اُردوEn
وبإسناده عن بلال بن الحارث المُزَنِي: أنَّ النبيَّ ﷺ قَضَى باليمين مع الشاهد (2). ذكر صفوان بن المعطَّل السُّلَمي ﵁-
It is narrated from Sayyiduna Bilal bin al-Harith al-Muzani (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) gave judgment on the basis of one witness together with the oath (of the claimant).

(2) حديث صحيح لكن من حديث أبي هريرة، وهذا الإسناد وهمَ فيه الدراوردي فجعله من حديث ربيعة عن الحارث بن بلال عن أبيه كما وقع في رواية سريج بن النعمان عنه هنا، ورواية إبراهيم بن أبي الوزير عنه عند الطبراني (1139).
Grading: This hadith is sahih in origin, but it is from the narration of Abu Hurayrah.
Technical note / Defect ('illah): Al-Darawardi erred in this chain, narrating it as Rabi'ah from al-Harith bin Bilal from his father, as occurred here in the narration of Surayj bin al-Nu'man and in al-Tabarani (1139) in the narration of Ibrahim bin Abi al-Wazir.
ورواه عن الدراوردي على الصواب أبو مصعب الزهري ويعقوب بن إبراهيم الدورقي عند أبي داود (3610)، وابن ماجه (2368)، والترمذي (1343)، فجعلاه من حديثه عن ربيعة بن أبي عبد الرحمن، عن سهيل بن أبي صالح، عن أبيه، عن أبي هريرة قال: قضى رسول الله ﷺ باليمين مع الشاهد. وهو المحفوظ.
Grading: The "mahfuz" (correct) route of this narration is the one narrated from al-Darawardi by Abu Mus'ab al-Zuhri and Ya'qub al-Dawraqi (Abu Dawud 3610, Ibn Majah 2368, al-Tirmidhi 1343): Rabi'ah from Suhayl bin Abi Salih from his father from Abu Hurayrah: "The Messenger of Allah (peace and blessings be upon him) judged on the basis of one witness together with the oath (of the claimant)."
فقد رواه هكذا عبد الله بن وهب، عن سليمان بن بلال التيمي عن ربيعة، عن سهيل، عن أبيه، عن أبي هريرة. أخرجه ابن حبان (5073).
Reference / Source: Ibn Wahb narrated it with this same (correct) chain, from Sulayman bin Bilal al-Taymi from Rabi'ah from Suhayl, and Ibn Hibban (5073) recorded it.
وأخرجه النسائي (5969) من طريق المغيرة بن عبد الرحمن، عن أبي الزناد، عن الأعرج، عن أبي هريرة. وهذا إسناد حسن.
Grading: Imam al-Nasa'i (5969) narrated it through the chain of al-Mughirah bin 'Abd al-Rahman from Abu al-Zinad, which is "hasan".
