Mustadrak al-Hakim — Hadith 6596

حدثني علي بن عيسى، حدثنا الحسين بن محمد بن زياد، حدثنا إسحاق ابن إبراهيم، أخبرنا جَرِير، عن سماك بن موسى قال: لمَّا دَخَلَ أنسٌ على الحَجّاج أَمَر بوَجْئ عُنقِه، ثم قال: يا أهل الشام، أتعرِفون هذا؟ هذا خادمُ رسول الله ﷺ، ثم قال: تدرون لِمَ وَجَأْتُ عنقَه؟ قالوا: الأميرُ أعلم، قال: إنه كان بيِّنَ البلاءِ في الفتنة الأولى، غاشَّ الصدر في الفتنة الآخرة (1). قال جرير: فحدَّثَني محمدُ بن المغيرة قال: كان الحجَّاجُ يَطُوفُ به في العساكر، فكَتَبَ أنسٌ إلى عبد الملك: أرأيتُم لو أتاكم خادمُ موسى، أكنتم تُؤذونَه؟ فكتب عبدُ الملك إلى الحجَّاج: أنْ دَعْهُ فليَسكُن حيث شاء من البلاد، ولا تَعرِضْ له، وكتب إلى أنس: إنه ليس لأحدٍ عليك سلطانٌ دُوني (2).

It is narrated from Simak bin Musa that he said: When Sayyiduna Anas (may Allah be pleased with him) went in to al-Hajjaj, he ordered that he be struck on the neck. Then he said to the people of Syria: "Do you know this man? This is the servant of the Messenger of Allah (peace and blessings be upon him)." Then he asked: "Do you know why I had his neck struck?" The people said: "The Amir knows best." He said: "He was a source of trial in the first fitnah, and in the later fitnah too his breast was full of deceit." Muhammad bin al-Mughirah says: Al-Hajjaj used to parade him around the army camps to humiliate him, so Sayyiduna Anas (may Allah be pleased with him) wrote to the Caliph Abd al-Malik bin Marwan: "What do you think: if the servant of Sayyiduna Musa (peace be upon him) came to you, would you harm him like this?" So Abd al-Malik wrote to al-Hajjaj: "Leave him alone; let him live wherever he wishes, and do not interfere with him." And he wrote to Sayyiduna Anas (may Allah be pleased with him): "No one other than me has any authority over you."

(1) إسناده جيد، سماك بن موسى قال أبو زرعة الرازي كما في "الجرح والتعديل" 4/ 321: لا بأس به. ومن دونه ثقات. إسحاق بن إبراهيم: هو ابن راهويه، وجرير: هو ابن عبد الحميد.
Grading: Its chain is "jayyid" (good).
Technical note / Defect ('illah): Regarding Simak bin Musa, Abu Zur'ah al-Razi said there is no harm in him (la ba'sa bihi). All the remaining narrators are thiqah (trustworthy). Ishaq bin Ibrahim is "Ibn Rahawayh" and Jarir is "Ibn 'Abd al-Hamid".
وأراد الحجاج بالفتنة الأولى: ما جرى بين علي بن أبي طالب ومعاوية من الخلاف، وبالفتنة الثانية: فتنة ابن الأشعث، والله تعالى أعلم. وانظر "سير أعلام النبلاء" 3/ 402.
Important point: By the "first fitnah" al-Hajjaj meant the dispute that took place between 'Ali and Mu'awiyah (may Allah be pleased with them both), and by the "second fitnah" the fitnah of Ibn al-Ash'ath. And Allah knows best.

(2) محمد بن المغيرة هذا يغلب على ظننا أنه أبو علي البصري مولى الأُمويِّين، فهو في هذه الطبقة، وهذا مجهول، وذكره ابن حبان في "ثقاته" 7/ 434، وخبره هذا معضل، فهو لم يدرك زمن الحجّاج.
Grading: This report is "mu'dal" (two or more consecutive narrators missing from the chain).
Technical note / Defect ('illah): Most likely Muhammad bin al-Mughirah is "Abu 'Ali al-Basri" (a client of the Umayyads), who is majhul (unknown), although Ibn Hibban mentioned him in "al-Thiqat". He did not live in the time of al-Hajjaj, so the report is broken.
