Mustadrak al-Hakim — Hadith 6439

حدثني محمد بن صالح بن هانئ، حدثنا جعفر بن محمد بن سَوّار، حدثنا قُتَيبة بن سعيد، أخبرنا جرير، عن سالم بن أبي حَفْصة، عن عبد الله بن مُلَيْل العِجْلي قال: سمعتُ ابن عبّاس قبل موته بثلاثٍ يقول: اللهمَّ إني أتوبُ إليك ممّا كنت أُفتي الناسَ في الصَّرْف (1).
هذا حديث صحيح الإسناد، وهو من أجلِّ مناقبِ عبد الله بن عبّاس: أنه رَجَعَ عن فتوى لم يُنقَمْ عليه في شيءٍ غيرِها.

Abdullah bin Mulayl al-Ijli narrates: I heard Sayyiduna Ibn Abbas (may Allah be pleased with them both), three days before his death, saying: "O Allah, I repent to You from the fatwas I used to give the people concerning sarf (the exchange of currency)."
This hadith has an authentic chain (sahih al-isnad), and it is among the greatest merits of Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that he retracted the one opinion for which, apart from it, nothing else of his was objected to.

(1) خبر صحيح، وهذا إسناد حسن من أجل سالم بن أبي حفصة وشيخه ابن مُليل جرير: هو ابن عبد الحميد.
Grading: This report is sahih; however, this particular chain is "hasan" because of Salim bin Abi Hafsah and his shaykh Ibn Mulayl.
Technical note / Defect ('illah): "Jarir" in the chain refers to Jarir bin 'Abd al-Hamid.
وروى نحوه عن ابن عبّاس أبو الشعثاء جابر بن زيد عند الطبراني (456) و (457) بإسناد جيد. ورواه مفصَّلًا عن ابن عبّاس أبو الجوزاء الربعي عند أحمد 18/ (11479) - وهو عند ابن ماجه مختصرًا (2258) - قال: سألتُ ابن عباس عن الصرف، يدًا بيد، فقال: لا بأس بذلك اثنين بواحدٍ، أكثر من ذلك وأقل، قال أبو الجوزاء: ثم حججتُ مرة أخرى والشيخُ حي - يعني ابن عبّاس - فأتيته فسألته عن الصرف، فقال: وزنًا بوزنٍ فقلت: إنك قد أفتيتني اثنين بواحد، فلم أزل أُفتي به منذ أفتيتني، فقال: إنَّ ذلك كان عن رأيي، وهذا أبو سعيد الخدري يحدِّث عن رسول الله ﷺ، فتركتُ رأيي إلى حديث رسول الله ﷺ.
Grading: A similar narration was reported by Abu al-Sha'tha' Jabir bin Zayd from Ibn 'Abbas (may Allah be pleased with them both), in al-Tabarani (456, 457), with a "jayyid" (good) chain.
Details of the narration: Abu al-Jawza' al-Rab'i transmitted it in detail in Musnad Ahmad (18/ 11479) (and it is in Ibn Majah 2258 in abridged form): he asked Ibn 'Abbas about sarf (currency exchange), and he permitted two for one; but when they met again on another Hajj, Ibn 'Abbas said that the exchange must be weight for weight. When Abu al-Jawza' mentioned the earlier fatwa, Ibn 'Abbas said these historic words: "That was my own opinion, but now Abu Sa'id al-Khudri (may Allah be pleased with him) narrates a hadith from the Messenger of Allah (peace and blessings be upon him), so I have abandoned my opinion and adopted the hadith of the Messenger (peace and blessings be upon him)."
