Mustadrak al-Hakim — Hadith 6853

حَدَّثَنَا أبو بكر أحمد بن سلمان الفقيه ببغداد، حَدَّثَنَا الحسن بن مُكرَم، حَدَّثَنَا يحيى بن حمَّاد، حَدَّثَنَا حماد بن سَلَمة، عن أبي قَزَعة، عن حَكيم بن معاوية بن حَيْدة، عن أبيه: أنه قال لأخيه مالك بن حَيْدة: انطلِقْ بنا إلى رسولِ الله ﷺ فإنه يعرفُك ولا يعرفُني، فقد حبَسَ ناسًا من جِيراني، فأتَيَاه وقال مالك بن حَيْدة: يا رسولَ الله، إني قد أسلمتُ، وأسلمَ جيراني، فخلِّ عنهم، فلم يُجِبْه، ثم أعاد فلم يُجِبْه، فقام متسخِّطًا، فقال: لئن فعلتَ ذاك إنهم يزعمون أنَّك تدعو إلى الأمر وتخالفُ إلى غيره، فجعلتُ أزجرُه وأنهاه، فقال: "ما تقولُ؟ " قالوا: إنه يقول: كذا وكذا، فقال: "إن فعلتُ ذاك، فإنَّ ذاك عليَّ، ما عليهم منه شيءٌ، دَعْ له جِيرانَه" (3). ذكرُ مِخْمَر بن حَيْدة أخيهم (1) الثالث ﵁ -

It is narrated from Hakim bin Mu'awiyah bin Haydah, from his father, that he said to his brother Malik bin Haydah: Take us to the Messenger of Allah (peace and blessings be upon him), for he knows you and does not know me; he (peace and blessings be upon him) has detained some of my neighbours (for some reason). So the two of them came to him (peace and blessings be upon him), and Malik bin Haydah said: O Messenger of Allah, I have accepted Islam and my neighbours have also become Muslims, so release them. He (peace and blessings be upon him) gave no answer. He said it again, and still received no answer. He stood up angrily and said: If you do this, people will say that you call to one thing and yourself do the opposite. (Mu'awiyah says:) I began to rebuke him and stop him. He (peace and blessings be upon him) asked: "What is he saying?" The people told him that he was saying such-and-such. So he (peace and blessings be upon him) said: "If I have done that, its burden will be upon me; nothing of it will fall upon them. Release his neighbours to him."

Grading: (3) Its chain is hasan because of Hakim bin Mu'awiyah.
Technical note / Defect ('illah): Abu Qaza'ah: he is Suwayd bin Hujayr bin Bayan al-Bahili.
وأخرجه أحمد 33/ (20014) عن عفان بن مسلم، عن حماد بن سلمة، بهذا الإسناد. وفي رواية عفان: أنَّ أخا معاويةَ مالكًا قال: يا معاويةُ، إنَّ محمدًا أخذ جيراني فانطلِقْ إليه، فإنه قد عرفك وكلَّمك. وهو الصواب. وانظر "طبقات ابن سعد" 9/ 34.
Reference / Source: It was narrated by Ahmad 33/ (20014) from Affan bin Muslim, from Hammad bin Salamah, with this same chain.
Technical note / Defect ('illah): In the narration of Affan: "Mu'awiyah's brother Malik said: O Mu'awiyah, Muhammad (peace and blessings be upon him) has seized my neighbours, so go to him, for he knows you and has spoken with you." And this is the correct version. See also "Tabaqat Ibn Sa'd" 9/ 34.
وسلف برقم (432) من طريق بهز بن حكيم عن أبيه.
Details of the narration: This hadith has already passed at number (432) through the route of Bahz bin Hakim from his father.

Note / Clarification: (1) In the manuscripts it is "akhuhum", whereas the correct form is what we have established.
