُجمَّمًا، وبين سَرِفَ ومكةَ اثنا عشر ميلًا (1).
هذا حديث صحيح على شرط مسلم ولم يخرجاه. وقد نَطَقَ هذا الإسناد الصحيح بأن رسول الله ﷺ تزوجها حلالًا، فأما أخبار عكرمة عن ابن عبّاس فإنها ناطقةٌ أنه ﷺ تزوجها وهو مُحرِمٌ.
Yazid bin al-Asamm narrates from Sayyidah Maymunah (may Allah be pleased with her) that the Messenger of Allah (peace and blessings be upon him) married her when he (peace and blessings be upon him) was not in the state of ihram, and when the marriage was consummated at Sarif he (peace and blessings be upon him) was also not in ihram. She also died at Sarif, on the same night on which, years earlier, he (peace and blessings be upon him) had spent his first night with her. Maymunah (may Allah be pleased with her) was my maternal aunt. Ibn Abbas (may Allah be pleased with them both) and I went down into her grave. When we placed her in the niche (lahd), her head tilted to one side. I folded my cloak and wanted to place it under her head, but Ibn Abbas (may Allah be pleased with them both) took it and threw it away, and placed a stone (kaddhanah) under her head, and said: She had shaved her head during Hajj, so the hair on her head was short. The distance between Sarif and Makkah is twelve miles.
This hadith is sahih (authentic) on the condition of Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it. This sahih chain testifies that the Messenger of Allah (peace and blessings be upon him) married her when he was not in ihram; as for the reports of Ikrimah from Ibn Abbas, they state that he (peace and blessings be upon him) married her while in the state of ihram.

Grading: Its chain is "sahih".
Important point: Abu Fazarah is Rashid bin Kaysan al-'Absi.
وأخرجه أحمد 44/ (26828)، والترمذي (845)، وابن حبان (4134) من طرق عن وهب بن جرير، بهذا الإسناد وقال الترمذي غريب، وروى غير واحد هذا الحديث عن يزيد بن الأصم مرسلًا: أن رسول الله ﷺ تزوج ميمونة وهو حلال.
Reference / Source: Ahmad (44/ 26828), al-Tirmidhi (845) and Ibn Hibban (4134) narrated it through various routes from Wahb bin Jarir with this same chain. Al-Tirmidhi said: It is "gharib".
Technical note / Defect ('illah): More than one narrator reported it from Yazid bin al-Asamm as "mursal": that the Messenger of Allah (peace and blessings be upon him) married Maymunah while he was "halal" (not in ihram).
وأخرجه مسلم (1411)، وابن ماجه (1964)، وابن حبان (4136) من طريق يحيى بن آدم عن جرير بن حازم به مختصرًا.
Reference / Source: Muslim (1411), Ibn Majah (1964) and Ibn Hibban (4136) narrated it in brief by way of Yahya bin Adam from Jarir bin Hazim.
وأخرجه أحمد 44 / (26815) و (26841)، وأبو داود (1843)، وابن حبان (4137) و (4138) من طريق حماد بن سلمة، والنسائي (5383) من طريق الوليد بن زوران، كلاهما عن ميمون بن مهران، عن يزيد بن الأصم، به.
Reference / Source: Ahmad (44/ 26815, 26841), Abu Dawud (1843) and Ibn Hibban (4137, 4138) narrated it by way of Hammad bin Salamah, and al-Nasa'i (5383) by way of al-Walid bin Zawran; both of them (Hammad and al-Walid) narrate it from Maymun bin Mihran, from Yazid bin al-Asamm.
وخالفهما سفيان بن حبيب، فرواه مرسلًا عند النسائي (3219) عن حبيب بن الشهيد، عن ميمون بن مهران، عن يزيد بن الأصم: أنَّ رسول الله ﷺ تزوج ميمونة وهو مُحلٌّ.
Technical note / Defect ('illah): Sufyan bin Habib contradicted the two of them (in al-Nasa'i: 3219). He narrated it as "mursal" from Habib bin al-Shahid, from Maymun bin Mihran, from Yazid bin al-Asamm: that the Messenger of Allah (peace and blessings be upon him) married Maymunah while he was "muhill" (out of ihram).
وأخرجه كذلك مرسلًا النسائي (5384) من طريق شعبة عن الحكم، عن يزيد بن الأصم، قال: ما تزوج رسول الله ﷺ ميمونة وهو محرم. وهي خالة يزيد.
Reference / Source: Al-Nasa'i (5384) also narrated it as "mursal" by way of Shu'bah, from al-Hakam, from Yazid bin al-Asamm, who said: "The Messenger of Allah (peace and blessings be upon him) did not marry Maymunah while he was in ihram." (Note that) Maymunah was Yazid's maternal aunt.
وسيأتي مرسلًا أيضًا عند المصنف بعد حديث من طريق الزهري عن يزيد بن الأصم.
Note / Clarification: It will also come as "mursal" with the author (al-Hakim), one hadith later, by way of al-Zuhri from Yazid bin al-Asamm.
قوله: "كَذَّانة": هو الحجر الرّخو.
Note / Clarification: The word "kadhdhanah" means "soft stone".
